Ohio gym teacher charged with allegedly doing members of football team gets 4 years, lifetime SO registration

An Ohio teacher has been charged with 16 counts of sexual battery and 3 misdemeanor counts of offenses involving underage persons for allegedly having sex with football team members and providing them alcohol at the high school she worked at. Stacy Schuler of Springboro OH, was charged by the Warren County Prosecutor's Office after parents went to the authorities regarding their sons' sexual contact with Schuler. Schuler, a health and physical education teacher at the 3,048 student-populated Mason High School, has been under investigation by police after an anonymous tip was given to school officials during the week of Jan. 10, according to Tracey Carson, schools spokeswoman. Carson said Schuler was placed on paid administrative leave on Jan. 18. During that time, Schuler was prohibited from attending district events or being on district property.

Chief Assistant Prosecutor Bruce McGary said the allegations did not happen at a party. Mason police Detective Toni Hoelke said when the parents of the students found out about the allegations, they “were surprised and that they had no idea about it.”

The Mason High School teacher, who turns 33 next week, was arraigned in Warren County Common Pleas Court Friday, February 4 and is currently being held on $50,000 bond, which she has not yet raised, according to her attorney, Charlie Rittgers of Lebanon, OH.

“We knew she was being investigated. There has been no discovery from prosecutors and we’ll be starting our own investigation.” Rittgers also stated that if she made bond, thought to be unlikely before the end of the weekend, she would have to wear a GPS monitoring device. and stay away from the victims and other Mason High students. “Anytime a teacher is accused of having sex with students, it gets peoples attention. It doesn’t surprise me with those allegations.”

Mason High school mother Ginnie Sclosser said that "It is just heartbreak all over, and I especially feel bad for the students that were involved and my heart breaks for their parents, too. It's just a bad situation for everybody,"

Schuler graduated from Centerville High School in 1996 and Wright State University in 2000. She was a student teacher at Fairmont High School in Kettering from 1999-2000, according to her file.Her duties included work as an athletic trainer for the high school’s girls and boys sports teams. She earned $53,194 in 2008, according to her personnel file.

In her Health Education Philosophy as part of her application to work at Mason, Schuler wrote that she wanted to teach students about major risk factors for teenagers including “sexual behaviors that result in disease, STDs, and unwanted pregnancies.” Part of her mission statement included “Today’s society has its own standards of behavior, values, and norms that do not necessarily reflect healthy living...How can a child who is sexually active as a teenager learn about STDs and how to prevent unwanted pregnancies?”

Mason superintendent Superintendent Kevin Bright said that “Our job at the end of the day, is to partner with our families and to empower our staff to report anything that seems out of line, and then to act swiftly when someone behaves inappropriately. He also said his district “acted swiftly, partnered with police immediately, and we are standing her[e] today because of how seriously our high school principal took an anonymous tip.”

 

The principal of Mason High, Mindy McCarty-Stewart sent out a e-mail to parents January 31. She said that “As high school principal, I am committed to the safety and well-being of our students, and will not tolerate behavior that does not conform to that goal. Our staff is prepared to help our students during this situation, and know how it important it is to continue to build trust with our students and families.”

 

Schuler isn't the only Mason High employee who has been embroiled in this scandal. George Coates, an assistant Mason High principal, allegedly sent Schuler sexually explicit images. Coates turned in his resignation and the Mason High School board is voting on whether to accept it at their upcoming Tuesday meeting. The school board is also voting on whether to suspend Schuler without pay and beging termination procedures against her at the meeting.

(Update 2-9-11) Schuler was released on her own recognisance yesterday. Conditions of release include a 8PM to 6AM curfew, no contact with any minors or high school students over 18, and no drugs or alcohol. The now former teacher must also wear a GPS device.

During the Mason School Board meeting last night, the board unanimously accepted the resignation of Schuler, who has submitted a letter of resignation Monday. They also accepted the resignation of former assistant principal George Coates. Despite this, Dr. Kevin Bright, Mason School District superintendent, faced calls from parents to also resign. One said "All this stuff happened under his watch." and another said, "It's your policies that now have cost the children their innocence. You ought to get out of Mason. Just get out of Mason. Get out."

Bright said that he reported the allegations to the Ohio Department Of Education, and "While we had begun the process to terminate Ms. Schuler, we received her resignation today and believe that accepting it will save the district a lot of legal fees, which is in the best interest of our taxpayers and students."

(Update 10-28-11) After a three day bench trial, Stacy Schuler was convicted of 16 felony counts of sexual battery and three misdemeanor counts of giving alcohol to minors in a Warren County, OH courtroom yesterday. The presiding judge was Judge Robert Peeler. All five teenage boys were over Ohio's age of cpnsent, which is normally 16, but does not exist when there is a position of formal authority.

All five teens, who were about 17 years old at time, testified that Schuler was drinking alcohol at the time of the alleged incidents, was a willing participant in the acts and initiated much of the contact.

One of the teens testified they considered Schuler’s home a safe place to get high. Several said they were high on marijuana during sex with Schuler and that she made them vodka smoothies and served them beer and peach wine.

Originally, Schuler plead not guilty to all charges, but changed her plea to guilty by reason on insanity, a plea which according to a prosecution witness, was planned by Schuler before she was formally charged. During Thursday's closing arguments, Assistant Warren County Prosecutor Teresa Hiett said that "She got drunk and made some really poor choices. Does that mean she’s insane? No. She was the adult. She was the teacher. She had the trust. It’s the relationship between the defendant and the victims that makes this a crime.”

Defense attorney Charlie Rittgers said that her condition was caused by a mixture of bipolar disorder, Zoloft, an antidepressant drug, and alcohol."The underlying disease is the bipolar. The catalyst is the Zoloft magnified by the alcohol.”

Rittgers said it didn’t make sense that a person with Christian values would risk her livelihood and freedom, and said that the evidence supported an insanity defense.

“They want us to believe that all of a sudden after 10 years teaching, she wants to throw it away to have sex with five different guys,” he told the judge. “It’s far more reasonable to believe Stacy was suffering from an underlying psychological disorder.”

Judge Peeler said that while the defense argument about the adverse reaction of alcohol and drugs or an underlying condition may explain Schuler's behavior, it does not excuse it. Being voluntarily drunk was no excuse for taking advantage of students, and that it would be "a leap" to suggest that Schuler did not appreciate the wrongfulness of her conduct.

Before the verdict, the mother of one of the victims took the stand and said while crying, "These young men may appear as if they are tough guys, but in reality they are truly hurting. (Schuler) played on their emotions and she crossed the line.”

The four year prison sentence comes with an option for early release in six months. Besides the felony convictions of sexual battery, Schuler must register as a Tier 3 sex offender every 90 days for the rest of her life. Schuler resigned as a gym teacher from Mason High school back in February.

Woman charged with biting boyfriend's lip off during fight

A 26 year old Las Cruces, NM woman is facing a third degree felony charge after biting her "boyfriend's" lip off during an argument on Sunday May 1, 2011. Aurelia Lorena Reyes, 26, is charged with one count of aggravated battery against a household member causing great bodily injury, a third-degree felony.

At around 11 p.m. Sunday, Las Cruces police were called to the Coachlight Inn at 301 S. Motel Blvd., where officers found the victim with a bloody face. The 35-year-old man was taken to a local hospital and then, because of the severity of his injuries, to University Medical Center of El Paso. His injuries are not life-threatening.

According to Las Cruces police, Reyes had an argument with her boyfriend, who told her to leave. Reyes became angry, so she grabbed the victim's head and bit off his upper lip, which was found about two feet from the entrance to their shared apartment. After hiding out in a neighboring school parking lot, Reyes turned herself it Monday, May 2 morning. Reyes is currently being held on $10,000 bond in the Dona Ana County Detention Center.

Long term substitute teacher charged with misconduct with three boys

A British literature teacher who allegedly had sexual relationships with three Bay City Central High School students is free on $100,000 bond. 41 year old Heidi Lewis was charged with 6 counts of 3rd degree criminal sexual conduct, punishable by up to 15 years imprisonment.

While the AOC in Michigan is normally 16, Michigan state law raises the AOC to 18 when dealing with teacher student sex under normal circumstances The same law raises it to 26 when dealing with Michigan special needs students. Lewis was arrested after the "girlfriend" of one of the alleged victims told Assistant Principal Joseph Buggs that her beau had had sex with the teacher. The teacher was a long term substitute, who taught between January and June 2010.  This led to an interview with Buggs and a Bay City police officer.

The students, both 17, told Buggs and the officer they had been in Lewis’ class and that during the school year, their relationship had been of a typical teacher-student nature.

Near the end of the school year, Lewis and one of the students exchanged cell phone numbers, one of the teens said. A short while after school let out for the year, Lewis came over to the teen’s house and they had sex, the teen told investigators.

The second teen told investigators the first teen later told him of his relationship with Lewis while they were hanging out together. When the second teen said he did not believe his friend, the first teen called Lewis over to his house. Both teens then simultaneously had sex with Lewis, they said, according to court records.

Over time, the two teens told a third classmate about having sex with Lewis. Investigators interviewed the third teen, who claimed to have had sex with Lewis in the back of her silver Jeep Cherokee. This teen told his girlfriend what happened and she ended up passing the information to school authorities.

Lewis was arrested later that day. She was arraigned February 9, 2011 in Bay County District Judge Dawn A. Klida's courtroom.  Bay County Assistant Prosecutor Jordan E. Case asked that an additional stipulation prohibiting her from contact with minors be added to her release conditions. Defense attorney Richard Lee Jr objected, but Judge Klida granted the prosecution request.

Female swim coach charged with sexual abuse of 17 year old girl pleads guilty, sentenced to year in jail

Sarah Blessing, a 27 year old South Plainfield, NJ woman who is a 5th grade teacher and Edison, NJ swim coach, was charged Wednesday, December 2 with sexually exploiting a 17 year old swim student at Bishop George Ahr High School. Blessing was formally charged with sexual assault, criminal sexual contact and endangering the welfare of a girl, according to Middlesex County Prosecutor Bruce Kaplan and Edison police chief Thomas Bryan.

The relationship lasted for 6 months, from June to her arrest, according to officials, and was found out when Diocese of Metuchen officials notified Edison police. The Metuchen Dioscese fired Blessing from her swim coach job, a job she held for four years. "The Diocese and Bishop Ahr High School is shocked and saddened to learn of these allegations," officials said in a statement [December 1, 2009]. We, of course, take matters of this nature very seriously."

Blessing , a 5th grade teacher at Park Middle School in Scotch Plains, was suspended from that job pending the outcome of her case. She is being held on $150,000 bond without a cash option at the Middlesex County Jail in North Brunswick. Superior Court Judge James Mulvihill has ordered that Blessing not contact her victim.

(Update 8-6-10) Blessing plead guilty yesterday to criminal sexual contact and witness tampering in front of MIddlesex County Judge Judge Joseph Paone, according to prosecutors. She must forfeit her teaching certificate and the right to hold public sector jobs in New Jersey. Blessing must also undergo mental health treatment and have no contact with the victim or girls under 18 without supervision.

She is expected to be sentenced to a year in jail when Judge Paone formally sentences Blessing on September 30.

(Update 10-2-10) Blessing was sentenced to 364 days in jail and 5 years probation September 30, 2010 by Judge Paone. At the sentencing hearing,  Assistant Middlesex County Prosecutor Christie Bevacqua said that Blessing met the victim during a troubled period for the girl. The victim's mother asked Blessing to "watch out for her," but instead Blessing "took my daughter's innocence away." ""The betrayal of trust is a huge thing here," said Bevacqua.

Before the sentencing Blessing read a statement saying "I wasn't manipulative. It wasn't predatory. I had feelings for this person."

Blessing will not be allowed to have any contact with the victim or any unsupervised contact with females under the age of 18 and must undergo mental health counseling. Under the sentence, she can no longer teach and will be barred from holding public employment in New Jersey.

Blessing faced a maximum sentence of a decade behind bars. Criminal sexual contact is a felony which lands one on the sex offender list for life under New Jersey's Megan's Law.

Woman who allegedly staged shotgun murder of husband charged

A Minnesota woman who claimed that intruders killed her husband was charged with 2nd degree murder in Blue Earth County, MN on September 10. 26 year old James Nibbe was found shot to death early the morning of August 31 in his Lake Crystal, MN home. Jennifer claimed a masked intruder took James' shotgun, killed him, then fled on foot. Police poked holes in the story after learning that there were no footprints out of the house and that the Labrador the couple owned had stayed asleep during the killing.

Charges cite journal entries by Jennifer Nibbe that chronicle her dissatisfaction with her two-year marriage, her interest in another man and how "Sometimes I wish I could go back to just [my son, who is 17] and I plugging along."

The complaint describes Jennifer Nibbe, a nurse, as addicted to painkillers and deeply in debt. Just two months before he was killed with a single shotgun blast to the head, James Nibbe, 26, had taken out a $250,000 life insurance policy, naming his wife as the beneficiary.

On September 13, a judge set bail at $600,000 in front of a courtroom packed with both the suspect and the victim's family.

"Boyfriend" charged with 1st degree murder after shooting woman to death

A 23 year old woman was found shot to death in her South Side of Chicago apartment early Saturday morning and her 28 year old "boyfriend," Gerald Rufus was charged in her murder. Theresa Russell was found dead at the scene from a gunshot wound to the arm by police at around 2:32 AM Saturday, September 4.

Rufus was picked up after he was seen on top of the victim, who suffered a gunshot wound under the left armpit. He initially told police Russell was shot in front of the building at 6435 S. Morgan St. and he had taken the victim upstairs to the kitchen area, a police report said.

The man then changed his story and said the incident occurred on the back porch of the second floor apartment, and that the gunmen shot into the apartment from the back door, the report said. The man was taken into custody because witnesses gave conflicting statements indicating they heard a single shot fired inside the apartment and there was not evidence that a shooting happened in front of the building. Police later learned Russell was shot dead after arguing with Rufus.

Rufus faces 45 to 85 years in prison in convicted of 1st degree murder - 20 to 60 for the murder charge and 25 years for using a firearm.

Jackson Park rapist sentenced to 40 years for attacks

A convicted Chicago felon was held without bail for allegedly robbing and raping or fondling people at gunpoint who were visiting Jackson Park’s Osaka Japanese Garden. The rapes and robberies took place between June 24 and August 18. Assistant Cook County State’s Attorney George Canellis stated that the suspect, 40 year old Richard Martin often claimed he was robbed before robbing the victims of taking their cell phones, cash, and wallets. He accused some victims of robbing him before some attacks.

In all four attacks, women were either fondled or raped, according to Canellis. Once, Martin told a woman while fondling her that "she must keep money everywhere."

During an attack on Aug. 8, a woman ran to nearby bushes as her male friends, ages 26 and 17, gave Martin a cell phone, $250, a bank card and an ID, Canellis said. He then demanded to know where the woman, 25, went and used a flashlight to locate her. When he found her, he fondled her, Canellis said.

When Martin raped a 23-year-old woman in the June 24 incident, her frightened male friend jumped into a nearby lagoon, Canellis said. This distracted Martin assaulted the woman as she tried to retrieve her wallet, Canellis said. At that point, he told the woman, he “just wanted money anyway,” Canellis said.

Martin’s latest victims were a 50-year-old female and a 52-year-old male who had been walking over a bridge near a lagoon at the Osaka Japanese Garden, prosecutors sid.

Late Tuesday [August 18], he allegedly ordered the two to lie on the ground. Martin went through both victims’ pockets before raping the crying woman, Canellis said. He placed a gun at the woman’s throat when he assaulted her, Canellis said.

Jackson Park is located 7 miles to the south of downtown Chicago on Chicago's lakefront. It is close to the Hyde Park and South Shore neighborhoods.

(Update 8-6-10) Martin pleaded guilty yesterday in Cook County Circuit Court to 5 felonies - 3 counts of aggravated criminal sexual assault and two counts of aggravated criminal sexual abuse. Martin was sentenced to 40 years imprisonment, and will be required to serve 85%,  or 34 years, before release.

Juarez serial rapist caught - sentenced to 60 years imprisonment

An El Paso, TX man has been captured by Juarez, Mexico police after allegedly going across the border and raping females between 13 and 20. The rapes took places between 8 and 10 PM, and always Tuesdays and Fridays in neighborhoods near the Rio Grande. The 1st known assault happened April 4, 2008; the last assault was April 3, 2009. Jorge Alberto Mendez Navarro, 43, has been officially charged with the rape of a 17 yera old girl March 24, but suspected in 18 other gunpoint rapes.

Mendez, who allegedly used a handgun, in some cases forced his way into a victim's home and claimed to be a hit man. He allegedly told women not to tell anyone or he would kill them, officials said. There were up to three victims in some assaults. On occasion, Mendez was allegedly nude wearing only black gloves and a tan panty- hose with eye-holes on his head during the attacks. Investigators said Mendez allegedly told one girl that he wasn't from Juárez.

The break in the case came after Mendez broke into two 19 year old women's homes, but was scared off by the victims' relative. The relative took down Mendez's license plate number, and Chihuahua State investigators arrested Mendez when he crossed the border in his 1997 Chevy Tahoe. Clothing, porn, and a Kia sedan were also seized.

Juarez is infamous for its drug related shootings due to the narcotics trade. In the late 1990s and early 2000s, it was the scene of hundereds of femicides (killings of women). Most of these killings are still unsolved.

(Update 7-22-10) Last week, after a two week trial in a Chihuahua, Mexico courtroom, Mendez was sentenced to 60 years imprisonment and an over 60,000 peso fine for the rapes of the girls and young women. Mendez was found guilty of aggravated rape, rape, child pornography, and sexual abuse.

Prison teacher's aide charged with sexual activity with inmates

A teacher's assistant who had 6 years on the job at a New Jersey prison for sex offenders was charged with 5 counts of sexual assault, official misconduct, and drug distribution.  Joy R. Black, 32 of Irvington, NJ was charged with incidents at the East Jersey State Prison in Avenel, NJ which occured between November 2009 and June 2010, according to investigation. Black allegedly had sex with 5 inmates in prison classrooms and smuggled marijuana and cocaine inside the prison for use by two of those inmates.

Black has worked at the prison in the Avenel section of Woodbridge since June 12, 2004. Anyone with information on the case is asked to contact Sgt. Black was arrested at the prison June 30, 2010 and is currently facing a decade in prison, sex offender registration for life, and a lifetime ban on New Jersey public employment. She is being held at the Middlesex County Adult Correction Center in North Brunswick.

Marine faces charged in abduction, rape of N. Virginia woman

A US Marine has been charged with the rape of two Ballston, VA women who he followed home and assaulted at around 4AM on February 27, 2010. 21 year old Jorge "George" Torrez was charged with acts relating to the gunpoint rape and abduction of two women after they returned home from a meal. According to authorities, after Torrez forced them inside of their house, one of the women called 911 and hung up, leading him to flee with the other woman.

4 hours later, that woman was found in Prince William County VA, close to the edge of Marine Corps Base Quantico. Torrez was stationed in Ft. Myer, near the area of the attack. She had been raped, beaten and choked to within inches of her life before being dumped in the woods. Authorities arrested him within hours of the attack.

Arlington police on Friday [June 25] announced that they have charged Torrez with 14 criminal counts related to the North Wakefield Street attack, including abduction, rape, forcible sodomy, robbery, burglary with intent to commit sexual assault and use of a firearm during a felony.

Torrez was already in jail for a second attack which took place February 10, 2010, when he allegedly attempted to abduct a woman at gunpoint near a local high school, but settled for simply grabbing her purse. That attack led to a composite sketch which led to Torrez.

Arlington County spokeswoman Crystal Nosal, a detective, said "If these two cases are connected, there's obviously a clear escalation within two weeks. Two weeks ago the woman convinced him not to take her, and then he confronts two women and leaves one for dead in Prince William County."

Torrez, who joined the Marine Corps at 18 immediately after graduating from high school in Zion, Ill., served in Okinawa, Japan, for two years before moving to Northern Virginia last year, according to his family. He had a lifelong ambition to join the military, an ambition that solidified after the Sept. 11, 2001, terrorist attacks, his sister said.

Sara Torrez said her brother has been working at the Pentagon and seemed to be enjoying it, their discussions centering on whether he wanted to continue with a career in the Marine Corps or to leave, go to school and return to Illinois.

Torrez is being held in the Arlington County Jail without bond. His next court appearance was scheduled for July 26, but may be sooner in Prince William County officials file their own charges. Prosecutors are considering bringing attempted capital murder charges against Torrez because it appears that parts of the attack occurred in their jurisdiction and the attack included rape.

Entrepreneur & father of three killed - wife and employee charged in love triangle slaying

A West Goshen, Pennsylvania father of three and entrenpreneur was poisoned and bludgeoned to death with a shovel before being buried in a shallow grave next to a high school. The suspects are the victim's wife, 34 year old Morgan Mengel and 22 year old employee Stephen Shappell. The victim, according to police, is 33 year old Kevin Mengel Jr.  The suspects are 34 year old Morgan Mengel and Stephen Shappell, 22. According to the wife's Facebook page, they had been married since August 1998. The couple have 3 children.

According to officials, the plot began when Morgan and Steve began to "fall in love" at the business that the victim and Morgan ran together, M.K.B. Property Management LLC. The company does landscaping for homeowners and other property owners.

On June 17, she reportedly said, Shappell placed "some sort of drug" in a lemon Snapple, which Morgan Mengel then left on the hood of the pickup truck for Kevin Mengel to find. No one else who worked at the business drank Snapple, she reportedly told police, and she knew Kevin Mengel would drink it.

A short time later, according to court documents, she received a text from Shappell that said he had struck Kevin Mengel in the head with a shovel.

She reportedly asked if he was serious and he replied, "Dead serious." She then asked if there was a "pulse," police reports said, to which he replied "Get down here now." Morgan Mengel reportedly told police that Shappell told her he buried Kevin Mengel's body approximately 150 yards behind Marple Newtown High School, where he had been a student.

The beginning of the end for Morgan Mengel and Shappell's freedom came on Father's Day, when Kathleen Barton reported her son missing. She noted that her daughter-in-law told her that she had seen Kevin move out of their West Goshen, PA apartment on June 18. Still suspicious, Kathleen monitored her son's Facebook page and told West Goshen detectives about the affair. After her son's Facebook page was updated in a different style than he would use on June 23, detectives went to the victim's apartment.

While Morgan gave police the same story that she gave her mother-in-law, detectives saw the victim's clothes and toothbrush in the apartment. After being taken to the police station for an interview, Morgan Mengel admitted the affair and the murder.

According to West Goshen Police Department Chief Michael J. Carroll, "Normally a report of a missing person who's a 33-year-old adult male is sometimes not taken as seriously because they have the absolute right to be missing, they can go wherever they want to go. During the course of the week it became clear to our department that this was more than just a missing person case."

 We were able to identify and locate the victim by the use of a cadaver dog that was brought to us by the Search and Rescue Dogs of Pennsylvania in Malvern. I can tell you without the use of this dog, we would not have been able to find this body.

It's a very tragic case. The victim was the father of three children. Obviously the children have lost their father and with what has gone on so far they're going to lose their mother for an extended period of time.

Shappell was arrested in Denver the evening of Sunday, June 27. Carroll said "This was a direct result of cooperation between departments. It was through an investigation here. We knew where to look for him."

It is unknown what charges he'll face when he is extradited to Pennsylvania, but Morgan Mengel will be facing 1st degree murder and criminal homicide.

18 year old accused of sexual coercion, blackmail of HS students pleads guilty in suburban MIlwaukee courtroom, gets 15 years prison

An 18 year old man originally investigated for a bomb scare at the New Berlin High School was charged with sexual assault, and other offenses for coercing fellow male students into sex using Facebook. If found guilty on all charges, he faces 293 years in prison.

Anthony "Tony" Stancl, 18 was charged with posing as a girl to trick 31 boys, ranging in age from 13 to 19, into posing for nude pitcures. The boys, all Stancl's former classmates, were contacted through their Facebook pages. While posing as a girl, Stancl threatened to release the nude photos to the public unless the victims agreed to perform sex acts.

The sexual assaults occurred in 2008 in a bathroom at the high school, the school parking lot, a New Berlin Public Library restroom, parks and at some of the victims' homes, according to the criminal complaint. At least seven boys, 15 to 17, were forced into performing sex acts, the complaint says.
Police learned of Stancl's alleged activities after he was accused in a bomb threat that closed Eisenhower and one victim came forward to police.

Stancl, who was expelled after the bomb scare, is charged with a bomb threat, plus repeated sexual assault of same child (at least three violations of first- or second-degree sexual assault), possession of child pornography, second- and third-degree sexual assaults and five counts of child enticement.

The child porn charges stem from 600 photos of both commercial porn and about 300 photos/movie clips of the New Berlin victims found on Stancl's computer.

(Update 7-16-09) Waukesha County Circuit Judge J. Mac Davis lowered Stancl's bail from $250,000 to $75,000, a move which puts his release within reach. Defense attorney Craig M. Kuhary said that Stancl's parents were able to access $75,000 in their retirement funds. Stancl's parents will also pay the $20 per day electronic monitoring fee.

Kuhary said Stancl would like to get his high school diploma, possibly from New Berlin West or Waukesha County Technical College. Davis said he will allow Stancl to complete his education but he can be on school grounds only for scheduled purposes and with adult supervision.

Davis said Stancl would be allowed to go to the homes of his grandparents in West Allis and Hartland, his attorney's office, police departments and court. Stancl would not be permitted to use the library, access the Internet, or possess a cell phone.

District Attorney Brad Schimel objected to the bail reduction due to the severity of the charges and the potential maximum sentence in convicted. The New Berlin School District, through its Superintendent Paul Kreutzer, released a statement saying, in its entirety, "Mr. Anthony Stancl, under no circumstances, will be involved at any level with the School District of New Berlin."

(Update 12-22-09) Tony Stancl pled guilty before Waukesha County Circuit Judge James R. Kieffer to 2 counts of sexual assault on a child in a Waukesha County, WI courtroom today. 10 other charges against him were dropped by prosecutors as a result of the plea agreement. District Attorney Brad Schimel is asking for a substantial prison sentence, which could be as long as 30 years with 20 years of extended supervision after release. If Stancl had went to trial and been convicted on all charges, he would have faced 176 1/2 years in prison.

Schimel's view about the agreement and outcome of the case is below.

 I contacted each and every one of the victims in this matter and each of them felt that this was a very positive resolution of the case. It was important for them that this be resolved before the holidays....I've never had a case where victims and parents have been more apprehensive about testifying than in this case. There has been an enormous amount of publicity, maybe unprecedented in a child sexual assault case, and all happening in a school where all of the victims went, along with the defendant.

This resolution is something that is going to set them at ease in the coming weeks. This was going to continue to get more troubling to them as we approached trial. So this resolution is something that I view as a fair resolution and from the victims' perspective, they are relieved that we are doing this.

 I think a lot of parents learned something from this. Usually in child sexual assault cases...the media attention is relatively minor...This one has just attracted a lot of attention because it's bigger than what just happened here. There are people all over the country looking at this, I hope, and questioning what are kids up to. What are kids doing with their photo phones? What are they doing on their computers? There's been this other message beyond just dealing with the defendant and the victims.

(Update 2-25-10) Stancl was sentenced to 15 years in prison and 13 years of extended supervision this afternoon by Waukesha County Circuit Judge J. Mac Davis because as someone who has proven to been manipulative and self-centered, he was still potentially dangerous and "I am afraid of what he can and might do."

District Attorney Brad Schimel asked for "substantial" prison time, without being specific. No victims spoke at the sentencing, but some had sent letters asking for substantial prison time. Some of the victims required hospitalization for suicidal thoughts, medication or have had to undergo therapy, Schimel said.

Schimel said substantial prison time was needed because of the number of victims, the scheming nature of the crime and the impact on victims. He also said that the very nature of the crime - repeatedly coercing sex by extortion - was a pattern of deviant sexual behavior. Schimel also cited a 2004 juvenile case in which Stancl, then 13, was found delinquent for sexual assault of a 3-year old in a home where he was a babysitter.

Defense attorney Craig Kuhary suggested 5 years in prison with a decade of extended supervision, stating that Stancl's problems began after he was outed as gay by a former "lover" who went to his school. "Once word got out that he was gay, everything shut down," Kuhary said.

Stancl's uncle, Al Turk, from California spoke on behalf of the family saying his nephew and godson was loving, intelligent, athletic, a former altar boy and a technological whiz kid who worked at a software company while going to school and maintaining good grades.

"Like many young men his age, he's made a serious mistake," Turk said. Emphasizing his Catholic upbringing in a supportive and forgiving family, Turk said he remains a joy to his family who'll be there for him when his "penance" is served.

Stancl himself made a statement saying that he needed to treat others the way he wanted to be treated, and that after prison, "I am determined to become once again a productive and law-abiding citizen."

Besides prison, extended supervision, and the sex offender list, Stancl was banned from contact with the victims or their families, the New Berlin school district under any circumstances. He can't use the Internet or have contact with minors without correctional supervision after he gets out of prison.

Schimel explained his role in the prosecution of Stancl. "I had two jobs here. I had a job to get him locked up for some reasonable amount of time to protect the community, but I also had to look out for the welfare of these seven kids, and I think we struck that balance. I asked for substantial prison, and 15 years of initial confinement followed by 13 years of extended supervision is a substantial prison sentence that takes away Anthony Stancl's youth," said Schimel.

He also reiterated that parents must be on guard when it comes to electronic devices and protection from sexual predation. "They have to know that the more capability they give their kids electronically with this stuff, the less control they have over their kid's safety."
 
Last, but certainly not least, Schimel reminded parents that this was how most sex offenders work. "This is how sex offenders work. They compromise their victims. Very few of the sexual assaults we see involve some sort of person jumping out of the bushes and grabbing someone. Most of the time, it's someone that the victim knows, and they get manipulated into a position where it becomes difficult to say something, to speak out. That's what happened with these kids."

Second female teacher in as many months charged with child seduction at Indianapolis high school

For the second time in two months, a female employee at Indianapolis' Pike High School was charged with child seduction, a Class D felony. After school officials contacted Indianapolis police and after questioning the night of February 17, 40 year old Taine Abdullah was charged with an illegal sexual relationship with a 17 year old special needs student today.

According to a probable cause affidavit, Abdullah was an instructional assistant who tutored the boy after he returned to school in January. Police said that in one of three encounters, Abdullah performed oral sex on the boy and then texted him about the encounter, later asking him to delete the text because she could get in trouble for what she had done.

Investigators said that in a Feb. 5 incident, the boy skipped school and stayed at Abdullah's house, where they fondled each other.

"She admitted that she knew what she had done was wrong," according to the affadavit. Lieutenant Jeffery Duhamell stated why Abdullah was charged with child seduction when Indiana's AOC is normally 16. "She's a person of trust and he's a student, and that's supposedly how they met, and, basically, that crosses the line and becomes a criminal act."

Abdullah, who has worked as a teacher's aide at Pike High, has been removed from the classroom, according to officials. She's being held on $30,000 bond. Besides Abdullah, former coach Sara Strahm has been charged with the same crime for a relationship with a player on her girls' basketball team.

(Update 2-24-10) Abdullah pled not guilty at her arraignment yesterday. Her bond was reduced to $500, allowing her to be placed on house arrest until trial. Her attorney, Jack Crawford, described the conditions of house arrest.

"The judge was very firm. She cannot have any contact - she cannot even pick her daughter up at school or drop her off at school. She's gonna have to make different arrangements while this case is pending and that's understandable. The charges are serious. They involve young people, so while these charges are going on, she must avoid young people."

The reason Abdullah can't pick up or drop off her daughter is because she was fired from Pike High and barred from going onto the premises. She still has supporters from her church.

"She needs all the support she can get," said Anthony Chapman, a church member. "I'm not discounting the fact that she's made a mistake. But at these times it's important to have support of your church family."

Her church members have a message for the student and his family involved in this case. They're hoping the student's family can look past the alleged conduct.

"Hopefully they can find it in their heart to forgive. Its about forgiveness and reconciliation and in America you have a lot of high profile cases and celebrities who make mistakes as well as common people," said Chapman.

Abdullah faces 1 to 3 years in prison if convicted as charged.

Rapist released from prison charged with new rape after cutting off monitoring bracelet

A convicted Massachusetts rapist, who was out on probation after serving 8 to 9 years imprisonment for a previous rape, was charged with raping another woman last Thursday evening at about 11:30 PM local time. 29 year old William French had been released June 24 to his grandparents' custody in Framingham, MA for what was supposed to have been 6 years of parole, which he immediately violated January 4. Middlesex Superior Court Judge Howard Whitehead could have sent French back to prison, but ordered him to wear an electronic monitoring bracelet during a February 16 hearing.

The terms of French’s six-year probation require him to stay drug- and alcohol-free, submit to random drug screens, undergo sex offender treatment and have no contact with the victim.

In the prior rape case, French told the victim he had a gun and threatened to kill her and her 13-year-old daughter, who was sleeping in another room, if she did not comply, court records show. French’s record also includes a string of prior arrests for larceny, assault, threats, and burglary.

On Thursday at about 11:25 p.m., probation officials received an alert indicating that French had removed the GPS monitor from his leg, and an arrest warrant was issued at 11:45 p.m., the DA’s office said.

French was arrested early Friday morning, while the victim was treated and released from a local hospital. He was arraigned in Framingham District Court Friday afternoon by Judge Sara Singer and charged with the following - 2 counts of aggravated rape, kidnapping, assault and battery, unarmed robbery, threats to commit a crime, and removing the GPS monitoring device. He is currently being held without bail pending a dangerousness hearing scheduled February 25.

Suburban Milwaukee teacher, coach charged with sexual assault on female player

A Brown Deer, WI teacher and girls soccer coach has been charged with sexual exploitation of a student by school staff for sexual relationship with one of her soccer players. 26 year old Emily Patterson allegedly started the sexual relationship after the 16 year old victim began having problems with her home life. This eventually led to facebook contact and sleepovers, with Patterson and the girl fondling each other over clothes during a sleepover.

Patterson's contract with the Brown Deer School District ended with the 2008-2009 girls' soccer season. However she was still considered a volunteer coach because of her involvement with an open gym night for girls interested in playing soccer, according to the complaint.

The district said it has remained in dialogue with the Brown Deer Police Department about the investigation, and the school has counselors available. Administrators stated, "The safety and welfare of our students is always the district's highest priority."

Parents of Brown Deer High students said that the case reinforced that parents need to monitor the use of cell phones and social networking sites. Mother Neila Bond stated "Well, I think for one thing, they shouldn't have their home phone number or cell phone number that would be a clue that something might be a little off." 

Another mother, Cynthia Hines, stated that "Check e-mails, check Facebook. Check everything to have a conversation with your child."

Patterson is currently employed as a teacher at Mukwanago High School. Brown Deer and Mukwanago are suburbs of Milwaukee, WI.

Sunday School teacher stabbed to death outside of Wal-Mart - convicted sex offender suspect

A registered sex offender with a long criminal history in Arkansas was arrested outside his Oklahoma City trailer Saturday, February 6 and charged with the 1st degree murder of a 26 year old Sunday School teacher. Family members said that the victim, Nelly Pelts, made a habit of shopping lat at night inside the Del City Wal-Mart, all the while, witnessing and telling folks about her church, located next to the murder scene.

This habit turned tragic when Platts met James Allen O'Berry, 53, around 12:20 AM Saturday. The video shows O'Berry approaching Pelts and them leaving the store parking lot at 12:35 AM. According to O'Berry, they went outside of their cars then left with her. Next thing, according to O'Berry, he "blacked out" and at around 12:50 AM Saturday,  O'Berry stabbed the woman to death and struck her with his car. He was later found inside his Oklahoma City mobile home.

James Allen O'Berry, 53, was taken into custody late Saturday evening after surveillance video from the Del City Walmart was aired on several local television stations and two separate tipsters called with O'Berry's name and address.

When detectives and officers from Midwest City and Oklahoma City Police Department arrived at O'Berry's mobile home, 2401 SE 44th, Lot No. 50 in Oklahoma City, his 1997 Lincoln Towne car was parked outside.

The car matched the description given by the witness who saw the attack and also had damage to the left front and driver's side rear view mirror. Evidence gathered at the murder scene from the suspect's car was linked to O'Berry's Lincoln. The car also had blood inside.

Investigators recovered O'Berry's clothing which had been discarded and dumped in a trash bin near I-35 and SW 44th Street.

 

Search warrants have been conducted on O'Berry's home and car in which additional evidence has been recovered. O'Berry had changed his appearance by cutting his hair and also suffered a laceration to his left arm during the attack which required medical treatment prior to him being jailed.

  We are extremely grateful to Walmart for providing photos of our suspect, to the media for airing those almost instantaneously, and to our tipsters who called in which lead to O'Berry's identification .A tremendous amount of manpower was allocated to solve this brutal homicide, and everyone worked tirelessly for justice. You have a young, innocent woman who devotes her life to her faith and because of this, becomes targeted by a sexual predator and ultimately killed. Basically within a time span of twenty minutes, James O'Berry tracked his prey and viciously killed her.

Brian Bates, the "Video Vigilante" who prevents johns from picking up prostitutes on a particular stretch of Oklahoma City highway, said that O'Berry tried to assault him, and heard from people who knew the convict after posting the video online. "All of those emails came with a warning he's a very violent man," Bates said.

Bates said he filed a complaint with the police department. But in the meantime, he tried to prevent O'Berry from soliciting prostitutes.

"My only fear is since the police didn't act on my video and didn't charge this guy with some sort of probation violation, he was then allowed to perpetrate this murder," Bates said.

District Attorney David Prate said he's been in contact with Brian Bates about the complaint he filed at the police department. Prater said he's trying to find out what happened and if O'Berry's probation could have been revoked, which may have prevented the murder of Nelly Pelts.

The Midwest City police department is currently holding O'Berry on a 1st degree murder complaint and is questioning him to see if more crimes can be traced to him.

Besides this case, O'Berry is named as a suspect in two other Oklahoma City police cases. In one, a 26 year old women complained that she started to be stalked after O'Bery met her at her southeast Oklahoma City church. A second woman alleges that as a police impersonator, O'Berry pulled her over in her car and raped her.

New Britain, CT woman files restraining order 8 days before murder, allegedly by husband

A Connecticut mother of 3's restraining order, dated January 27,  paints a grim picture of events leading up to her February 4 death, allegedly by her husband. In it, 30 year old Dia Palafox made allegations against her husband on about a year, 32 year old Juan Palafox, saying that he threatened to kill her and take her kids to Mexico.

The victim's mother found her daughter on the floor of the younger couple's New Britain home. The children, 6, 5 and 2, werein the house but unaware of what had happened. The Connecticut Medical Examiner's Office ruled Dia Palafox's death a murder by multiple stab wounds.

The restraining order filed last week paints grim a picture of the couple's last month together, which, according to court documents, was colored by physical and verbal abuse.

"My husband was drinking. He punched me in the face. Took me by the hair and hit my head twice on the bathtub. He also grabbed scissors and threatened to kill me," Dia Palafox wrote of the incidents that unfolded on Jan. 16.

The abuse also was sexual, she writes. Juan Palafox "forced himself on me for sex. I said 'no' numerous times," Dia wrote of an attack on Jan. 1. "He said I'm his wife and it's not rape."

She also went to a friend's house more than once in January, in fear of her life. During one of those trips, Juan showed up yelling at her to "get out of the car or he will hurt me," Dia wrote. "The children witnessed this."

On the last date listed in court papers, Jan. 27, Dia describes coming home from work and being met with verbal accusations that she was having an affair. A friend she was speaking with over the phone called police.

Throughout their last few weeks together, Juan harassed Dia "on a daily basis," she wrote, "stating that he will take my kids to Mexico and I will never see them again."

Juan Palafox was pulled over in North Carolina for speeding, and is on his way to being extradited back to Connecticut. This was not the first time that he had been violent towards his victims. in 2002, his pregnant 23 year old girlfriend was threatened with a knife, though the records surrounding the case are sealed.

Man held in beating, rape, murder attempt on 91 year old woman

Leslie James Setzer, 34, of East Stroudsburg, PA, was charged with the rape, beating, and attempted murder of a 91 year old woman on Saturday, November 28. Patrolman Kevin Buck of Palmerton, PA was called to the victim's house just before 2 PM, and said that after a man asked to use her phone, he struck her in the head, raped her, and attempted to smother her with a plastic bag.

When the man fled, the victim called police. Buck said the victim provided a description of her attacker and it matched the description of a man who had just walked into the emergency room at Palmerton Hospital ''stating that he needed help.''

Police arrested Setzer at the hospital. The victim has been at Lehigh Valley Hospital-Cedar Crest since the attack. Buck said she has been upgraded to stable condition.

Buck said that the attack was a random act perpetrated by a stranger. Besides the rape, attempte murder, and beating charges, Setzer also faces aggravated assault, indecent assault, and aggravated indecent assault.

He is currently being held on $1 million bail at the Carbon County Prison.

Mother of 2's remains found - husband charged

After a 14 month search, the parents of a North Carolina mother of 2 were relieved after discovering the remains of their daughter inside of the Tar River Fox Pen. The remains of Kelly Morris, 28, was found last week in the hunting tract, located near Creedmore, NC. She disappeared after leaving from her stepmother's house September 3, 2008, and the next morning, firefighters were called to the Granville County home she shared with her husband and accused murderer, William Scott Morris, 35. The fire was determined to be arson, yet there was no sign of Kelly.

In the next few days, Kelly's dad, Pat Currin began the search for Kelly, which quickly turned into a search for her remains. "Fourteen months - I really don't have much to say right now," he said after learning his daughter's remains were found. Kelly's mother, Wanda Hollis, said "I knew that this day would come eventually. It's like a brick lifted off your chest. I'm glad I didn't have to wait five years, or 10 years."

[Al] Mignacci, a retired IBM engineer, took the search's lead within a month of her disappearance. It wasn't his first missing-person chase. Two years before, he helped look for a Lee County woman thought to be abducted. Just last week, he was helping to find a 5-year-old Fayetteville girl killed and hidden under thick kudzu.

For Morris, Mignacci set up inside the workshop of Currin's construction company, plotting a 15-mile radius from her house, divvying up roads to other volunteers, highlighting all the combed-over territory in yellow.

When he heard the news that Morris had been found at Tar River Fox Pen, he recalled walking outside the fence line along Sam Moss-Hayes Road, passing maybe a few hundred feet from where she was found. Inside, he said, sportsmen bring dogs to chase the foxes and coyotes that wander over roughly 900 acres. A 4-foot fence surrounds the property, and dogs can be heard howling inside from the road.

On Wednesday, at least a dozen State Bureau of Investigation agents and sheriff's deputies were again walking that the fence line, this time inside and lined up abreast with wooden staffs to poke through the leaves and underbrush.

Meanwhile, Morris made his first court appearance in Oxford, NC, where he was being held without bail on 1st degree murder and arson charges. He faces the death penalty. Mignacci said, while going over new areas to find Kelly's remains, that  "It's been a long, tough struggle. A lot of kind searchers put in a lot of time."

Masseur with property crime history accused of fondling customer

A masseur with a history of property crimes, including 1st degree burglary, was accused of fondling and molesting a long time customer of the massage business that he worked for. The 35 year old victim claimed that Joshua Shane Beach, 25, fondled her breasts, genitals, and performed oral sex on her during the 1 1/2 hour "massage" section.

Pam Henrichs, Beach's manager, said that she wasn't awars of his criminal history, but appeared to be a legitimate - and popular masseur.  "He's only been here a month and was doing good. He had a number of repeat (customers), including her. I was impressed with him and his knowledge about massage." The victim was a client of the facility for 12 years.

During questioning by detectives, Beach admitted fondling and performing oral sex with the alleged victim, apologizing to the woman for making her "uncomfortable."
