Suspect in rape of ex-girlfriend ordered bound for trial

An alleged rapist of his ex-girlfriend has been ordered to stand trial for his crime. Charles Joseph Carter, 39, of San Ramon, faces 25 years to life in prison from not only the state's 3-strikes law, but also a one-strike sexual assault law.

According to prosecutors, on June 15, Carter attended a party with a woman with whom he had broken up the previous month but had remained friends. After the event, he drove her home to Foster City and asked to sleep on her couch because he was too drunk to drive, she told police. After a half hour, she reported, Carter entered her bedroom and forcibly raped her.

Foster City police arrested Carter but he was released from jail after posting bail. After learning of 1990 convictions and prison sentence for rape and sexual penetration with a foreign object out of San Francisco County, investigators received a no-bail arrest warrant in August.
Police also learned he failed to register in Contra Costa County as a sex offender, according to Foster City police at the time of his early September arrest.


The judge, which is unnamed, found sufficient evidence for Carter to be held (without bail) on the charges. He will be back in court January 18 to enter a plea and for setting of his trial date.
