Ohio gym teacher charged with allegedly doing members of football team gets 4 years, lifetime SO registration

An Ohio teacher has been charged with 16 counts of sexual battery and 3 misdemeanor counts of offenses involving underage persons for allegedly having sex with football team members and providing them alcohol at the high school she worked at. Stacy Schuler of Springboro OH, was charged by the Warren County Prosecutor's Office after parents went to the authorities regarding their sons' sexual contact with Schuler. Schuler, a health and physical education teacher at the 3,048 student-populated Mason High School, has been under investigation by police after an anonymous tip was given to school officials during the week of Jan. 10, according to Tracey Carson, schools spokeswoman. Carson said Schuler was placed on paid administrative leave on Jan. 18. During that time, Schuler was prohibited from attending district events or being on district property.

Chief Assistant Prosecutor Bruce McGary said the allegations did not happen at a party. Mason police Detective Toni Hoelke said when the parents of the students found out about the allegations, they “were surprised and that they had no idea about it.”

The Mason High School teacher, who turns 33 next week, was arraigned in Warren County Common Pleas Court Friday, February 4 and is currently being held on $50,000 bond, which she has not yet raised, according to her attorney, Charlie Rittgers of Lebanon, OH.

“We knew she was being investigated. There has been no discovery from prosecutors and we’ll be starting our own investigation.” Rittgers also stated that if she made bond, thought to be unlikely before the end of the weekend, she would have to wear a GPS monitoring device. and stay away from the victims and other Mason High students. “Anytime a teacher is accused of having sex with students, it gets peoples attention. It doesn’t surprise me with those allegations.”

Mason High school mother Ginnie Sclosser said that "It is just heartbreak all over, and I especially feel bad for the students that were involved and my heart breaks for their parents, too. It's just a bad situation for everybody,"

Schuler graduated from Centerville High School in 1996 and Wright State University in 2000. She was a student teacher at Fairmont High School in Kettering from 1999-2000, according to her file.Her duties included work as an athletic trainer for the high school’s girls and boys sports teams. She earned $53,194 in 2008, according to her personnel file.

In her Health Education Philosophy as part of her application to work at Mason, Schuler wrote that she wanted to teach students about major risk factors for teenagers including “sexual behaviors that result in disease, STDs, and unwanted pregnancies.” Part of her mission statement included “Today’s society has its own standards of behavior, values, and norms that do not necessarily reflect healthy living...How can a child who is sexually active as a teenager learn about STDs and how to prevent unwanted pregnancies?”

Mason superintendent Superintendent Kevin Bright said that “Our job at the end of the day, is to partner with our families and to empower our staff to report anything that seems out of line, and then to act swiftly when someone behaves inappropriately. He also said his district “acted swiftly, partnered with police immediately, and we are standing her[e] today because of how seriously our high school principal took an anonymous tip.”

The principal of Mason High, Mindy McCarty-Stewart sent out a e-mail to parents January 31. She said that “As high school principal, I am committed to the safety and well-being of our students, and will not tolerate behavior that does not conform to that goal. Our staff is prepared to help our students during this situation, and know how it important it is to continue to build trust with our students and families.”

Schuler isn't the only Mason High employee who has been embroiled in this scandal. George Coates, an assistant Mason High principal, allegedly sent Schuler sexually explicit images. Coates turned in his resignation and the Mason High School board is voting on whether to accept it at their upcoming Tuesday meeting. The school board is also voting on whether to suspend Schuler without pay and beging termination procedures against her at the meeting.

(Update 2-9-11) Schuler was released on her own recognisance yesterday. Conditions of release include a 8PM to 6AM curfew, no contact with any minors or high school students over 18, and no drugs or alcohol. The now former teacher must also wear a GPS device.

During the Mason School Board meeting last night, the board unanimously accepted the resignation of Schuler, who has submitted a letter of resignation Monday. They also accepted the resignation of former assistant principal George Coates. Despite this, Dr. Kevin Bright, Mason School District superintendent, faced calls from parents to also resign. One said "All this stuff happened under his watch." and another said, "It's your policies that now have cost the children their innocence. You ought to get out of Mason. Just get out of Mason. Get out."

Bright said that he reported the allegations to the Ohio Department Of Education, and "While we had begun the process to terminate Ms. Schuler, we received her resignation today and believe that accepting it will save the district a lot of legal fees, which is in the best interest of our taxpayers and students."

(Update 10-28-11) After a three day bench trial, Stacy Schuler was convicted of 16 felony counts of sexual battery and three misdemeanor counts of giving alcohol to minors in a Warren County, OH courtroom yesterday. The presiding judge was Judge Robert Peeler. All five teenage boys were over Ohio's age of cpnsent, which is normally 16, but does not exist when there is a position of formal authority.

All five teens, who were about 17 years old at time, testified that Schuler was drinking alcohol at the time of the alleged incidents, was a willing participant in the acts and initiated much of the contact.

One of the teens testified they considered Schuler’s home a safe place to get high. Several said they were high on marijuana during sex with Schuler and that she made them vodka smoothies and served them beer and peach wine.

Originally, Schuler plead not guilty to all charges, but changed her plea to guilty by reason on insanity, a plea which according to a prosecution witness, was planned by Schuler before she was formally charged. During Thursday's closing arguments, Assistant Warren County Prosecutor Teresa Hiett said that "She got drunk and made some really poor choices. Does that mean she’s insane? No. She was the adult. She was the teacher. She had the trust. It’s the relationship between the defendant and the victims that makes this a crime.”

Defense attorney Charlie Rittgers said that her condition was caused by a mixture of bipolar disorder, Zoloft, an antidepressant drug, and alcohol."The underlying disease is the bipolar. The catalyst is the Zoloft magnified by the alcohol.”

Rittgers said it didn’t make sense that a person with Christian values would risk her livelihood and freedom, and said that the evidence supported an insanity defense.

“They want us to believe that all of a sudden after 10 years teaching, she wants to throw it away to have sex with five different guys,” he told the judge. “It’s far more reasonable to believe Stacy was suffering from an underlying psychological disorder.”

Judge Peeler said that while the defense argument about the adverse reaction of alcohol and drugs or an underlying condition may explain Schuler's behavior, it does not excuse it. Being voluntarily drunk was no excuse for taking advantage of students, and that it would be "a leap" to suggest that Schuler did not appreciate the wrongfulness of her conduct.

Before the verdict, the mother of one of the victims took the stand and said while crying, "These young men may appear as if they are tough guys, but in reality they are truly hurting. (Schuler) played on their emotions and she crossed the line.”

The four year prison sentence comes with an option for early release in six months. Besides the felony convictions of sexual battery, Schuler must register as a Tier 3 sex offender every 90 days for the rest of her life. Schuler resigned as a gym teacher from Mason High school back in February.

Missing Jersey City mom's body found in concrete drum - "husband" charged with 1st degree murder

A Jersey City man was charged with 1st degree murder in the death of his baby's mother, a Canadian who moved to Jersey City, NJ to become a waitress. 38 year old Steven Acuna was charged with strangling his wife and dumping her into a cement-filled barrel which he then folded his wife's body into. The mother's remains were discovered Friday, Septem,ber 23 and Acuna was formally charged with 1st degree murder.

[Randy "Amanda"]Lehrer, 32, was reported missing on Aug. 17. One of the last times she was seen publicly was leaving Tommy’s Family Restaurant on Central Avenue where she worked on Aug. 12 with Acuna, officials said.

Tommy Diakos, owner of Tommy’s Restaurant where Lehrer worked for nearly four years last saw her on Friday Aug. 12 when she finished her shift at 2 p.m.

“I never thought he (Acuna) would do something like that. He was very quiet when he came here,” Diakos said yesterday. “I hope she rests in peace. The baby is going to miss her more than anybody else.”

Acuna was always a suspect in his wife's disappearance. After Jersey City police used cadaverdogs to search their apartment and found nothing, Acuna was held of outstanding warrants, then released. Officials went back late last week after surmising that Amanda's body might have been dumped in the basement.

Hudson County, NJ Prosecutor Edward DeFazio stated, “Last week, based on further investigation, Jersey City police ascertained that tenants in the building had access to the basement. Based on that information they got permission from the owner of the property to inspect the basement...They discovered this barrel that was hidden by construction-type debrisAnd when they saw that barrel, based on good intuition, they said something didn’t look right about the barrel.”

The barrel was opened and Lehrer’s remains were found “encased” in concrete, according to DeFazio. There was no evidence that she was dismembered. “It is almost like she was bent, folded,” the prosecutor said. As investigators examined the remains, they realized they belonged to a woman, DeFazio said.

“Although there was decomposition, they were of a mind that it was Amanda. Then, further corroboration was obtained at the time of autopsy.”

DeFazio went on to say, "We believe this (murder) occurred during the course of a domestic violence situation and it could be that she was strangled.We believe it happened shortly after she was last seen alive.”

Acuna is being held on $1 million bail for 1st degree murder at the Hudson County Correctional Facility. After his wife's body was found, neighbors organized a vigil outside their apartment. A woman who was visiting her daughter said, "It's so sad, just painfully sad. I was visiting my daughter and wanted to know why everyone was standing around this house. Now, I wish it wasn't so."

Serial British philandering teacher sentenced to 22 to life for murdering "partner"

A JUDGE described music teacher Andrew Lindo as “cunning, cruel and calculating” as he sentenced him to 22 years in prison for the murder of Marie Stewart. Mr Justice Andrew Smith said it was “chilling” that Lindo had shown no remorse after brutally murdering his fiancee Miss Stewart, 30, at their Holmfirth home.

Throughout the sentencing at Bradford Crown Court, Lindo stared forwards blankly and expressionless, his hands clasped in front of him.The 29-year-old – in a grey suit and blue striped tie – did not flinch when the judge told him he would serve a minimum of 22 years.

Mr Justice Smith told Lindo: “When you have served it, it will be for others to consider whether it is safe to release you. Those faced with the decision will weigh it carefully.

“They will be wary of your extraordinary cunning and facility for deceit. They will also reflect upon how someone could be as calm and calculating as you were so soon after such a murder. They will consider all the texts that you sent that evening, and they will ask themselves whether your mental state can sufficiently be comprehended for it to be safe to release you.”

Lindo brutally murdered Marie – who was a special needs carer at Holmfirth High School – on December 18 last year, while their two children slept in their rooms at their rented house on Perseverance Place, Holmfirth.

Mr Justice Smith said: “The murder was not planned, but the attack on her was vicious and sustained.
You assaulted Marie in bed, and tried to throttle her. You used a suitcase to haul her to the living room.She was still alive. I am prepared to suppose – having considered the evidence – she was not conscious.You battered her face with a solid wood chair and you tried to strangle her with a belt.

You pulled her to the garage, covered her face in bubble wrap plastic and then inflicted fatal blows with a knife, stabbing her at least eight times.Your children were in the house at the time.”

Lindo then stuffed Marie’s body in a flight bag and hid it in the garage – her remains were not discovered by police for nearly two months. Mr Justice Smith said Marie had been devoted to Lindo and their children and said that she had recently found out that Lindo was cheating on her.

He told Lindo: “I cannot tell why you killed Marie Stewart, still less why you killed her so brutally – whether there was a motive and if so what it was. I do not accept that you were provoked or suffering prolonged stress. But that evening you faced a crisis in the double life that you were leading.”

The judge said that Lindo had become scared that his lover Angela Rylance would find out that he was living with Marie.

He said: “You had convinced Angela Rylance that you were a single father deserted by your partner, and you were committed to having her spend the night at your home. You might have been driven to do what you did because you could not face losing Angela Rylance. It was not the first time that you had seduced other woman with such deceit, cunningly trapping them and betraying Marie and your family.”

Mr Justice Smith said: I have seen no sign of remorse. Even when eventually you had no choice but to admit killing Marie, you again portrayed yourself as the victim. Your allegations against Marie reached new depths – accusing her of mistreating her own daughter. I am sure that those allegations were without truth – that they were a deliberate and despicable fiction.”

The judge said an aggravating feature was that the attack was “sustained and cruel” and culminated in a multiple stabbing. And that it had all been done while the children – a daughter, three , and a baby son – slept in their bedrooms in the three-storey house.

He said: “There is no evidence that they woke before or during the fatal attack – we can only hope that, mercifully, they did not. But the noise was enough to rouse the two-year-old boy next door.”

Mr Justice Smith said that it was “chilling” that Lindo had lacked any remorse following the murder and that he had been “cruel” and “calculating” when he concealed her remains in the garage and continued his lies about what had happened to her.

DETECTIVES who investigated the murder of Marie Stewart condemned the “selfishness” of her callous killer. They said Andrew Lindo had sought only to cause further suffering for her family.

Det Supt Dick Nuttall, of West Yorkshire Police’s Homicide and Major Enquiry Team, said Lindo had done nothing but “compound” the Stewart family’s suffering by trying to blacken Marie’s name.
He spoke out minutes after 29-year-old Lindo was jailed for at least 22 years for the brutal murder.

He said: “Andrew Lindo has now been convicted of the murder of Marie Stewart, a verdict which confirms that this was a cruel and deliberate act rather than the spontaneous and momentary loss of control that Lindo has claimed in his defence.

Lindo killed Marie in a series of brutal assaults that began in a bedroom a few feet from where their young children lay asleep and which continued through three floors of the family home before ending with Marie’s body being callously consigned to a flight bag in the garage.

“Within hours of Marie’s death – and by prior arrangement – Lindo brought his unsuspecting new girlfriend into his home before embarking on an elaborate charade that convinced everyone that Marie was still alive for several weeks. In his conduct since killing Marie, Lindo has continually sought to avoid or minimise his responsibility for his actions."

“Right from Lindo’s despicable behaviour and use of text and facebook messages prior to his arrest, his lies and crocodile tears in police interviews through to his descent to the ultimate low of blackening Marie Stewart’s character in the worst possible way he has shown himself to be calculating and manipulative.”

He said Lindo’s behaviour “inspired revulsion” among even the most experienced officers on the enquiry team who painstakingly exposed his lies and subterfuge to present a compelling case to the court.

“This killing had it roots in Andrew Lindo’s selfishness and whilst it is his behaviour that will make the news we shouldn’t forget that through his actions he has caused the needless death of Marie Stewart and has deprived her two young children of their loving and devoted mother.”

Match.com rapist sentenced to a year in jail

A Southern California man who raped a woman after his second date on Match.com was sentenced to a year in jail yesterday for his crime. Los Angeles Superior Court Judge Barbara R. Johnson sentenced 67 year old Alan Paul Wurtzel of Pacific Palisades, CA to 5 years probation, lifetime registration as a sex offender, and no use of computers or telephones for social networking unless approved by a probation officer.

Wurtzel pled no contest to sexual battery by restraint, and prosecutors dismissed a charge of forcible oral copulation. The victim learned abut his history of sexual assault after he followed her into her home and attacked her. She sued Match.com and settled the lawsuit last month, which would require the dating site to screen members against the state and federal sex offender registries.

Oregon man sentenced to 56 years for sexual attacks on wife

A man who raped his wife and terrorized their children was sentenced to 56 1/4 years in the Oregon prison system on August 10, 2011. 50 year old Diego Lara Andrade was convicted of numerous sex crimes at the conclusion of a two day trial which took place in a Umatilla County, Or courtroom on July 25 and July 26.

50 year old Diego Lara Andrade of Hermiston, OR was convicted of sexual attacks on his wife, the mother of his children, between March and October 2010. The jury convicted him of several counts of rape, sodomy, and physical abuse of his victimized wife.

Each of the sex crimes defendant was convicted of are listed under Oregon’s Ballot Measure 11, requiring minimum mandatory prison sentences. Convicts sentenced under Oregon’s Ballot Measure 11 are not eligible for parole or any other forms of early release.

Judge Daniel Hill presided over the trial and sentencing of Andrade. Judge Hill imposed five consecutive 100 month sentences in prison for each of the counts of rape in the first degree, one consecutive 100 month sentence for sodomy in the first degree, and one 75 month consecutive sentence for sexual abuse in the first degree for a total of 675 months (56 ¼ years) in prison, without any eligibility for early release.

Judge Hill said that it was his "own arrogance toward his wife and his family that put him in the position he is now in," and that he expected Andrade to die in prison.

Rapist sentenced to 50 more years for week-long assault on wife - appeal denied

A man who was convicted of raping his wife in a second trial was sentenced to 50 years in prison in addition to 22 years handed down in a previous aggravated rape conviction. The 50 years sentence stems from two consecutive 25 year sentences for aggravated rape and especially aggravated kidnapping. 6 year sentences for aggravated burglary and aggravated assault were imposed, but they'll run concurrently with the other charges.

Sullivan County Criminal Court Judge Robert Montgomery said that he “I shudder to think what might have happened” if Bristol TN resident Doug Young, 49, hadn't been apprehended in Georgia a week after he kidnapped and raped his wife, Heather Moore.

The rapes and kidnapping occurred over the week of January 4 to 11, 2008 after they ate breakfast at Moore's home. Young's presence was a violation of the protective order Moore filed against him on December 3, 2007, citing that “[Young] possesses many firearms and has threatened to shoot me and I am in fear for my life.” Moore's father, fred Moore began staying with his daughter, trying to protect her.

The two traveled in Moore’s vehicle to Asheville, N.C., where they spent the night at a rest stop; to Cades Cove in the Great Smoky Mountains National Park, where they circled the scenic loop over and over again; and to Cherokee, N.C., where they holed up at the Drama Inn for most of the next week, according to testimony presented Monday and Tuesday.

From Cherokee, Young and Moore took shopping and dining excursions to Spartanburg, S.C., and Clayton, Ga. From Jan. 4 to Jan. 11, Moore testified, Young kept a gun trained on her at almost all times, and forced her to have sex with him on at least seven separate occasions. Prosecutors are focusing only on the incidents that occurred in Sullivan County.

Everywhere they went, Moore testified, Young kept the pistol in his right-hand pants pocket. One day, while drinking vodka and driving, Young menaced her with the gun, running it up and down her head, saying, “I could kill you right now,” she recalled.

Friday’s sentencing concluded the most serious charges that Young racked up in just over a month between Dec. 1, 2007, and Jan. 10, 2008. Before then, he had been a superintendent at BurWil Construction, whose worst offense was an incident of joyriding as a juvenile.

But with his marriage to Moore unraveling, Young turned violent, sexually assaulting Moore in December 2007 at her home, after she refused to give him a hug, a jury concluded.

Then, on the eve of finalizing their divorce and days ahead of a hearing on Young’s aggravated rape charge, he violated the court’s no-contact order and stole in to Moore’s house to wait for her.

Prosecutors in Young’s second trial in August built their case by focusing on his offenses from the time he entered Moore’s residence, to when he left, abducting her at gunpoint, and commandeering her car.

According to Moore's previous victim impact statement, she fears coming home at dark, her rapist escaping and putting a gun to her head, and has to face the door when eating at restaurants. "All of this make it very difficult to report a crime like this and have the most horrible thing that has ever happened to you be exposed in the media for all to see.”

Moore's mother, Margaret Schaffer, said that “We’re going forward now. We’re not looking back.” Young's 2008 rape conviction is currently being appealed.

(Update 5-27-11) Doug Young's appeal of his 2009 rape conviction has been denied by the Tennessee Court Of Criminal Appeals in a unanimous decision dated Monday, May 23, 2011. The appeal is based on the introduction of Young's 1st rape conviction in the second trial as evidence. The court said that while testimony regarding the first rape conviction was a bit excessive, it allowed prosecutors to privide evidence of a criminal plan or motive. The appellate court also ruled that other evidence against Young outweightd the error of allowing the testimony relating to the first conviction. Teacher gets 60 days jail, lifetime SO registration for banging 18 year old student

A former high school French teacher and bowling coach was sentenced to 60 days in jail, a $500 fine, and lifetime sex offender registration for having sexual encounters with an 18 year old student on Monday, May 16, 2011.

44 year old Cheryl Clark’s sentencing was the culmination of a guilty plea entered Monday, April 11, 2011 in a Bellefontaine, OH courtroom. The guilty plea was for a single count of sexual battery. The presiding judge over was Logan County Common Pleas Judge Mark S. O'Connor. Clark, of Huntsville, OH, was a teacher for 15 years at Indian Lake High School before she was charged with sex with an 18 year old student.

Clark and the teenager had sex in her home at least twice, the first time on Feb.10 [2011], 16 days after the student turned 18, [Logan County Assistant Prosecutor Eric]Stewart said. Still, under Ohio law, it is a felony because Clark held a position of trust.

The boy’s mother became suspicious after she saw Clarke with her son at a school event. She went to local authorities, and the Washington Township Police Department went to Clarke’s home and found evidence, including text messages.

Clark told probation officers who were conducting a pre-sentence investigation that she thought the relationship was permissible because the student had turned 18, Stewart said. O'Connor could have sentenced Clark to as long as five years in prison, and the prosecutor wanted prison time.

Besides the jail sentence, lifetime registration, and the $500 fine, Clark's teaching certificate was permanently revoked. She must also undergo counseling and have no contact with her victim.

Snake rapist sentenced to 25 years prison and lifetime extended supervision

One of two men who were found guilty of raping a woman with a live snake last fall was sentenced to 25 years imprisonment by Eau Claire County Judge Paul Lenz on Tuesday, May 24, 2011. 24 year old John Bullock, of Altoona, earned the sentence after a jury convicted him and 25 year old Damonta Jones of Eau Claire, WI of two counts of 1st degree sexual assault last month.

According to the criminal complaint:

The woman told police she was at Jones' residence in the early morning hours of Nov. 11 with Jones, Bullock and two friends.The group was drinking alcohol and dancing. At one point, one of the friends left the residence while the second went to take a shower. Jones then invited the woman into a bedroom to see his children's pictures.

When she walked into the bedroom the woman said she was struck in the head with an unknown object and thrown on the floor before blacking out. The woman said she remembered Jones holding her while Bullock sexually assaulted her. She said she later was sexually assaulted with a live snake.
Bullock told police he had sexual contact with the woman but that it was consensual.

Besides 25 years imprisonment, Bullock will spend the rest of his life on extended supervision and the sex offender registry. He must stay away from the victim, Jones, minors, taverns, and alcohol. He also can't own pets.

The 25 year sentence falls in line with the pre-sentence investigation prepared by the Wisconsin Department Of Corrections, which recommended a 20-40 year sentence, but under Eau Claire County Assistant District Attorney Meri Larson's 30-40 year sentence suggestion. According to Larson, Bullock "attacked a defenseless woman in the most degrading way he and Mr. Jones could think of" and that Bullock "is a great threat to the community."

Before sentencing, Bullock said "I can't apologize about a crime I did not commit...My case is a case ... of media sensationalism and police misconduct. My case has been built on a foundation of lies. I am not a man that sexually assaults women."

Judge Lenz disagreed, saying "Just when you think you've seen every kind of depravity that comes into the mind of a man, there comes along another one."

Jones, still being held on $30,000 bail in the Eau Claire County Jail, will be sentenced August 3 after a pre-sentence investigation is run on him. Both Bullock and Jones have appealed their convictions.

15 year old boy handed 15 life sentences in rapes - sentence modified to 65 years

(Original Post 3-14-10) A 15 year old boy was sentenced to 15 life terms Wednesday, March 10 for raping and kidnapping two Apollo Beach restaraunt workers. Jose Walle, 13 when he attacked the woman, entered a blind plea to 19 felony counts last month.

The women were abducted from the Apollo Beach restaurant Aug. 15, 2008, held for several hours and repeatedly sexually assaulted before being dumped along Interstate 75. One said Walle got in the back seat of her truck, pointed a gun at her and raped her.

One of the victims said in her impact statement, "There was no doubt in my mind that he would kill us. He chose to rob us. He chose to abduct us. He was the one who raped me." The other victim said that "I think he should be shown the same mercy he showed us - none."

Walle's parents, friends, soccer coach and attorney, as well as a psychiatrist hired by the defense, portrayed him as a youth soccer star who got caught up in drugs and came under the sway of bad influences - co-defendants Rigoberto Martinez, 22, and Vincente Reyes-Carbajal, 21, who are awaiting trial.

Walle's explanation of his attack on the women was "I was angry. I was on drugs."

But Assistant State Attorney Rita Peters said Walle laughed and smiled his way through a presentence interview with a state corrections official. Walle told the official, "I'm a nice guy, but if you mess with me I have no problems killing you," Peters quoted from the report.

Hillsborough Circuit Judge Chet Tharpe used those statements to justify his 15 life sentences. This is one of the most disturbing cases I have ever come across...If he is not stopped, he is going to do it again. And, quite frankly, I'm not willing to take that chance. It is my intention that you never ever walk the streets of our community again as a free man. He's going to kill; it's just a matter of time."

Walle's life sentences will be served concurrently to one another and consexutively with a 27 year sentence handed down for the rape of a third woman. Two other Florida youths have been jailed for life without parole terms for non-murder crimes committed at 13.

(Update 5-21-11) After a 2010 US Supreme Court ruling stating that juveniles cannot be sentenced to life without parole for crimes other than murder, Judge Tharpe resentenced Walle to 65 years imprisonment on Wednesday, November 17, 2010. Judge Tharpe said at Walle's second sentencing, "Jose Walle knew the difference between right and wrong. He has forfeited his right to live in a free society."

After listening to both sides re-present arguments made during the first sentencing, Judge Tharpe said to the defense, "Let me start out by saying, what's wrong with this picture? Shouldn't our focus be first and foremost on the welfare of the victims? Is it not cruel and unusual punishment for the victims to have endured the rage, the brutality, the terror that your client exacted upon them? What about the fact that these ladies have to live the rest of their lives worrying about whether or not they will become a victim again of another person like Jose Walle …Isn't that cruel and unusual punishment?"

Tharpe also gave the opinon that the juvenile justice system does not give enough accountability to youths convicted of serious crimes and that "grave crimes bring grave sentences.""Why don't we focus our money and our resources and our time on fixing the problems as opposed to trying to coddle a Jose Walle?"

Man who threatened to kill "girlfriend" in front of child then does it gets 30 to life

A Bella Vista, CA man who threatened to kill his "girlfriend" in front of her 7 year old child, then proceeded to do just that was sentenced to a prison term of 30 years to life on April 22, 2011. 49 year old Ty Rone Pitts was sentenced in Shasta County Superior Court by Judge Bradley Boeckman on April 22 for the 1st degree murder of 24 year old Randal Leigh Wert. Wert was stabbed five times in front of her 7 year old daughter Kaylee, with three of those stabbings going through Wert's body. This was not the first felony conviction Pitts had for attacking Wert - a 2008 conviction was for choking and holding a knife to Wert's throat.

According to court documents, Pitts told a sheriff's detective that he and Wert, who worked as a shift manager at a fast-food restaurant in Redding, had been arguing the night of the stabbing and that "she continued to 'needle' and 'nag' " at him.

He then pulled an 18-inch "coconut knife" from the top of the refrigerator, and he nicked her arm with it, the court documents show. Wert then told Pitts she was "going to call the cops and he was going to prison."At that point, the report said, Pitts began to stab Wert in the upper torso.

Jankowitz said during the trial's closing arguments that Pitts inflicted the final stab wound after the bleeding and terrified Wert tried to run away from him but tripped and fell down in the driveway at their residence.

Pitts then rolled Wert onto her back and, holding the knife with both hands, raised it high over his head and plunged it into her heart, Jankowitz has said.

Karen Hallenbeck of Shasta Lake, CA said her daughter's murder has caused continuing nightmares."I miss her so much...I talk to her every night before bed...I will never forgive him." Hallenbeck read a letter from her granddaughter Kaylee who asked Pitts why he killed her mother. "I wish you were here so we could play," Kaylee said in her letter.

Hallenbeck also opined that Pitts should get life without parole since "he always said he was going to kill her in front of the children." Judge Boekman said "You predicted this and you made it happen."

Former Houston officer sentenced to 6 years jail for coercing prostitute into sex

A former Houston police officer was convicted, then sentenced to 6 years imprisonment for raping two prostitutes while on duty. 26 year old Demetrie Trevail Dixon, 26 was convicted by a Harris county jury on two counts of sex assault Tuesday, May 3, 2011. The conviction stems from charges that two prostitutes had been coerced into performing oral sex by Dixon while he was on duty.

Dixon was sworn in as an HPD officer in January 2009. He was arrested June 4 and terminated after an internal investigation Jan. 7 [2011].The north Houston division patrol officer was charged last year with four felony counts of sexual assault and two misdemeanor counts of official oppression.

Internal affairs investigators said Dixon stalked several women while on duty then took them to a secluded area to strip-search them. Prosecutors said he raped two of the women twice over a three-month period. After more than a week of trial and about two hours of deliberating, Dixon was sentenced for raping one of the women twice.

While Harris County Prosecutor Prosecutor Matthew Peneguy asked for the maximum of 20 years behind bars for "using the badge to coerce" sex, Dixon's defense attorney said "We don't need to warehouse this guy, he needs help," but the jury disagreed.

Dixon sill faces sexual assault charges for raping the other prostitute, and faces two misdemeanor allegations that he forced two other women, one of them an undercover police officer, to submit to strip searches under threat of jail.

Woman charged with biting boyfriend's lip off during fight

A 26 year old Las Cruces, NM woman is facing a third degree felony charge after biting her "boyfriend's" lip off during an argument on Sunday May 1, 2011. Aurelia Lorena Reyes, 26, is charged with one count of aggravated battery against a household member causing great bodily injury, a third-degree felony.

At around 11 p.m. Sunday, Las Cruces police were called to the Coachlight Inn at 301 S. Motel Blvd., where officers found the victim with a bloody face. The 35-year-old man was taken to a local hospital and then, because of the severity of his injuries, to University Medical Center of El Paso. His injuries are not life-threatening.

According to Las Cruces police, Reyes had an argument with her boyfriend, who told her to leave. Reyes became angry, so she grabbed the victim's head and bit off his upper lip, which was found about two feet from the entrance to their shared apartment. After hiding out in a neighboring school parking lot, Reyes turned herself it Monday, May 2 morning. Reyes is currently being held on $10,000 bond in the Dona Ana County Detention Center.

Home invader sentenced to 360 years for robbery, kidnapping, and rapes

In Virginia Beach, VA, a 22 year old man was sentenced to 360 years imprisonment on Wednesday, April 27 for multiple robberies, kidnappings, and sexual assault which took place during a 2008 home invasion.

Richard Richardson Jr. and two other gunmen intended to rob a drug dealer at Pembroke Lake Apartments the night of Sept. 10 but mistakenly went to the wrong address. They instead robbed 10 young friends who had gathered at a home to watch ultimate fighting on television, according to testimony during Richardson's four-day trial in December.

The gunmen ordered the eight men and two women to the floor and demanded cell phones, wallets and money. They struck the men, then marched the women to a back bedroom where they sexually assaulted them at gunpoint, according to court testimony. The night ended when another young man knocked on the door; he was shot in the head as he tried to flee. He continues to suffer from seizures.

According to prosecutors, Richardson was the triggerman in that particular shooting.

Richardson was convicted of all forty felony charges he faced on December 10. These felonies included 17 counts of the use of a firearm in a felony, 10 counts of robbery, two counts each of abduction, object sexual penetration, forcible sodomy, and single counts of aggravated malicious wounding and rape.

Circuit Court Judge Edward Hanson Jr. presided over the Richardson trial and conviction.

Tyvonte Lawton, then 17, pled guilty to 17 felonies and was sentenced by Circuit Court Judge Leslie L. Lilley to 45 years on January 18, 2011. Kevin Marshall Jr., 21, plead guilty to to robbery with a firearm, conspiracy, and two firearms charges related to those offenses for being a lookout. Antoine Linn Jackson was sentenced to life plus 241 years by Stephen C. Mahan on February 15, 2011. Jackson was convicted of 16 counts of the use of a firearm in a felony, 9 counts of robbery, 2 counts each of abduction, object sexual penetration, and sodomy, and single counts of rape, aggravated malicious wounding, and attempted robbery.

Teacher who faced 10 years behind bars for "relationship" with 19 year old student gets 10 months

A 28 year old Shelby, NC teacher is facing a decade behind bars for an "affair" with a 19 year old student at the school she worked at. Nichole Chapman, a married mother of three daughters was arraigned at the Cleveland County Law Enforcement Center Thursday morning. Chapman was charged with two counts each of indecent liberties with a student and sex offense with a student.

The judge set Chapman's bond at $75,000 and ordered her not to have any contact with the victim, 19 year old Vavaughia Snipes. This may be a problem since instead of listing her estranged husband, Chapman listed Snipes' mother, Chella Whisnant as her nearest relative during booking.

Chapman and Snipes began their "relationship" about a month ago at North Shelby School, a school for special needs students between 3 and 21. All encounters took place at his home, and he claimed to have started the relationship. Snipes said that "I ain't no victim...I love her and she loves me, so as far as that goes. They are not going to stop me from seeing her so it don't matter,” he said. He suffers from seizures and a learning disability.

Chapman said she believes she was arrested and charged “Probably because I'm white and he's black." Jeff Ledford, the Shelby police chief, disagrees. "That teacher-student relationship, that's where it's at. That's where your issue lies. The age goes out the window when you are talking about a teacher [and a] student,” because North Carolina law considers teachers to be guardians of students.

(Update 5-2-11) Chapman was sentenced to 10 to 12 months in jail for indecent liberties with a student and sex offense with a student. In December, Cleveland County (NC) Superior Court Judge Forrest D. Bridges accepted Chapman's pleas. On Monday, May 2, it wasn't Judge Bridges, but Judge James W. Morgan who formally sentenced Chapman. Bridges ordered psychatric evaulations for Chapman, conducted while at a psychiatric hospital in Butner, NC. The evaluations stated that she was competent to stand trial.

Chapman’s lawyer, Katherine Haen, said the former teacher was on medications to treat her various disorders at the time of the incident. Haen said this “cocktail” of medicine affected her behavior.

Chapman’s mother and father sat in the courtroom during the proceedings. Haen said Chapman’s parents drove to Raleigh on a regular basis to visit their daughter over the three months she was at the psychiatric hospital. Haen said it was over the course of her stay at the psychiatric hospital that Chapman changed.

"I think she’s gotten to know herself. She actually thanks Judge Bridges for putting her through that program...She has three daughters she hasn’t seen since December. I hope that the court will allow her to be released today to start a new life, a new direction. This experience has really transformed her.”

Chapman echoed her lawyer's statement. “I’m not the same Nicole. I can tell, and my family can tell, I’m a different person thanks to the help I’ve gotten.”

Missing mother abducted from parents' house by estranged husband - husband sentenced to life without parole

COLON TOWNSHIP — Police are searching for a missing St. Joseph County woman who is believed to have been abducted Monday morning by her estranged husband, authorities said.

Venus Rose Stewart, 32, was taken some time between 7:10 and 8:30 a.m. from her parents’ home in the 55000 block of Driftwood Drive in Colon Township, according to Michigan State Police. Police said Stewart, who was last seen wearing pajamas, may be with her estranged husband, Douglas Harrie Stewart, 29.

“We have information to believe she did not leave voluntarily,” said Lt. Mike Risko of the State Police Post in White Pigeon.

Police said the Stewarts may be traveling in a 1998 silver Mercury sedan with Virginia license plate XNP1453 or a silver full-size Dodge Ram with four doors and Virginia plate XNP1301. Douglas Stewart lives in Newport News, Va., and police believe the two may be headed there.

Risko said Venus Stewart formerly lived in Newport News but had moved back to Michigan where she was living with her parents and children. He said Venus Stewart’s father and children were asleep at the house in Colon Township at the time that she is believed to have been abducted. The lieutenant declined to say Monday what information police have that leads them to believe that Venus Stewart did not leave her parents’ home willingly.

Police described Venus Stewart as a white female, 5 feet 4 inches tall, weighing approximately 130 pounds with brown eyes and dark hair. Douglas Stewart is described as a white male, 5 feet 11 inches tall, weighing approximately 250 pounds with brown hair and brown eyes.

Police ask that anyone with information about the Stewarts’ whereabouts to call the White Pigeon post at 269-483-7611 or the State Police Regional Dispatch Center in Rockford.

Two weeks ago, Doug Stewart was sentenced to life without parole after being convicted of kidnapping and killing his wife. Stewart was sentenced to life without parole on counts of 1st degree intential murder, and conspiracy to commit first degree inentional murder. A St. Joseph jury convicted Douglas of these charges on March 11 after a three week trial.

During the sentencing, which took place on April 18, Venus' brother Dustin Jasper read a statement by their mother, Therese McComb. Jasper was angry at his former brother-in-law for not telling his family where Venus' McComb's body was.

“Don’t you miss her? Don’t you realize how much Brook and Rachel need their mother? This just shows how much you didn’t love them and saw them as pawns to hunt Venus. You’re hurting Mom by not telling where she is at to have a proper burial.”

Jasper then called his sister's murder a sociopath who lied and seduced his sister into the marriage. "He never served in Afghanistan or was a sniper...A pathological liar lies to get sympathy, to look better, to save his butt...A sociopath will quickly proclaim that you are their true love and soulmate,” Jasper said. “They want to move in together or get married quickly.”

St. Joseph County Circuit Judge Paul Stutesman presided over the trial and sentencing.

A week ago, on April 26, 2011, a vigil was held for Venus McComb in Centreville, MI. It was led by Pastor Don Smith of Firm Foundation Ministries and attended by about 100 people. Pastor Smith said “It was a special day for me. My mother had also dedicated her life to the Lord and was going to be baptized that day...You could see the joy in her face in the midst of the struggles she was going through. Today, the biggest question is, ‘what are we supposed to do without Venus?’ How can something good come out of something so tragic?...We see the life in her legacy just by looking at her daughters. There’s nothing wrong with crying over Venus tonight. We need to mourn.”

Theresa McComb, the victim's mother said, “She made my life complete...She was a free spirit. She loved her little girls more than anything in the world.”

Burglar who beat, raped victim sentenced to 165 years to life

A home invasion which turned into a beating and rape has netten a Kansas City, MO man 165 years to life in the Missouri correctional system. Taurian J. Burton, 24, was convicted by a Clay County jury in January of single counts of forcible rape and 1st degree robbery, 2 counts of 1st degree assault, and 3 counts of armed criminal action for the incident at a Northland, MO residence on July 24, 2009.

According to court records, two gunmen wearing masks forced their way through a door just after midnight. They demanded cash and drugs before binding and beating the two victims. The intruders raped the woman. The man suffered a skull fracture, a broken finger and other injuries.
The gunmen stole a television, two laptop computers, jewelry and other items.
Burton was convicted in 2005 for burglary in Jackson County. He served several years but was released in 2008, said Corey Carter, an assistant Clay County prosecutor.

Burton is one of two men charged in the attack. A second man, Anthony L. Taborn, also of kansas City, is scheduled to go on trial in July as well. The presiding judge in Burton's trial was Circuit Judge Shane T. Alexander

27 to life for rape of coed by fellow college student

Former Cuesta College student David Andrew Shenosky was sentenced to 27 to life on Friday, April 22, 2011 for the rape and kidnapping of a fellow student on March 27, 2010. The 23 year old plead no contest under San Luis Obispo Superior Court Judge John Trice

After the incident, her eyes had broken blood vessels, consistent with the choking she described, and an examination found that she had been raped, police said. Police found a note on Shenosky’s computer expressing his regret for hurting her. The note said he loved her and wished the incident had never happened. According to the woman’s statements to police, Shenosky drove her home to San Luis Obispo after the rape and then she told her roommates, later describing the events to police.

Shenosky's sentence is as follows : 15 years to life on a single count of forcible rape, and 12 years for 2 counts of felony sexual penetration by a foreign object and a count of kidnapping, all to be served consecutively.

Man gets 12-25 years, woman gets 5 2/3 to 15 years for three way with developmentally disabled daughter

A Fruitland Township, MI man was sentenced to 12-25 years in prison Tuesday, April 12, 2011 after pleading to three counts of 1st degree criminal sexual conduct. He and a Manistee, MI woman were originally charged with three counts of 1st degree and 3rd degree criminal sexual conduct, respectively by Muskegon County officials.

The sexual assault charge stem from both perpetrators having sex with the woman's 21 year old developmentally disabled daughter, described as needing 9 to 16 hours of supervision a day by her case manager and as a girl with the mental capacity of a 10 to 13 year old. Both perpetrators were sentenced by Muskegon County 14th Circuit Judge William C. Marietti.

The victimization of the daughter by then 51 year old Mark Wayne Barnhard and her then 46 year old mother took place over several months in 2008, with the victim undergoing a sexual assault examination April 23, 2009. Both offenders were originally arraigned in May 2009.

According to a Muskegon County Sheriff's report, Barnhard -- using the alias "Mike Bradford" -- met the woman in an online chatroom more than a year and a half ago. He told police that the two later met in person and began having sex on numerous occasions at his Fruitland Township home.

At some point, Barnhard and the woman -- both married to other people -- decided they wanted to have a "three way" and the woman brought her 21-year-old mentally impaired daughter to Barnhard's house to participate, the report said.

Authorities were alerted to the alleged sexual abuse after the 21-year-old victim told her aunt that she might be pregnant by Barnhard. It turns out she was not, according to the report. Barnhard told investigators that both he and the victim's mother performed sex acts on the daughter.
"It was a secret life I had," he told investigators.

The mother was sentenced to 5 2/3 to 15 years imprisonment by Judge Marietti on September 15, 2009. The victim's aunt, now her guardian, said "when she gets dressed, there's not enough layers of shirts and sweaters."

When the young woman first arrived in her aunt and uncle's home, she barely spoke, and her family could see "fear in this young girl's eyes."

The victim's impact statement, read during the first sentencing by a family friend, said, "You did a very bad thing to me and let bad things happen to me...Why did you do this?" When the victim wanted the abuse to stop, instead of stopping,"you yelled at me and told me not to be a baby...You made me feel dirty and told many lies. I never want to be anything like you, Mom...I will never forgive or forget you, Mom... I hope you'll be gone for a long time."

Judge Marietti said that "this is probably the most outrageous and disgusting scenario that I have ever come across. It actually is beyond belief." Robert Hedges, a 22 year prosecutor in the Muskegon County court system, said "It's just awful. Even in the animal world, mothers care for their children."

Barnhard plead guilty to his three counts of 1st degree CSC on March 2, 2011, and was able to stay out on bond until his sentencing. At the sentencing, the family friend read another letter from the victim, this time directed at Barnhard. “Auntie wakes me up and I'm afraid to open my eyes, because I'm afraid it will be you. I scrub my skin until it's red and I can't feel clean. … Auntie and I moved far away and I still can't feel safe.” The aunt asked Barnhard, "Does it make you feel like a big man that this little girl's afraid of you? Calling you a monster is too good for you.”

Nurse guilty of sexually assaulting women and girls at medical offices in suburban Atlanta

A nurse who sexually assaulted women and girls under anesthesia was found guilty as charged in a Cobb County, GA courtroom on Monday April 11 and is expected to be sentenced to a lengthy prison term by Superior Court Judge Reuben Green during sentencing which is scheduled to take place within the next month or so.

48 year old Paul Serdula, a nurse anesthesiologist who practiced in metro Atlanta, was found guilty by Judge Green in a "stipulated facts" bench trial in which 20 pages of still sealed facts were agreed to and entered into evidence. Judge Green reviewed multiple images, presumably of women and girls being victimized. According to Cobb County investigators, this evidence shows victims from around the county and not just the victim Serdula was convicted of videotaping.

Serdula's defense attorney Jimmy Berry said that the images were the reason his client did not plead guilty, citing police misconduct in obtaining the evidence. "The pictures are what they are, they show what they show...We didn’t have a lot to fight about. Just the procedure of how they got them, and whether they got a valid search warrant.”

Serdula, who appeared in court Monday shackled at the waist, was charged in two separate indictments of assaulting 19 victims, including two girls under the age of 16, at a local hospital, surgery center, and a dentist’s office.

He was first arrested in November 2009, after a woman found the camera hidden beneath a bathroom sink at the Goldstein Garber & Salama dental office at 600 Galleria Parkway and called 911. He was later released on $50,000 bond, but was re-arrested about a week later on child molestation charges, after one victim was identified as a child [The 15 year old victim was victimized at the same dental office Serdula was arrested before].

In July 2010, he was again released, this time on $250,000 bond, before being arrested a third time, in December 2010 on additional charges of unlawful surveillance, aggravated sodomy and sexual assault. He has been held without bond at Cobb County Jail since that time.

A lawsuit filed by five female patients against WellStar Cobb Hospital was setteld out of court for an undisclosed amount.

According to the original lawsuit, four of the women were at the hospital to deliver babies via cesarean section, and a minor was undergoing an emergency appendectomy. The suit claimed that Serdula administered some drugs without medical need, and gave excessive doses, leaving the new mothers unable to recall their babies’ births. Other operating room staff were in the room at the time of the assaults but unaware of what was happening.

Serdula faces a mandatory minimum of 25 years in prison when he is sentenced.

Minnesota serial predator sentenced to 10 years for raping woman, groping three others

A Shoreview, MN developer was sentenced to 10 years in prison Wednesday, April 20 and will be deported back to his native Bangladesh after being convicted of raping a woman and groping three other women. The sex assaults took place between January 2008 and September 2009. According to prosecutors at his trial, now 36 year old Maksud Mahbub would target women who were drunk at downtown Minneapolis bars during closing time and offer them "help" or rides, when they would be assaulted in his car or home.

The women testified that they passed out and woke up in Mahbub's home or car, unable to remember how they got there. The evidence against Mahbub included a shopping bag found in his closet with four pairs of women's underwear, including one belonging to a victim; a bra; and some women's jewelry. The victims also testified that Mahbub took or disabled their cellphones, in some cases by removing the batteries, so they could not call for help.

In one of the assaults, the victim testified that she had gone to a Minneapolis bar with a friend in September 2009 and had about five beers and six shots of liquor before ending up alone. She testified that the next thing she remembered was being in Mahbub's car. At his townhouse, she said, she fell asleep with her clothes on in his bedroom, but was nude when she woke up and he was on top of her. She said he raped her, even though she pushed him off twice.

Mahbub testified that he had never touched the woman. He also said that he had consensual sex with one of the women and kissed another, but denied touching the others. Mahbub testified at trial that he had only good intentions when he offered the inebriated women rides or took them to his townhome. He admitted only after aggressive questioning that he would have liked to have sex with the ones he groped "if they wanted to."

Investigators found three victims through taxi records after the first reported she was raped in September 2009. Another reported her assault after officials put out a public call for victims to come forward.

The charges that Mahbub was found guilty of and sentenced by Ramsey County District Judge Judith Tilsen were a single count of 3rd degree CSC and 3 counts of 4th degree CSC. A charge of 3rd degree sexual misconduct was dropped, and cases against six other women were not pursued or dropped due to lack of evidence. One of his victim wrote a letter to Judge Tilsen regarding her assault.

"I wanted to write this letter not only for myself but for the other women in this trial, and the countless others that may have been afraid to come forward. I thought, how could this happen to me? I am so much ... stronger than to let this happen." she said, before realizing that regardless of background, there is a difference between sex and rape. As for Mahbub's actions, the victim said, "that's what predators do."

Mahbub through his attorney Earl Gray, argued for a year in jail and SO treatment, stating that the immigration hold Mahbub has meant that he will be seperated from his brother, young daughter, and mother, who cried throught the proceedings. "I have been blessed with a loving family. I'm sorry to everyone because they had to endure such a hard time ... because of my conduct. I'll never be able to see my daughter, brother and mom ever again." said Mahbub.

Judge Tilsen said in response, "I'm not going to depart from (state sentencing) guidelines because it's going to be hard on your family," and Ella Friendt, a juror on the case, said "To me, it was a gut-wrenching case. It was very hard being a mother, to see what his mother was going through. But I also have a daughter ... and he was a predator."

Sterling Heights man who kidnapped, raped mother of his children gets 26 3/4 to 75 years

A Sterling Heights, MI man was sentenced to 26 3/4 to 75 years in prison in a suburban Detroit courtroom Friday, April 15, 2011 for raping and kidnapping his "girlfriend," the mother of his two children, on New Years Day 2010. Brandon Jay Smith kidnapped the woman be forcing her into his grandmother's car when she arrived to work at a Green Oak Township restaurant.

The woman testified at a June preliminary examination that Smith was waiting for her when she arrived to work. She said he told her not to resist and not to scream for help. She resisted and she screamed, and Smith grew angrier, the woman said. The woman sat on the ground in an effort to be dead weight, but her 5-foot, 96-pound frame was no match for Smith, at 6-foot-3 and 180 pounds.

She said Smith fled on U.S. 23, where he cut off his electronic tether, he had to wear one as a condition of his sentencing less than a month earlier on charges of aggravated domestic violence against the same woman, and threw it out the window. He put zip ties on her wrists and took the batteries out of both of their cell phones.

Smith told the woman that he was taking her somewhere no one would find her and during that trip north, he told her that he was going to asphyxiate himself and she was going to watch. He also told her that he was going to kill her and if police stopped them, he threatened to kill her in front of them.

The woman said Smith raped her while en route to his family’s camper trailer in Antrim County and again once they reached the site. She was rescued by Antrim County sheriff’s deputies in the early morning hours of Jan. 2, 2010.

Defense attorney Mark Gatesman said that he was proud of his client's taking responsibility. He also said that a factor in his client's favor was that instead of killing his victim should police raid the trailer, he simply surrendered to police.

This view contrasts with some of the statements Smith made to the Center for Forensic Psychiatry. "My intent was never to hurt her, but she got hurt. We were supposed to go up to the camper, up north. She kept asking why we were going there. I told her that's where I'm going to commit suicide. ... The reason she was with me was she could watch. Never got around to doing it, though. The cops came before I had a chance to."

However, according to presiding Judge Livingston County Circuit Judge Michael P. Hatty, it was Smith's mother who took on her reasonably to the mother of her grandkids to lead them to the camper. Judge Hatty, citing the "horrendous" nature of the case, said "This case came up very short of being a murder case, if the police didn't get there quick enough." According to Prosecutor David Moses, the victim was 45 minutes from death. "She thought she was going to die. She thought she would not see her family again, would not see her children," Moses said about the victim.

Beside the kidnapping and 1st degree criminal sexual conduct counts, Smith was also sentenced for assault with intent to commit great bodily harm, aggravated domestic violence and assault with a dangerous weapon for threatening and cutting the woman with a knife as well as interfering with electronic communications.

The victim's father, who attended the sentencing, said that he thanked the officials who helped find his daughter. "We owe a lot to the police agencies that were involved in this. Those guys did a great job."

Man who shot father-in-law to death while stalking estranged wife sentenced to 50 years

A man who shot his father-in-law to death at a mall while gunning for his estranged wife was sentenced to 50 years without parole. Michael James Young Jr, 25, was sentenced in a Lexington County, SC courtroom Monday, April 11 after pleading guilty to murder and assault with intent to kill for the shooting of his estranged wife, then 21 year old Shaunna Bell, and her father, a retired US Air Force officer, 49 year old Robert Lynn Bell, on June 13, 2007 in the Columbiana Center mall parking lot.

Before the deadly shooting four days shy of Father’s Day that year, Bell had called police to report that Young threatened to destroy the kiosk at the mall where she sold computers and told her he didn’t care if she lost her job. He also damaged her parents’ vehicle. She told police at the time that Young was known to carry a snub-nosed .38-caliber revolver.

Her father had been driving Bell to and from work for several weeks in an attempt to keep Young away from his daughter, said Robert Rikard, a Columbia lawyer hired by the family.

The Bells are suing the security company, saying that they did not do enough to protect Shaunna from her husband's stalking. While Young was banned from the mall, the supervisor on duty was not informed of this fact.

Shaunna said in her victim impact statement, "I think about getting married and not having anyone to walk me down the aisle. My father/daughter dance was taken from me. When my mom’s birthday or Mother’s Day comes around, I do not have anyone to secretly call for details of what she has been wanting.”

Young has accepted his responsibility for the mall shooting and has expressed his remorse “innumerable” times, his lawyer, John Delgado, said. “He considers it a life sentence, but he considers it a just sentence for what he did.” Despite Young’s imposing size, his aggression toward women “was his way of being able to assert himself in the world,” Delgado said, saying Young had no self esteem.
“He’s a completely different person now,” the lawyer said.

The 50 year sentence for murder will be served concurrently with the assault with intent to kill. In exchange for the guilty plea, Young saw four stalking charges, and single charges of forgery, telephone harassment, and assault with intent to kill. Judge Thomas Russo was the presiding judge over this case.

"Boyfriend" sentenced to life without parole for running over woman on Jacksonville, FL street

A man who deliberately ran over his "girlfriend", crushing her bones so badly that they "resembled sand" was sentenced to life without parole in a Jacksonville, FL courtroom a week ago today. Circuit Judge Mark Hulsey sentenced Giacinto Martin, now 34, for a count of attempted murder for pushing mother of two Mary Wilkie out of a car she was driving and running her over last July in Jacksonville.

Martin pushed Wilkie out of the car, ran over her, backed over her and then ran her over again. He maintained it was an accident. The two had left a bar that night and Wilkie drove because Martin was drunk.

Police said Martin left Wilkie on Anniston Road just off Beach Boulevard to die in the middle of the night. During a break in his interview with detectives, he was caught on video saying to himself, “If I was going to run her over, I’d make sure she was dead but I’d never do that.”

According to the victim's mother Judith Wilkie, her daughter is still in a wheelchair relrning how to walk, and medicial bills from her recovery have topped $1.4 million. Assistant State Attorney Bernie de la Rionda said that the $1.4 million was the highest amount he has seen for medical costs resulting from crimes he has prosecuted.

Before Judge Hulsey sentenced Martin, Martin asked for a term which would allow him to attempt to pay off the victim's bills. “I have nightmares every single night about this. I swear to you. I swear to God. I swear to everybody in my life I’d never hurt her.”

However, Hulsey said, “There are cases where lenience is called for. This isn’t one of them. I hope that God has mercy on your soul, to be honest with you.”

Rapist, murderer of coed sentenced to life plus 42 years in Nashville

A man who raped, robbed, then killed a Tennessee State University student was sentenced to life without parole plus 42 years yesterday in a Nashville, TN courtroom. Deshaun Lewis was convicted of 1st degree felony murder, especially aggravated robbery, and aggravated rape. 18-year-old Raquel Johnson was killed after Lewis robbed her car, with her body found not far away from the school that she was attending. Judge Steve Dozier sentenced Lewis to 20 years for robbery, 22 years for rape, and 51 to life for murder, ordering the sentences to be served consecutively and in full.

Prosecutors contended that Lewis took the girl to the home for a planned robbery. Prosecutors said Johnson was beaten, robbed and raped. Her car was stolen as well.

A key piece of evidence in the trial was testimony from Lewis' former girlfriend who told police that he had forced her at gunpoint to tell police that she had seen someone else driving the victim's stolen car a few days after the murder. Prosecutors also had relied on physical evidence, including Lewis' bloody hand prints, left at the crime scene. Attorneys for the defendant had claimed the evidence simply didn't add up.

The victim's mother, Maria Johnson said that while she has forgiven Lewis, that he needed to be punished to the fullest extent of the law so that others would not be hurt by him.

In international law, hosti humani generis, enemies of mankind, is the term given to those that torture, commit war crimes, genocide, piracy, and a host of other actions which violate jus cogens, or peremptory norms.

What happened to this 29 year old woman is nothing short of horrendous. It rivals the worst cases of child abuse and torture, including a case where the stepfather of a 7 year old girl was convicted of her murder. I'm reprinting this AP story in its entirety.

ALTON, Ill. - Banished to the basement, the 29-year-old mother with a childlike mind and another baby on the way had little more than a thin rug and a mattress to call her own on the chilly concrete floor.

Dorothy Dixon ate what she could forage from the refrigerator upstairs, where prosecutors say housemates used her for target practice with BBs, burned her with a glue gun and doused her with scalding liquid that peeled away her skin.

They torched what few clothes she had, authorities say, so she walked around naked. They often pummeled her with an aluminum bat or metal handle.

Dixon — six months pregnant — died after weeks of abuse. Police have charged two adults, three teenagers and a 12-year-old boy with murder in the case that has repulsed many in this Mississippi River town.

"This is heartbreaking," police Lt. David Hayes said. "It was almost as though they were making fun of the abuse they were administering. This woman was almost like living in a prison."

Investigators put much of the blame on Michelle Riley, 35, who they said befriended Dixon but pocketed monthly Social Security checks she got because of her developmental delays.
Dixon saw little, if any, of the money, Hayes said. For months she weathered the torment to keep a roof over her head and that of her year-old son, who weighed just 15 pounds when taken into state custody after his mom's death.

"I've never seen an almost conspiratorial effort by a group of people to continuously torture someone until she finally died, then not really show any remorse," Hayes said. "It was just a slow, torturous, tragic way to die. I highly doubt Dorothy Dixon even knew she was dying."

Riley, 43-year-old Judy Woods and three teenagers, including Riley's 15-year-old daughter, LeShelle McBride, are charged with first-degree murder, aggravated and heinous battery, intentional homicide of an unborn child, and unlawful restraint. Riley's 12-year-old son is charged as a juvenile.

Riley, her daughter, Woods and 16-year-old Benny Wilson have public defenders who did not immediately return messages for comment. An 18-year-old defendant, Michael Elliott, planned to get his own attorney, court records show. All remain in jail on $1 million bond.

Messages left with a Chicago-area sister of Dixon went unreturned, but neighbors, Hayes and newspaper accounts offer a mosaic of the months leading to Dixon's demise inside the small, white, blue-shuttered house.

Riley and Dixon, police said, had lived in Quincy, a Mississippi River town about 100 miles north of St. Louis, Mo. Quincy is where Riley worked as a coordinator for a regional center that helps the developmentally disabled with housing and other services. Dixon was a client.

For years, an impoverished Riley struggled raising her children. Her use of methamphetamine and cocaine brought drug convictions in 2002 and 2004. But with treatment and housing help from the Quincy YWCA, Riley put her life in order — so much that in February of last year, the Quincy Herald-Whig did a story on her comeback.

Last summer, Dixon and Riley moved into the $800-a-month, three-bedroom rental in Alton about 15 miles north of St. Louis. From the start, neighbors Chad Hudson and Terri Brandt considered Riley trouble.

"Michelle was evil, vindictive. Manipulative," said Hudson, convinced the teenagers were Riley's powerless minions. "She was angry, vicious," added Brandt.

Riley considered Dixon her slave, making her rub Riley's feet until Riley fell asleep and forcing her to run naked around the house when she got in trouble, the neighbors said. "Being in their house was like being in a prison day room," Hudson said. "They just sat around the kitchen table and fought." There was little question that Riley ruled the roost.

While doing fix-ups on the home last fall, landlord Steve Atkins saw Riley "barking orders" at the children and everyone else. Atkins joked to her whether he needed to call the Army and see if they wanted their drill sergeant back.
"She didn't laugh about it at all," Atkins said. "Obviously, I hit a nerve."
Atkins said Dixon generally kept to herself "but was always nice when she spoke to you." He saw no hints she'd been suffering or tortured. "I would have never, ever suspected something like this," he said. "It's definitely shocking."

Police said Dixon was allowed out of the house but didn't say under what conditions. Hayes didn't know who the father of Dixon's fetus is.

Hayes said things apparently came to a head Jan. 30, when investigators believe that Woods, during a dispute, beat Dixon on the head with an object Hayes wouldn't identify. The next day Woods found her dead.

Hayes watched the autopsy and found her injuries disturbing. X-rays revealed roughly 30 BBs lodged in her. Deep-tissue burns covered about one-third of her body — her face, her chest, her arms and feet — and left her severely dehydrated. Her face and body showed signs of prolonged abuse. Many of her wounds were infected.

None of the injuries, Hayes said, proved singly fatal to Dixon. Her system already was taxed by her unborn baby. "The autopsy sort of indicates her immune system just shut down," he said. "It was not capable of fending off any more."

In the rental home's basement, Atkins said, he found spots of blood in a shower and tiny smears on the concrete floor, washer and dryer. "It's disgraceful the way this girl died, as kind and as sweet as this girl was," he said. "She didn't deserve to die the way she did. It's just terrible, senseless. It's just a total shame."

(Update 2-7-10) The ringleader of the torture, Michelle Riley, was sentenced to 45 years in prison for 1st degree murder Friday, February 5. This was the maximum sentence possible in a plea agreement made by Michelle Riley, 37 and Assistant State's Attorney Mike Stewart. Stewart believed that "I don't think 45 years is enough, but that's what we agreed to."

Riley, said in front of presiding Madison County Circuit Judge Charles Romani Jr, "I'm sorry that I can't take it back," but Romain said that that statement, along with Riley's history of substance abuse, was no excuse. "There were things done to this woman that you don't see done to animals, let alone human beings. This lady was tortured."

Riley will serve her sentence without parole, as she pled guilty to 1st degree murder. Her lawyer, Jon Delaney, said she took the plea deal to spare her daughter, 17 year old LeShelle, 1st degree murder charges in exchange for 2nd degree murder. The daughter and three others are scheduled to go on trial for 1st degree murder.

(Update 7-13-10) LeShelle McBride was spared a trial and 1st degree murder charges by pleading guilty to 2nd degree murder. WIth credit for time served, she could be out in 2 to 8 months. A 12 year old boy was found deliquent for 2nd degree murder and sentenced to juvenile detention. Others are either awaiting trial for or sentencing on 1st degree murder charges.

(Update 4-19-11) Benny Wilson, the last defendant in this case, was sentenced to 30 years imprisonment for 1st degree murder. According to authorities, it was Wilson who repeatedly shot Dixon in the head with a BB gun. Assistant State's Attorney Jennifer Vucich asked for 45 years while defense attorney Rand Hale asked for 20 years. Vucich said that "Clearly what he did to Dorothy Dixon was despicable. I don't think anyone in the room can imagine the suffering she endured." Madison County Associate Judge James Hackett imposed sentence and presided over the guilty plea Friday, April 15.

Prosecutors have said that some of the other defendants received better deals because they were less culpable. Michelle Riley got a sentence of 45 years because she was believed to be the ringleader in the murder.

Michael Elliot and LeShelle McBride both pled to second degree murder and received sentences of eight years and six years respective; Judy Woods pled to aggravated battery and was sentenced to 18 months' periodic imprisonment.

Judge Hackett said that testimony was"some of the most horrific that could come before this court."
"It is stunning. It is at least remarkable, at most, overwhelming." However, Judge Hackett took into account the lack of previous criminal history, young age, and multiple perpetrators when sentencing WIlson.

Stripper sentenced to decade of imprisonment for running over customer

HAMILTON — An exotic dancer who pleaded guilty to striking a customer with her vehicle and dragging him to death was sentenced to 10 years in prison this afternoon [Thursday, April 7, 2011]in Butler County Common Pleas Court.

Kristina Hensley, 35, of Higginsport, was given the maximum sentence by Judge Keith Spaeth at a 1:30 p.m. hearing. Supporters of Jae Cho, the 31-year-old Monroe man killed by Hensley, applauded the judge’s ruling. Pam Birch, Hensley’s mother, began wailing as her daughter broke out in tears and doubled over.

Spaeth called the autopsy photos and the autophy report detailing how Cho died, “ghastly.” The judge said he had seen a lot of autopsy photos over the years, but Cho’s were “very hard to look at.”

“Given the circumstances of this case, Ms. Hensley, the court has not choice,” Spaeth said before handing down her sentence. “You didn’t just hit Mr. Cho, he was (dragged) to a horrible death.”

Hensley took a deal in February, pleading guilty to involuntary manslaughter and failure to stop after an accident. Her plea came days before she was scheduled to go to trial on charges of murder, aggravated robbery, theft and failure to stop after an accident.

She was accused of robbing and killing Cho on Aug. 7, and stealing from another customer a few hours earlier in Blue Ash. In the statement of facts read at her plea hearing, Hensley admitted to causing Cho’s death after attempting to steal from him.

Hensley originally told police that after the incident she received a call from her employer, Naughty Bodies, to go to 367 Timrick Place in Monroe for a private show. She said she arrived about 4:20 a.m., and that once inside, Cho touched her inappropriately. She told police she left immediately, and Cho followed her out of the house. She struck him with her vehicle as she fled, but told authorities she didn’t know Cho was lodged underneath her sport-utility vehicle.

In a sentencing memorandum filed this week, defense attorneys Jeremy Evans and Timothy Upton urged the judge to give Hensley community control or sentence her to the minimum of three years in prison with credit for the 334 days she has served since her arrest. Hensley has three sons, ages 13, 8, and 7, and is engaged to their father, who has been unemployed for some time, according to defense attorneys.

“As a result, Kristina has been the sole income provider for their family, opting to work as a dancer due to economic hardship in an economy that had nothing else to offer her,” Evans wrote in the motion. “She would sit in a parking lot waiting for a call to do a show, travel alone to a show, go alone to a stranger’s home to perform and was expected to collect the money, perform a show and leave without incident.”

The defense also said Hensley has no prior violent history and her only exposure to the criminal system was in 2002 in Florida for petty larceny and resisting an officer in the recovery of a stolen vehicle. “The facts surrounding this event show that this was not a vindictive, malicious or retaliatory act toward Mr. Cho nor that Kristina Hensley intended to cause his death,” Evans wrote.

The defense said GPS evidence shows Hensley pulled out of Cho’s driveway and sat in the street before driving off. “There is some evidence that she did not just heartlessly plow over Mr. Cho, but sat in the street for more than 9 minutes before leaving his home.”

Evans and Upton said Hensley then drove 1.3 miles to the nearest open and lit establishment — a Shell gas station — and stopped. Hensley has shown emotional trauma and remorse for her actions, according to her attorneys.

Letters asking the judge to show leniency for Hensley have been sent by family members, including her oldest son, her mother, Pam Birch; and stepfather, Douglas, who live in Middletown.

According to the prosecutor’s office, numerous letters from Cho’s friends and loved ones also have been sent to Spaeth. Cho, a University of Cincinnati graduate, worked as a server at Sammy’s Gourmet Burgers and Beer in Blue Ash.

Last month, a wrongful death lawsuit asking for $3 million in damages was filed by Cho’s father, In Chae Cho, against Hensley, State Auto Insurance Companies and Allied Communications Network (doing business as Naughty Bodies).

The suit filed by attorney Gary Franke of Cincinnati seeks damages for reasonable and necessary funeral expenses, mental anguish and a loss of Cho’s support and services, according to Butler County court documents.

Hamersville, OH man sentenced to 2 years imprisonment, lifetime Tier 3 SO registration for sex with drunk woman

A Hamersville, OH man who sexually battered a woman during a party on Halloween 2010 was sentenced to a mandatory 2 years imprisonment and Tier III sex offender registration in the Brown County Court of Common Pleas on April 7, 2011.

38 year old Marlon Scott Schauer plead guilty to a single count of sexual battery, down from two charges of rape for the incident, which took place last fall. Assistant Prosecutor Steve Purtell said that the charges involved a woman who wastoo drunk to give meaningful consent to sex, and who may have also been asleep.

Court of Common Pleas Judge Scott Gusweiler accepted the plea and sentencing recommendation, and noted during the hearing that the case files do not reflect any prior criminal charges in Schauer's history.

The two year sentence is mandatory and cannot be shortened by early or judicial release, Gusweiler told Schauer Thursday. As part of the plea, Schauer also relinquished his right to appeal to the 12th District court of Appeals, the judge said.

Five years of mandatory post-release control are also included in the sentence, and Schauer will be permanently considered a Tier III sex offender for the remainder of his life. Tier III is the most serious of Ohio's sexual offender designations, and after his release from prison Schauer will be required to register, in person with the sheriff of the county in which he lives, works or goes to school. Tier III offenders like Schauer are also required to provide other identifying information, including mobile phone numbers and email addresses, with law enforcement, Gusweiler said.

Defense attorney Kenneth Miller said that Schauer's wife has remained by her husband's side dispite the nature of the charges, and that his client showed "a great deal of remorse," during the sentencing. Miller said that his client's Valentines' Day 2011 suicide attempt, leading to hospitalization and a mental evaluation, stemmed from genuine guilt, and was not an attempt to delay court proceedings.

Hitman sentenced to life for murder at behest of victim's wife

A hitman hired by the victim's wife to kill for a $500,000 life insurance policy was sentenced to life plus 25 years in a Fulton County, GA courtroom for the killing. Jean Pierre Devaughn, 29 of suburban Atlanta, was sentenced by Judge Stephanie Manis Monday, April 11, 2001 for the murder of his cousin, 35 year old Eric Clark of Alabama. According to the Fulton County District Attorney's Office, Clark's wife, Constance Shinell Clark, hired Devaughn to kill her husband for his life insurance.

Clark had driven to Atlanta the day he was murdered with $500 cash to get discounted alcohol for a party he was bartending, prosecutors said. Authorities learned that in the months before he died, Clark's wife had secured a $500,000 life insurance policy on her husband, prosecutors said.

The victim's mother, Janice Clark, spoke for her son during the sentencing."Not seeing his lovely face and smile has been hard for our family. Eric was loved so much and he was brutally murdered and left like trash. This man has taken his life and shown no remorse...He destroyed our son and we will never be the same."

The wife is currently serving time in federal prison for identity fraud, but is scheduled to be tried for her husband's murder.

Syracuse men sentenced to 18 years imprisonment for attempted murder of wife

A Syracuse man was sentenced to 18 years imprisonment for shooting his wife Wednesday, April 6, 2011 in a Onondaga County courtroom for the attempted murder of his wife. Cecil Torrence III, a 35 year old father, pled guilty on Valentine's Day 2011 to a single count of attempted 2nd degree murder for shooting his wife Lisa in the bathtub after an argument over texting.

The couple reportedly was arguing about text messages the victim had received when Torrence pulled a gun and opened fire on her in the bathtub, the prosecutor has said. The victim was shot four times, but managed to crawl from the residence after the gunman left with the couple's 2-year-old child.

The victim collapsed in a snowbank outside her home where neighbors discovered her and called for help. The defendant was arrested the following day when he was found hiding in a closet of a home on North Midler Avenue.

Given an opportunity to speak in court, Torrence turned to face about a dozen relatives and apologized for any shame and embarrassment he caused them. He then apologized to his children for being taken away from them as a result of his conduct. Lastly, he apologized to his wife for causing her any pain and suffering.

Aloi noted Torrence's courtroom comments were far different from his reported comments to the probation officer who prepared a pre-sentence report. The judge said the probation report indicated no remorse by Torrence.

Paul Carey, Torrence's defense lawyer, said that the lack of remors in the pre-sentencing report was due to his advice not to talk about the case until after sentencing. The defendant's two daughters and aunt were upset with the length of the sentence because homicides can get that lenght of time behind bars. The aunt said her nephew was"a good person, a good father and a good husband."

Tracy, CA physician settles for millions in patient molestation cases - sentenced to 3 years imprisonment

Peter Chi, a Livermore, CA plastic suregeon who practiced in Tracy, CA, has settled a lawsuit for $1.8 million filed by 37 female patients who alleged that they were groped and fondled by him at his practice, according to Stewart Tabak, the attorney for some of the victims. Tabak said that he and other attorneys reached the settlement because "It would be better to resolve it now." Chi's insurance company, Evaston Insurance, is trying to revoke his policy for criminal acts, not covered under the policy.

Chi, a Livermore resident, was the medical director of Beauty Renewed Laser Skin Center at 1770 N. Tracy Blvd. He was first charged in February 2009 after eight women filed reports with Tracy police. More women came forward after the investigation became public. The incidents are alleged to have occurred from May 2007 to January 2008.

The criminal case against Chi, 46, is still ongoing. He has pleaded not guilty to 51 counts of sexual battery, 15 counts of sexual penetration with a foreign object while the victim was unconscious and one count of committing a lewd act upon a child. One of Chi's accusers was 15 at the time of the alleged molestation.

Chi's trial is scheduled to start October 25. He's currently free on $500,000 bail and has surrendered his passport and medical license to authorities.

(Update 4-13-11) Chi was sentenced to 3 years imprisonment and a lifetime on the sex offender registry on April 4, 2011. The disgraced physician pled guilty to 36 counts of sexual battery and one dozen of the victims were present in the courtroom. "Renee" said that Chi botched her plastic surgery as well as groped her. Diana Koron, Chi's marketing director between 2004 and 2006 until she said Chi sexually assaulted her, attended Chi's sentencing. “I’m glad it’s over. I wish the sentence would be longer. But I am glad it’s over. I’ve been waiting since 2006 for him to be sentenced. Being in the courtroom yesterday was so emotionally draining....He showed absolutely no remorse whatsoever. He wouldn’t even look at anyone,”she said. Koron was not represented in any of Chi's civil lawsuits or criminal charges.

An Uwchlan, PA man was sentenced to two years probation for recording a nude woman and a clothed girl at his home April 1, 2011. The sentencing of David W. Geipel, 37, was for invasion of privacy and disorderly conduct, and took place in Chester County (PA) Common Pleas Court under Judge Judge Anthony Sarcione.

According to Kubacke and the police complaint filed in the case, the recordings were discovered after Geipel's wife, Michele Geipel, called a close friend last spring and told her that she had discovered a computer's external hard drive with videos on it showing the friend's pre-teen daughter wearing a bathing suit in the bathroom.

Michele Geipel also told the friend, whose name is being withheld to protect her daughter's identity, that she had also seen on the hard drive a video of a mutual friend who had been staying at the Geipels' house using the shower. The video showed her naked.

After talking to the girl's mother on April 15, Uwchlan Police Detective Phillip Owen obtained a search warrant for the Geipel's home and seized as many as 10 computers, according to Ramsay. Owen turned the electronics over to the Chester County Detective's Computer Forensics Unit, which extracted videos, including those described by Michele Geipel.

Because the girl recorded was clothed, Geipel could not be charged with a crime according to Pennsylvania law. The invasion of privacy charge referred only to the adult victim. Because invasion of privacy and disorderly conduct is a 3rd degree misdemeanor punishable by a year in jail, Geipel was able to apply for Accelerated Rehabilitative Disposition (ARD) for first time offenders. He was turned down.

Besides two years probation, the cameras and computers used to record then store the indecent images were forfeited to the Uwchlan Police Department. Geipel was ordered to undergo psychosexual evaluations, and not to contact the grown victim, the child victim, or the child's mother.

A former state insurance claims adjuster pleaded guilty Friday to seven sexually motivated strangulation slayings of older women decades ago across Los Angeles County.

John Floyd Thomas Jr., 74, who Los Angeles police cold case detectives said was the notorious "Westside Rapist," pleaded guilty to the murders that took place in two waves, the first in Inglewood, Lennox and Los Angeles in the mid-1970s and the other in the Claremont-Pomona area a decade later.

The soft-spoken insurance claims specialist is described by the LAPD as one of the region's most prolific killers, responsible for as many as 30 slayings and about two dozen sexual assaults. But his plea in court Friday is for only seven killings.

The slayings involve Ethel Sokoloff, 68, in the Mid-Wilshire area in 1972; Elizabeth McKeown, 67, in Westchester in 1976; Cora Perry in Lennox in 1975; Maybelle Hudson, 80, Miriam McKinley, 65, and Evalyn Bunner, 56, all in 1976 in Inglewood.

The attacks appeared to stop in 1978, around the time Thomas was convicted and sentenced to state prison for the rape of a Pasadena woman. Thomas’ extensive criminal record also included serving a six-year state prison sentence, beginning in 1957, for burglary and attempted burglary. Two parole violations sent him back behind bars until 1966.

After his release in 1983, Thomas moved to Chino, which coincided with a wave of rapes and killings that began in the Pomona Valley area. Over the next six years, Los Angeles County sheriff's detectives would investigate five slayings of older women in Claremont, according to sources familiar with the investigation.

Adrienne Askew, 56, the last homicide with which Thomas was charged, was found strangled in 1986 in her Claremont apartment. The killings appeared to stop in 1989, the same year Thomas took a job in the state workers' compensation agency in Glendale.

The Westside Rapist faded from public memory and authorities made limited progress in the Claremont killings until late 2001, when the LAPD created the Cold Case Homicide Unit that reopened about 9,000 unsolved slayings going back to 1960, using emerging state and federal DNA databases.

In September 2004, the department's crime lab matched male DNA taken from the McKeown and Sokoloff crime scenes but were unable to match it to a suspect. Over the next five years, detectives developed 14 suspects only to rule out each of them as the attacker.

The break came in October 2008, when two officers collected DNA from Thomas while searching for the so-called Grim Sleeper serial killing suspect. Nearly two years later, LAPD Robbery-Homicide detectives arrested Lonnie Franklin Jr. in connection with 10 slayings of women in South Los Angeles after identifying him using familial DNA.

In March 2009, the California Department of Justice DNA laboratory notified detectives that Thomas' DNA matched the evidence from the Sokoloff slaying. Within days, the lab matched Thomas' DNA to four other slayings, leading to his arrest.

Thomas was born in Los Angeles. His mother died when he was 12 and he was raised by his aunt and a godmother. Thomas attended public schools, including Manual Arts High School. He also served in the military.

He briefly joined the U.S. Air Force in 1956. At Nellis Air Force Base in Nevada, a superior described Thomas as often late and slovenly. He received a dishonorable discharge, according to his military records. The next year he was convicted of burglary and attempted burglary, which would land him behind bars for nearly a decade.

But it was just the start of the criminal career of the alleged "Westside Rapist," who became one of the more notorious criminals of the era, targeting victims who ranged in age from their 50s to their 90s, according to LAPD detectives.

Bella Stumbo, the late Times feature writer, wrote in December 1975 that the "serenity" of the neighborhoods where the victims lived had been “grotesquely invaded by that elusive maniac the police loosely refer to as the 'Westside rapist,' now accused of sexually assaulting at least 33 old women and murdering perhaps 10 of them." She said residents lived in "small colonies of terror."

Victoria, BC teens sentenced to 10 to life for rape slaying of 18 year old girl

Kruse Wellwood, one of two teens sentenced to life in prison for the brutal rape and murder of 18-year old Kimberly Proctor last year, is the son of a convicted murderer.

On Monday, B.C. Supreme Court Justice Robert Johnston sentenced Wellwood, 17, and Cameron Moffat, 18, as adults and lifted the publication ban that had been protecting their identities since their arrest last June. Proctor was lured to a home, then tortured, beaten and sexually assaulted before she was killed. Her body was dumped and burned on a hiking trail in March 2010.

In eerily similar circumstances, Wellwood's father, Robert Dezwaan, is serving a life sentence for the 2001 murder of 16-year-old Cherish Billy Oppenheim in Merritt. Dezwaan got her drunk, sexually assaulted her and beat her to death. He left her badly damaged body covered with rocks and debris off a deserted road -where he later took RCMP after he pleaded guilty to second-degree murder. Dezwaan committed the crime while out on bail for a previous sexual assault.

At Monday's sentencing in a packed Victoria courtroom, Johnston ruled a youth sentence would not be long enough to hold the teens accountable for their crimes. He imposed the maximum adult sentence available for young offenders.

"It goes without saying first-degree murder with intent to kill is the most serious of offences. The circumstances of this murder as admitted by the young persons are so horrific that no words can adequately convey the inhumane cruelty these young men showed Miss Proctor," said Johnston. "They planned in advance to sexually assault and kill Miss Proctor. They chose her because they thought she would be an easy target, not necessarily because either of them had any ill will towards her."

Members of Proctor's family, including mother Lucia and father Fred, filled the front row of the courtroom. Lucia wiped away tears as Wellwood stood, hands clasped in front, with lawyer Bob Jones by his side as he was sentenced to life in prison.

Defence lawyer Steven Kelliher stood by Moffat, who appeared unemotional as he was sentenced to life in prison.

Outside court, Fred Proctor called the teens "animals" and said they deserve to die a long, slow, painful death."I don't even like to call them animals because Kim was such an animal lover," said Lucia. "To me they're just monsters and monsters are not rehabilitatable."

She lashed out at Wellwood's and Moffat's parents, saying they should have done something about their sons' risky behaviour before it escalated. "This didn't happen overnight this behaviour. You see the signs. You know when something is wrong with your child."

In October, Wellwood and Moffat pleaded guilty to the first-degree murder of Proctor, whose badly burned body was found under a bridge on the Galloping Goose Trail on March 19, 2010. The two admitted they lured the Grade 12 student to Wellwood's home, tied her up, gagged her, sexually assaulted her, beat her, suffocated her and mutilated her body with a knife. They then put her body in a freezer. The next day, they put it in a duffel bag and took it by bus to the Galloping Goose Trail.

Johnston also sentenced Wellwood and Moffat to five-year concurrent sentences on the charge of indignity to human remains, authorized the taking of DNA samples from the teens, and imposed a 10-year firearms prohibition.

Charges of sexual assault and unlawful confinement were stayed last week during the grim two-day sentencing hearing in which Crown prosecutor Peter Juk urged Johnston to impose adult sentences for the protection of the public.

Wellwood's father's crimes bear a striking similarity to the rape and murder of Proctor. The details of Dezwaan's offences can only be published now that the judge has lifted a publication ban on Wellwood's and Moffat's identities.

Before his murder conviction, Dezwaan had been arrested in March 2001 for sexual assault with a weapon, confinement, and robbery of a young woman in Kelowna. That followed a 1993 incident in which he was convicted of unlawful confinement and break and enter after he broke into a woman's home at night, climbed on her and tried to stuff a rag in her mouth.

A letter written by Wellwood and read in court last week, said: "As a child, I hated my father for what he had done. I felt I was less than him and now I find I have become a worse man. If you told me 10 years ago that I would commit one of the worst murders in British Columbia, I would not have believed you."

Court-ordered psychiatric and psychological reports on the teens show they are a high risk to reoffend violently and sexually. The reports also show there is little chance they can be rehabilitated.

Wellwood has been diagnosed as a sexual sadist -someone who derives sexual gratification from inflicting pain -with very strong psychopathic traits and strong indicators for necrophilia, an erotic attraction to corpses. A psychologist found he was aroused by the physical and psychological suffering of others, had rape fantasies and was interested in bondage and sexual asphyxia.

Moffat was not diagnosed as a sexual sadist but has a tendency to sexual deviance and the risk and thrill that go along with it. He has had conduct disorder problems since early childhood that involve defiant anti-social behaviour.

Correctional officer sentenced to probation for sex acts with inmate

A female former correctional officer was placed on two years probation Friday, March 25 with 2 years imprisonment suspended for having sexual contact with a 24 year old male inmate at the Burlington, IA facility where she used to work. 32 year old Megan Elizabeth Cecil originally faced four counts of sexual misconduct with offenders, but per plea agreement, two of those counts were dropped, and prosecutors agreed "not to file any additional charges now known to the state related to the defendant's employment at the Burlington Residential Correctional Facility."

Cecil admitted to engaging in a "sex act with an individual committed to the custody of the 8th Judicial District Department of Correctional Services," while she was a residential officer on March 9 and again on March 19, both of last year. The original charging document stated she had an inappropriate relationship with the inmate two more times later that same month.

Dan Fell, the correctional service's District Director, said Cecil started as a part-time residential officer in Sept. 14, 2007. She became a full-time employee in the position May 30, 2008, and resigned in April of last year. Three of the "sex acts" were reportedly committed inside the halfway house, and one was "in a location outside the facility," prosecutors said.

The two years probation were a compromise between jail time prosecutors were asking for and a deferred judgement that the defense wanted. Besides the probation related to her charge, Cecil will have to register as a sex offender and undergo counseling. Cecil will spend a decade on probation after the initial sentence.

St. Paul, MN man pleads guilty to forcing disabled woman to perform oral sex on city bus

A 22 year old Twin Cities man pled guilty Wednesday, March 30 to coercing a young woman with Down's Syndrome to perform oral sex on a bus last winter. Herbert Lee House, 22, of St. Paul, will be sentenced to between 5 and 5 1/2 years in prison on May 18 for a single count of 3rd degree CSC by Ramsey County District Judge Margaret Marrinan on May 18.

The charges said House was on a Route 64 bus in St. Paul about 10:30 a.m. Feb. 22 when the victim, a 19-year-old woman, got on board with a group of other vulnerable adults and their caretaker. Two teenage boys told police that the woman sat next to House, then they saw the two switch places. They saw the woman's head "bobbing up and down in the man's lap," the criminal complaint said.

Prosecutor Karrin Long got House to admit that the woman he victimized was developmentally disabled. "You know now that [the victim] is very slow and very dependent on other people?" Long asked. "Yes," House said. The sex offense was also a violation of probation for other charges. House had a criminal history involving theft, drugs, and assaults.

Britain's "Night Stalker" sentenced to life for rapes of elderly

Delroy Grant, 53, “terrified a whole community” for 17 years by committing hundreds of offences against pensioners including rape, sexual assault and burglary. Grant singled out his victims by looking for signs they were elderly and lived alone.

Dressed in black, wearing a mask or balaclava, with gloves on his hands, he would remove entire window panes, cut telephone lines and remove light bulbs before robbing and molesting his victims in the middle of the night. Yesterday, one of his victims, known only as Miss J for legal reasons, took the witness stand and faced her attacker.

At 5ft 1ins tall, with pure white hair and wire-rimmed spectacles, dressed in a white top and blue jacket, the 85-year-old stood as her police statement was read to the court.

"It is something that I shall never forget completely. It still feels so recent. I feel a huge amount of resentment and wonder how the suspect chose me. I often think to myself 'Why me?' or 'Why any of the other victims?'. I also feel a sense of indignation and anger as I feel that I had done everything reasonable to avoid this sort of thing happening. I have found that time is not a great healer. I don't think that it has got any easier over the last year. I certainly haven't got back my peace of mind."

She then added in person that she failed to understand why Grant had struck, before thanking the judge for the opportunity to speak.

The police operation to find Grant cost an estimated £7million and was the largest hunt for a serial rapist ever conducted in London. However, they had missed an opportunity to arrest him in 1999, which allowed him to strike again over 100 times more.

He was yesterday jailed for life, with a minimum of 27 years before he could be considered for parole.
Judge Peter Rook, sentencing, told Grant he remained a “very dangerous man capable of committing heinous crimes and causing incalculable harm” and warned him he was likely to die in jail.

The judge said: “You targeted elderly victims living alone. Your actions blighted the remaining precious years of their lives. Their homes, where many of them had lived for years, should have been their safest refuge where they could have expected to live their lives undisturbed and at peace. It is hard to imagine the extreme fear that the feel of your gloved hand and the sight of your masked figure looming above them must have been felt by your victims in their beds.”

He also placed Grant on the sex offenders' register for life.

Grant's defence counsel, Courtenay Griffiths QC, admitted that he could offer no mitigation for his client other than to point out that his age meant he would probably spend the rest of his life in jail.
Mr Griffiths added: "These offences were indeed perverse and disgusting and they were also uniquely revolting."

Before the former minicab driver left Woolwich Crown Court, in south London, the judge made these remarks. "Delroy Grant. Your utter depravity knows no bounds. The 18 victims of your offending were all elderly. In respect of nine of them, not only did you break into their homes in the middle of the night, that invasion being a highly traumatic experience for them in itself, but you then proceeded to subject them to humiliating and degrading sexual attacks.

Your offending spanned a period of 17 years. Five south London boroughs were affected by your offending. Over 17 years you have terrified a whole community. As your counsel accepted, thousands of people in south London have been living in fear that they might be your next victim.

It also led to an enormous drain on police resources as the years went by and you evaded arrest. Your offending led to the largest hunt for a serial rapist ever conducted in London.

This series of offences have multiple aggravating features. Your offending falls in a category of its own, way above anything envisaged in the definitive sentencing guidelines.

You targeted elderly victims living alone. Your actions blighted the remaining years of their lives. Their homes, where many of them had lived for years, should have been their safest refuge, where they could expect to live their lives undisturbed and at peace. You chose to invade their homes when they were in bed at night.

It is hard to imagine the extreme fear that the feel of your gloved hand and the sight of your masked figure looming above them must have been felt by your victims in their beds. Those who you raped or attempted to rape were all over 80. Many of your victims were in poor health.

Since in every case but one, your elderly victims lived on their own, I can only conclude that these offences were well-planned and you targeted victims. Singling out your victims must have involved considerable planning, as you chose the most vulnerable of people.

In the middle of the night, you would wake your victims who would be sleeping in their own beds by placing a gloved hand over their mouths to stop them screaming. You would shine your torch into their terrified eyes. You would search their homes and steal their money. I am not going to catalogue in detail the trail of distress, fear and misery you have left behind you.

There can be only one sentence and that is life imprisonment. I have no doubt that these offences are of such seriousness that a life sentence is appropriate to reflect the public abhorrence at your offending. You are a very dangerous man capable of committing heinous crimes and causing incalculable harm to people. It will be a matter for the Parole Board whether you ever be released. It may be that you will never be released.

Your offending is in a league of its own. I must look at the totality of your offending. I bear in mind that you are now 53. If this was a determinate sentence, a total sentence of 54 years would be appropriate. This means the minimum term will be one of 27 years, less the time you have spent in custody. I am told that is one year and 129 days. That makes the total minimum sentence 25 years, 236 days. I stress that is the minimum term you must serve.

It will follow automatically that you will be placed on the Sexual Offences Register for life.

St. Paul weight trainer accused of sexual misconduct with 16 year old - stipulated facts trial leads to probation

A 25 year old weight room supervisor at Cretin-Derham Hall in St. Paul, MN was charged with two counts of 3rd degree criminal sexual conduct for a sexual relationship with one of her 16 year old students which took place back in 2008. Gail E. Gagne is alleged to have engaged in sexual contact with the 16 year old several times, including at her Bloomington, MN home and at a hotel near the Mall Of America.

Hotel records and Gagne's credit card receipts show that on Sept. 13-14 of that year, she spent the night at LaQuinta Hotel on Nicollet Avenue south in Bloomington, the complaint said.

The principal at the private Catholic school told police that Gagne was hired in November 2007 as an assistant basketball coach. From January through September 2008, she was a substitute teacher. In the summer of 2008, she worked in the weight room, and in late September 2008, she was hired as a full-time teacher, the complaint said.

Gagne is not in custody because she is believed to be in Chicagoland. Hennepin County District Judge Ron Abrams issued an arrest warrant Tuesday, December 1. Her attorney, Earl Grey, said his client will plead not guilty. Third degree CSC is a 15 year felony in Minnesota.

(Update 12-13-09) Gagne turned herself in at the Hennepin county Jail 3:30 Thursday, December 10, but made her $50,000 bond four hours later, according to jail records. She appeared for her preliminary hearing before District Court Judge Thomas Sipkins Friday, December 11, where she was ordered to stay away from the alleged victim.

(Update 2-8-11) A "stipulated facts" trial heard by a judge only will decide the case of Gagne. He jury trial was supossed to have started yesterday, February 7, 2011. This means that the prosecution and defense attorney has gone to agreement on facts without having a formal plea agreement. Also like a plea agreement, a count of 3rd degree CSC was dropped and a second count of 3rd degree CSC was reduced to 5th degree CSC, a gross misdemeanor.

Under the agreement, prosecutor Judith Hawley will prepare a statement of the facts in the case and she, Gail Gagne and Gagne's attorney, Earl Gray, will sign it and submit it to Judge Richard Scherer on Wednesday. A sentencing hearing is set for March 28 if she's convicted.

According to Professor Joseph Daly of Hamline University Law School, such a legal arrangement meant it was a near certainty that Gagne would be convicted during the bench trial.

(Update 3-29-11) Yesterday, Gagne was sentenced to a year in jail, suspended, and two years probation by Hennepin County District Judge Richard Scherer. Gagne did not speak, but her victim's mother did. The mother said that she had hoped to send her son to Cretin-Derham to "provide a safe, loving environment," but that Gagne had betrayed her trust and damaged her family's lives. "His family is left holding the dirty laundry of the defendant's unprofessional, self-serving actions."

After the hearing, both sides used the words "reasonable" and "appropriate" to describe the outcome. Then again, they had both agreed to what it would be last month when they filed a "stipulation" with the court laying out what the facts were.

"I thought it was a reasonable disposition of the case," defense lawyer Earl Gray said afterward. "Although I thought I could win it, you can also lose."

"I think we had an appropriate resolution to a very unhappy situation," said Hennepin County Attorney Michael Freeman. He said he believed the verdict and sentence would send a message to teachers, coaches and others with authority over youths that having sex with students has strong consequences. "Society doesn't permit it, and morality doesn't permit it," Freeman said.

Gagne has moved to California.

Former high school basketball star given 84 to 230 years in home invasion rapes

On March 10, 2011, a former basketball player was sentenced to 84-230 years imprisonment for two Philadelphia assaults. 25 year old Domenique Wilson was handed the term by Philadelphia Common Pleas Court Judge Charles J. Cunningham III, who said he handed down the sentence to ensure "there is never a day when he is out."

Judge Cunningham continued, "This was not the case of someone who broke in an apartment and happened to find somebody there. You are a serial rapist, a serial criminal. You just got caught sooner rather than later." Wilson was convicted by a jury in November of rape, burglary, and robbery in the Philly attacks.

Wilson forced his way into an apartment on Oct. 22, 2008, on Clinton Street in Center City. He then raped and robbed a 25-year-old woman at knifepoint, and tied up, robbed, and assaulted her 29-year-old boyfriend.

Wilson was also found guilty of forcing his way into a Spruce Street apartment Dec. 19, 2008. The 24- and 22-year-old University of Pennsylvania female students testified that Wilson threatened them with a gun and knife, covered their eyes, mouths, and wrists with duct tape, and repeatedly raped one.

Both rape victims gave an impact statement, read in court. The first victim's statement said, "In one selfish, disgusting act, you destroyed every part of my life. You attacked me repeatedly in my own bedroom. I no longer have a safe place to call my own - not a single one. My fear is practically constant...With how heartless you seem to be, I don't know if you have the capacity to feel sorry for what you did. But I trust you'll have a long time ahead to think about it."

The Spruce Street victim said, "I want to say 'thank you' for all of the wonderful things I have been blessed with from this horrible act," including a closer relationship with the roommate who had to hear the rape, and a friendship with the other victims.

The Philadelphia sentence will be served consecutively to a Clinton County, PA sentence of 70 to 196 years for home invasion rapes at Lock Haven University in February 2009. Wilson attended school on a basketball scholarship before DNA evidence linked him to the college attacks in April 2009. Wilson was sentenced for those crimes in June.

Border guard gets 2 years for making women strip for no reason

A Canadian Border Service Agency (CBSA) guard was sentenced to 2 years less a day in the British Columbia jail system followed by three years probation by forcing young women, three Americans and a Canadian, to strip under threat of detention or a criminal record. The victims were detained on pretence of drug charges. 35 year old Daniel Johnson Greenhalgh was sentenced by BC justice Fritz Verhoeven in a New Westminster, BC courtroom on March 4, 2011.

The incidents took place in the spring of 2007 at the Douglas Border Crossing in South Surrey (known as the Blaine or Peach Arch crossing to Americans). The gropings took place between April 12 and May 26 in various locations at the crossing. The first incident, on April 12, featured two Seattle young women who were trying to cross the border. Greenhalgh separated them, made both of them strip, but only groped one of them.

The victims were not admitted into Canada. The next incident featured a Canadian woman who was returning from Seattle with her friend April 14. The last incident featured a young heterosexual couple detained at the border on May 26, 2007. The last incident lead to the charges Greenhalgh were convicted of.

The couple were detained at the border for one hour and 20 minutes. During that time Greenhalgh allegedly grilled the young woman about whether she was smuggling drugs, and then suggested that she could either be detained overnight in a cell and strip-searched in the morning or strip-searched now. When she chose to be strip-searched immediately, she was told to walk to the back of the building.

Greenhalgh then allegedly took her to a men's bathroom in a park where he ordered her to take off all her clothes except her underwear. After patting her underwear and private parts, he touched her breasts. She got dressed and the couple was allowed into Canada.

Justice Frits Verhoeven said that while even a legitimate strip search can be humiliating, the disgraced border guard used "relentless lies, intimidation and threats" to coerce women who knew the searches were illegal, but "reluctantly surrendered." Greenhalgh's abuse of authority had not only tainted the reputation of the CBSA, but tainted the reputation of Canada itself. Justice Verhoeven said that crimes like Greenhalgh's "shock and appall nearly every Canadian."

As a border guard, Greenhalgh was entrusted with enormous power, which he "knowingly, flagrantly and repeatedly" abused with apparent indifference to the suffering of his victims, Verhoeven said. And yet, he noted, the former guard has shown no sign of remorse.

The judge noted that Greenhalgh refused to discuss the offences with a psychiatrist prior to sentencing. Outside court, defence lawyer Stephanie Vyas explained to reporters that Greenhalgh maintains he's innocent and will launch an appeal of his conviction. The psychiatrist found him a moderate risk to reoffend, unless he finds himself once again in a position of authority. In such circumstances, the psychiatrist said, he'd be a high risk.

Two of the victims submitted victim impact statements. One said that after the "insult to her dignity," she had become cynical about authority figure, and a second victim is now afraid to travel. Another victim impact statement was submitted by Greenhalgh's ex-wife, who he met on the job as a fellow border guard. The ex-wife said that the crimes were a "devastating" breach of trust not only to the profession, but to her and their children. Greenhalgh is currently living in his parents' basement after being fired from the CBSA, a construction job, and using up his unemployment benefits.

Crown prosecutor Winston Sayson said that the sentence was just, since Greenhalgh's conduct was "an affront to all Canadians. He broke his promise, his oath of office."

Prosecutor given 6 months in jail, SO treatment for assaulting drunk driving defendant

A former Holland, MI city attorney was sentenced to 6 months in jail, a year of probation, and sex offender treatment for coercing a 21 year old woman into sex in exchange for letting her off on a traffic ticket. 31 year old Carl Gabrielse was formally sentenced Monday, April 19 to 3rd degree criminal sexual misconduct and misconduct in office by Ottawa County Circuit Court Judge Calvin Bosman. If he completes his probation successfully, Gabrielse can withdraw the 3rd degree CSC conviction and plead guilty to a reduced charge of gross indecency between a male and female, allowing him to escape the Michigan SO Registry.

The incident took place with a 21 year old Zeeland, MI woman in a jury bathroom last fall.

Gabrielse, contracted through Cunningham Dalman as a deputy city attorney, was accused of assaulting the woman at the Holland District Court in November. The victim later helped gather evidence so police could arrest Gabrielse.

The victim, who never entered the drunken-driving plea reached with Gabrielse, recently reached a different deal with prosecutors to plead down to impaired driving.

The judge scolded Gabrielse before accepting the plea. "I'm sure you know your biggest crime in this case is your violation of your oath to your wife, your oath to your profession and your oath to your employer. It's a costly violation."

So did the victim's aunt on a local forum.

Let me educate you all about a few things, since you weren't there and don't know all the facts. I was there as I am a relative of the victim. First of all.....she was RAPED! He admitted to RAPE. These things are on the record. She had no say in 'the deal' that was made. Her life is never going to be the same. First she gets RAPED by a member of the legal profession. Then she gets metaphorically RAPED by the judicial system.

Guess what the judge said upon sentencing? I haven't seen this reported so I assume the media is in on 'the fix'. The judge said in words similar to these that 'Mr Gabrielse, the people you hurt most in all of this is your profession and your wife and family' Really? Not one single mention about my niece and what she will have to go through because of a corrupt system. I won't go into all of the rest that happened because it all just makes me want to puke. This person, who I refuse to call a man, has gotten off virtually free. All the judicial system wants to happen here is for this to go away. I hope reasonable people can see what happened here.

A young woman commited a crime that she should have been punished for IN A COURT SESSION, not by being assaulted. Once again, Mr. Gabrielse admitted to RAPE and was caught on tape saying he'd like the next time to be 'more mutual'. This......piece of filth should have to suffer for the rest of his life. Instead....because he is a husband and father, and because he's remorseful, and because he's a deacon in his church, and because he hasn't done it before, (somehow I don't buy it), and because he has already been fired, the judicial system, including the prosecutors office I might add, thinks the deal that was made is appropriate. Unfreakenbelievable.

She was hung out to dry the moment she reported it. This is a fantastic precidence to set for victim's of RAPE and other types of abused. Say yes to Michigan? Maybe. But not to the Ottawa County judicial system. Sounds like something that would have happened 75 years ago in the deep south, not in modern America. So very sad.

Gabrielse's law license is currently on administrative suspension by the Michigan Attorney Grievance Commission, an arm of the Michigan Supreme Court that handles attorney misconduct cases of all types. John Burgess, the attorney handling the expected discipline by his organization, said that the complex plea deal will complicate, but not derail the actions expected against Gabrielse's license.

“It’s a unique situation in that he entered a plea but I understand that he may have the opportunity to withdraw it. That could be a bit more tricky” in deciding exactly when to begin disciplinary proceedings, he said. It’s certainly a serious matter and it’s going to be treated as such,” said Burgess.

(Update 3-12-11) Gabrielse finished his probation without any hitches, so he was able to withdraw his original CSC plea and plead to indecency between a male and a female under Judge Jon Hulsing Monday, March 7. The victim has filed a federal lawsuit against Gabrielse and the city of Holland. The defendants have agreed to settle with the plaintiff out of court, but details of the settlement are still being negotiated.

Suburban Buffalo man gets 25 to life in ambush, beheading of wife

A suburban Buffalo man was sentenced to 25 years to life yesterday in an Erie County, NY courtroom for the beheading murder of his wife. Mohammed "Mo" Hassan was sentenced to the maximum sentence, 25 years to life, for the murder of his wife Aasiya, in their Bridges TV studio in Orchard Park, NY on February 12, 2009. Hassan sneaked up on his wife, stabbed her 40 times, then cut off her head, according to prosecutors.

The murder was preceded by allegations of domestic violence. The jury took only an hour to reach their verdict on February 7, 2011.

The jury reached its verdict after 14 days of testimony and arguments spread over the course of three weeks in Erie County Court. The jury was clearly moved by the mountain of evidence and eyewitness testimony presented by Curtin Gable and fellow prosecutor Paul Bonanno depicting Hassan as a longtime spouse abuser who methodically planned the brutal, blood-soaked attack on his wife in the darkened hallway of their Bridges TV studio on Feb. 12, 2009.

Besides the 25 years to life sentence, Hassan was also served with a no contact order placed by his eldest two children.

Doctor sentenced in indecent assaults on patients

Authorities said a doctor who practiced in Kennett Square and was known for treating Lyme disease had another specialty: making unwanted advances to female patients. Peter Fabulian, 63, of Strasburg, who pleaded guilty in December to two counts of indecent assault, was sentenced Tuesday [March 1, 2011] to one month in prison and five months of electronic home confinement, followed by two years of probation.

"I know I've hurt people; I never meant to hurt people," Fabulian told Chester County Judge David F. Bortner.

The judge said Fabulian should have recognized the consequences of his actions. "He never meant to hurt people. . . . That may be, but he certainly did - very deeply and very seriously," Bortner said. "A lesser sentence would depreciate the seriousness of the crimes."

Assistant District Attorney Andrea Cardamone, who sought a six-month jail term, said that after Fabulian was charged with assaulting two women, others came forward. She said that two were within the statute of limitations and that the District Attorney's Office agreed not to file additional charges in exchange for Fabulian's cooperation. She said the agreement also included a provision that the court would hear about the other two cases to show a pattern.

During a hearing that lasted nearly three hours, Cardamone presented two witnesses and read a letter from a third. The women are not being identified by The Inquirer because of the nature of the offenses. Both described Fabulian's sexual overtures as an excruciating breach of trust. The first woman said she had to wait a year and a half for charges to be filed after contacting police because authorities said another victim would bolster her case.

Bortner said Fabulian's sentence would reflect only the two victims in the criminal complaint. He also said he would leave Fabulian's future as a doctor in the hands of the state Board of Osteopathic Medicine. A hearing is scheduled later this month.

Green card marriage leads to murder of wife, life without parole for husband

A Jamaican national who married a Florida woman to gain residency easier was sentenced to life without parole Wednesday, March 2, 2011. Orane Ferguson, 31 and a resident of Land O Lakes, FL, was convicted by a Pasco County jury of 1st degree murder for stabbing his wife, Lenora Michelle Ferguson, 50 times in the bathroom of their home. Ferguson was also convicted of aggravated battery for stabbing the murder victim's minor son, Gabriel Neal. Since prosecutors did not seek the death penalty, Circuit Judge Michael Andrews could only sentence the defendant to life without parole.

The Kingston, Jamaica native testified that he was in Florida for a four month visa to attend his brother's funeral when he met the victim, who went by her middle name. The woman suggested that she would help Ferguson obtain permanent residency in the United States by marrying him, while he supported her and her son. According to defense attorney Assistant Public Defender Willie Pura, Ferguson was met with increasing demands by his wife, including sex and impregnation, and threatened to withdraw her immigration help if he did not comply. Things boiled over on July 20, 2008.

The Fergusons argued that Sunday morning before heading to church in Lakeland. A second argument broke out after they returned home that afternoon. This time it turned violent. Orane Ferguson grabbed knives and so did Neal, who heard his mother screaming and ran downstairs to help her.

Eventually, Michelle Ferguson ran into a bathroom. Her husband forced his way in and began stabbing her. Neal ran to the door with a knife and began trying to attack his stepfather. Orane Ferguson stabbed him in the mouth, chest and thumb. The boy collapsed but managed to run outside and get help. Orane Ferguson testified that he doesn't remember stabbing his wife.

In closing arguments, Pura said that the events of 2008 should be considered manslaughter, since"There is simply no evidence of premeditation." Assistant State Attorney Mike Halkitis "How long does it take to get some knives, chase her into the bathroom, knock down this door and stab her 50 times? Is that enough time for reflection? I submit that's more than enough time for reflection."

The victim's sister Lakeisha Robinson, said that she remembers Michelle as a loving and caring mother. "The only thing she did wrong was marry the wrong man."

The wheels of justice turned tough Friday [March 4, 2011]on Alex C. Callison, a Bloomfield man who entered several pleas of guilty in a case involving the rape and confinement of a 78-year-old woman in October. He's headed to the Indiana Department of Corrections for 88 years in prison. Even if he racks up good time credit, it would still be 44 years before his release. Callison was 28 years old when he was arrested on Oct. 31.

When Greene Superior Court Judge Dena Martin pronounced the sentence on each of four criminal counts, she ruled that the sentences will be served consecutively, or one after the other.

During a change of plea and sentencing hearing early Monday, Callison entered a plea of guilty to, and was sentenced to:

* Burglary, a class A felony, 47.5 years (the maximum allowed by law is 50 years)

* Rape, a class B felony, 19 years (maximum of 20 years)

* Criminal deviate conduct, a class B felony, 19 years (maximum of 20 years)

* Intimidation, a class D felony, 2.5 years (maximum of 3 years)

Callison was represented in court by Attorney James Riester, serving as a public defender. The State's case was argued by Greene County Deputy Prosecutor Keven McIntosh.

The case initially filed against Callison included five other criminal counts which were dismissed under the terms of a negotiated plea agreement. The agreement left sentencing up to the discretion of the judge.

After the hearing, McIntosh said the Prosecutor's Office was pleased with the sentences. "He got roughly what he would have gotten had this case gone to trial and if he had been found guilty by a jury," said McIntosh noting that under Indiana's sentencing guidelines, some of the charges would have been merged for sentencing purposes.

"I'm happy with the outcome and I think the victim's family is happy with the outcome," said McIntosh.

The defense did not share that satisfaction and requested that a state public defender be appointed to represent Callison in an appeal of the sentence. Since Callison plead guilty, by law he cannot appeal the conviction, but he can appeal the sentence.

McIntosh said the victim did not ever want to see the defendant again and she didn't want to have to go through a trial. But she told him if it became necessary, she would testify. The victim did not attend the sentencing hearing, but was represented by four members of her family who all took the stand: Three daughters and one granddaughter.

"They did a tremendous job conveying to the judge how this has affected their mother and grandmother and their entire family," said McIntosh. "They should be commended for their heartfelt testimony."

Callison was accused of breaking into a home where the elderly victim lived alone. She thought she heard a knock on her door at 3:30 a.m. but chose not to answer it due to the time of night. Moments later Callison broke in and made his way into her bedroom.

Callison stayed in the home until the next afternoon. During that time, the victim was attacked again and again, forced to make breakfast for the man and she was threatened with knives out of her own kitchen.

She was able to give police a description and later identified Callison in a photo lineup. Crime scene technicians seized numerous items of evidence including the knives, Coke cans he drank from and other materials with DNA evidence and/or fingerprints.

When the victim was first interviewed, a detective said she was "visibly shaken" and became physically ill. During the hearing, two interviews were replayed, one with the victim and one with Callison.

Callison's criminal history was also brought out -- he had one previous conviction on his record, a class C felony burglary involving a break-in at a barber shop in Daviess County. Callison was on parole for that conviction when the current crime was committed.

McIntosh said he thought the defendant did seem sorry for what had happened but that didn't make up for what he did to the victim.

"I do not think that Callison is just a predator. I think this incident was fueled by drugs and alcohol," said McIntosh. "Appearances can be deceiving, but in court, he seemed remorseful. And by admitting guilt, he did save us going through a trial."

When asked about the victim's recovery, McIntosh said this had been a very difficult experience for her. "Since this happened, she's no longer able to stay by herself -- this changed her life greatly," said McIntosh. "She's tough, but this has affected her deeply. I hope she will overcome this, I think she will overcome this. I know she's a resilient lady."

Wife gets life without parole for at least 20 years for son's murder of husband

A woman who conspired along with her 20 year old son to kill the woman's husband was sentenced to life without parole for at least 20 years in a Topeka, KS courtroom Thursday, February 17.

44 year old Michelle Eberhardt was convicted of felony 1st degree murder for the murder by her son of 51-year-old Gerald “Jerry” Eberhardt. Judge Debenham said to the perpetrator, "You have violated the trust between a husband and a wife.[The family's] pain and suffering won't end today. It will continue for the rest of their lives." The shooting death rook place on October 25, 2009. Michelle's plea to felony 1st degree murder spared her a trial on premeditated first-degree murder, conspiracy to commit first-degree murder and solicitation to commit murder.

Scott M. Mosher, 20, the alleged triggerman in his stepfather's murder, is scheduled to go on trial June 13 for premeditated first-degree murder and conspiracy to commit premeditated first-degree murder

According to facts presented in Eberhardt's plea, Michelle Eberhardt and Mosher had talked about killing her husband, a used car dealer in Topeka. Mosher said he knew someone who would kill Jerry Eberhardt for $2,000. Michelle paid the money, but Jerry Eberhardt wasn't shot. She negotiated with the man who had taken the $2,000, but the man wanted more money and a car from the lot.

Mosher told Michelle he had a pistol and would take care of the slaying. Michelle Eberhardt said the house at 2538 S.E. Shawnee Heights Road would be empty Oct. 25, 2009, after 12:30 a.m., and at 1:30 a.m., she heard a gunshot. When she found her husband, he was sitting up in bed in the master bedroom of the family home.

A third defendant, Derrick Dwayne Haase, now 21, of Topeka, pleaded no contest April 26 to a reduced charge of reckless second-degree murder. On July 22, Haase was sentenced to 10 years and 11 months in prison.

The victim's father, Duane Eberhardt, said that the Eberhardts tried to welcome Michelle and her two children, but that she was "unberable" and a "rat." Like good parents do, Duane tried to convince his son to divorce her, but Jerry claimed to still be in "love" with her. "Dad, I know you're right, but I love her," Jerry told his dad. "You’ve stolen part of my future. The father said he intended to live long enough "to urinate on you and your son's graves because neither one of you will survive your prison sentences."

The victim's mother Mary said that her son would protect his wife after Mosher would beat her when she refused to give him money for drugs. However, she repaid that concern with betrayal when after the murder, Michelle told Shawnee County deputies her husband was responsible for his murder. “Why? Why did you do it? Jerry loved you. We loved your family. Why did you betray us...“You killed Jerry. Scott just pulled the trigger. What mother would encourage her son to kill? You threw your son under the bus.”

At least one Topeka Capital-Journal commenter said that Jerry should have listened to his father instead of his heart regarding Michelle.

Northwest Houston serial rapist sentenced to life with parole possibility in 30 years

A Houston man charged with five rapes and a murder in the Acres Homes neighborhood received a life sentence with the possibility of parole on Thursday. The same jury found LaMarques Devon McWilliams, 35, guilty last Friday of one aggravated sexual assault — a first-degree felony. The other rape charges were dismissed. He will be eligible for parole after serving 30 years in prison, according to his lawyer, Jacquelyn Carpenter.

McWilliams is accused of raping a woman who has pleaded guilty to prostitution three times in Harris County in the past two years, according to public records. The woman, who is not being named by the Houston Chronicle, testified during the guilt-innocence part of the trial.

After McWilliams was convicted on the single aggravated sexual assault charge, the prosecution presented DNA evidence that linked him to several other women, who testified during the penalty phase of the trial that they were raped by McWilliams.

McWilliams was arrested in August 2009 on two counts of aggravated sexual assault. A month later, he was charged with three more rapes and the death of Pamela Ann Goss, whose body was found in the Acres Homes area in 2006. McWilliams still faces a murder charge.

Carpenter said most of the women who testified this week worked as prostitutes.

"DNA shows evidence of sexual activity but it doesn't necessarily mean that the sexual activity was rape," the defense lawyer said. "If there were any sex, I believe it was consensual."

McWilliams did not testify, but has maintained his innocence. His lawyers have filed a notice of appeal.

Carpenter contends that her client was identified by police for political expediency as a way to calm fears about a rash of rapes and killings.

"They've been looking for someone for years," she said. "This was about showing the black community that we care that something is happening in (Acres Homes)."

A prosecutor with the Harris County District Attorney's Office could not be reached for comment.

Acres Homes residents and local activists became alarmed by the possibility of a serial killer or serial rapist in the northwest Harris County community after several bodies were found along roadsides, ditches and empty lots beginning in 2006. During the same time, there were dozens of sexual assault reports in the area. The investigation became one of the largest in the history of the Houston Police Department, which formed a special task force and devoted what was described as unprecedented resources to chase leads.

That probe resulted in multiple arrests, but charges were filed against McWilliams and Bilford Dwight Junious, 40, who was accused of nine sexual assaults in Acres Homes over seven years. He was convicted on one rape charge in 2009 and sentenced to 40 years in prison. The other charges were dismissed.

Husband gets 10 years in university dean's slaying

On Monday, February 28, 61 year old William Murray Wiggins received 10 years for the 1st degree manslaughter of his wife, an assistant dean of the University of Oregon College of Education. The dean, 62 year old Andrea Nicholson Wiggins, was found strangled in a bathtub at her Springfield, OR home March 5, 2010. The perpetrator pled guilty to 1st degree manslaughter because prosecutors were uncertain that they could prove 2nd degree murder. Lane Circuit Judge Charles Carlson presided over the plea deal and sentencing.

William Wiggins initially reported his wife’s death as an accidental drowning. He might have succeeded at the ruse had Andrea Wiggins not left injuries on her husband’s body as she fought for her life, Springfield police Sgt. David Lewis said after the brief sentencing hearing.

Lewis credited Springfield police Detective Larry Turner with asking to see and then photographing scratch marks and “a severe bite mark” on William Wiggins’ chest after responding to a 911 report of “an elderly female found dead in a hot tub.”

Strangulation bruises were “not obvious” on Andrea Wiggins’ neck, Lewis said — perhaps because her body remained in the hot tub after her death.

William Wiggins claimed he killed his wife "while under the influence of extreme emotional disturbance,” but Springfield police indicated that the lack of financial contribution on his part to the marriage lead to the argument which lead to the slaying.

At the time of Andrea Wiggins’ death, William Wiggins had an inactive real estate broker’s license and she was the primary breadwinner. Her professional accomplishments included raising $30 million in private donations for a new College of Education building that opened in 2009.

According to the victim's son Alexander Vollmer, "she told us that Bill had no savings or money of his own and that she would have to earn enough for them both.” The victim's father said “I believe Andrea had had about enough and Wiggins was aware he was about to lose his meal ticket.

Before the sentence was passed, William said “Andrea was the love of my life and I’ll never forget her. I took away a daughter and a mother and a grandmother from her family. I cannot ask for their forgiveness. I can only hope for their understanding some day.”

Lane County Deputy District Attorney Bob Lane said the victim's family accepted the plea agreement because the perpetrator has reliquenched “all claims to property belonging to the victim, the victim’s estate, and to any proceeds of any life insurance policies. They wanted to make sure that he didn’t benefit from her death.”

Laura Fine, William Wiggins's attorney, said that the strangling of his wife was an anomoly in their 13 year marriage. "All reports indicate that this was a very loving couple with no history of domestic violence.” Her client's actions, she explained, was “the documented side effect of explosive rage caused by one of his prescription medications.”

Vollmer gave a victim impact statement saying that “It’s unbearable to think about how terrified my mother must have been in the last moments of her life,” As his rock, "Every day I miss her sound advice, her wacky sense of humor, her delight in retelling family stories, and even her constant worrying. Her absence has left a gaping hole in our lives.”

The son is still “shock and terrible distress at the nature of my mom’s death and Bill’s role in it," with the worst part being “having to explain to my 7-year-old daughter how her nanny had died.”

The victim's father Jack Nicholson wrote Judge Carlson explaining that his former son-in-law was
“a cruel, callous and calculating killer” and a “deadbeat,” in contrast to his daughter, who "was a precious and special person” who “worked all her life trying to make things better.”

Vancouver BC father of four sentenced to 10 years for murder of wife

A judge has sentenced a Vancouver father of four to 10 years in prison for strangling his wife to death. But after double-time credit for pre-sentence custody, Orlando Carderas Mangaoang, 49, will serve two and a half years in prison for the May 2007 slaying of his wife, Editha, 41.

Court heard that the marriage became tumultuous after Editha, a nanny, came to Canada from the Philippines and sponsored her husband and their kids to follow her to Canada. They argued over money and Mangaoang’s perception that his wife was unfaithful to him. He became obsessive, following her and phoning her repeatedly.

Then one night following an argument, he struck her over the head with a metal object, fracturing her skull.
He spent up to 30 minutes strangling her with his hands, then cut up her panties in a search for semen before placing her half naked body in a cardboard box. The following day he drove to a remote location in Richmond and dumped the body.

Mangaoang lied to his children and to the police about his wife’s whereabouts and a massive search was launched, in which he participated. At one point his oldest son was placed under suspicion and took a polygraph. Three weeks later Editha’s body was found and Mangaoang was arrested. He confessed to the killing and was charged with second -degree murder.

But in January the accused pleaded guilty to the lesser and included offence of manslaughter. In sentencing him on Wednesday, B.C. Supreme Court Justice Bill Smart said that what precipatated the killing was not clear but that all of Mangaoang’s anger, frustration and contempt for his wife exploded in a rage.

The judge said Mangaoang’s conduct after the killing was almost as “disturbing and shocking” as the slaying itself. Smart noted that the Crown was satisfied that in his rage, Mangaoang did not have sufficient intent for murder. He said he was satisfied that the accused had shown “great remorse,” was otherwise a law abiding citizen and was determined to devote his life to helping his children.

He said the four children were the other victims of the crime.“They lost a mother and their relationship with their father has changed forever.” The judge quoted from letters written by the three sons of the couple. One of the sons wrote that they miss their father a lot and “would hate to see him grow old” in prison. “We would like to continue to have him be part of our lives because he’s the only one we’ve got. The past is the past and we cannot change it but we can alter the future.”

Another son wrote that his father was a changed man and that he had grown close to him. “I know that what he did was unacceptable and unthinkable. The past is the past... He confessed and apologized for what happened and I forgive him. I’m asking for the court to show mercy to my father.”

Outside court, Carmen Garcia, Editha’s aunt, said she respected the court’s decision but added she would have liked to have seen a stronger sentence. Garcia, who sponsored Editha to come to Canada, recalled her niece fondly.

“My niece was a caring, loving mother. She cared for her children. She was always very caring to all of us.”
Double-time credit was granted because the offence happened before the law changed to disallow the sentencing provison.

Semen squirting sicko sentenced to probation

A suburban DC man was sentenced to probation Thursday, February 24 for squirting semen onto 5 female shoppers. The gooey attacks took place between November 2009 and July 2010. Montgomery County District Court Judge Stephen P. Johnson sentenced 28 year old Michael Wayne Edwards Jr. to counseling and regular status hearings, but not sex offender registration. The perp plead guilty in November 2010 to 2 counts of 2nd degree assault and the three years probation are for those counts running concurrently.

Officers from the Gaithersburg Police Department arrested Edwards July 29 after investigation showed that he had followed a woman out of the Giant Food grocery store at 842 Muddy Branch Road on July 15 and sprayed human semen on her back from a small plastic bottle, police said.

He was freed on $4,000 bail until Montgomery County Police arrested him again Aug. 2 and charged him with spraying semen on another woman in November 2009 at the Michaels craft store in the Kentlands neighborhood of Gaithersburg.

He was charged with three additional assaults after police found video recordings on his cell phone of similar attacks on unknown women, but those charges were not prosecuted. Two of the attacks filmed on the cell phone occurred July 2 as women were leaving the Muddy Branch Giant, police said. Edwards sprayed one woman at about 8 a.m. and another at about 8:20 a.m., according to police charging documents. On July 8, he went back to the store and sprayed a woman as she left at about 3:15 p.m. Those victims did not come forward.

Defense attorney Barry Helfand said those attacks were not prosecuted because egg white and vinegar mix, not semen, was squirted during those incidents.

Prosecutor Amy Bills recommended 1 1/2 years imprisonment, but said she thought the judge's decision was fair. Judge Johnson cited to lack of previous criminal history and his feeling that incarceration would not give Edwards any more insight into his crimes than intensive supervised probation. The judge prohibited Edwards from going to the neighborhoods or the supermarket chains where the semen soakings occurred.

To the victim at the Michael's store, Edwards said, "I apologize to all for my actions. I've had a lot of time to think about this and reflect on this." After the sentencing, he said, "I'm ashamed. It's a shameful act. I'm very apologetic and it won't happen again."

"Monster" sentenced to 18 years, 8 months for attemped stabbing murder of wife

A man who stabbed his wife 63 times in front of their two children was sentenced to 18 2/3 years of imprisonment yesterday, February 28, 2011. 29 year old Brian Rolstad plead guilty to single counts of attempted murder causing great bodily injury, felony spousal abuse and two counts of felony child endangerment. The attack on his wife, Rachel, happened last spring at their Chula Vista, CA home. At sentencing yesterday, Rachel described as she drifted in and out of consciousness and saw fear on her sons' faces as their father attacked their mother.

The assault at the home in the 1300 block of Granite Springs Drive was reported shortly before 8 p.m. last June 14, according to Chula Vista police. A motive was not disclosed.

Officers arrived to find the assailant gone and the victim suffering from multiple stab wounds, most of them to her upper body. Rolstad was found about 7 the next morning, sitting in his car near Chula Vista Police Department headquarters.

"The torture was excruciating, horrifying and ruthless. I could feel each stab as it entered into and out of my body. He stabbed me over and over and all I could do is curl up in a fetal position to protect my heart while begging and hoping he would stop...You only care about yourself. Look how you washed yourself, changed your clothes and made sure you were nice and clean but left our kids crying, with blood smeared on their poor little faces, traumatized… while you left to go hide...When I see you, I see a monster."

To Superior Court Judge Esteban Hernandez, Rachel said that "Brian Rolstad is a cold-hearted, senseless human being… I see an angry man with no remorse… a vicious criminal who I believe will take revenge after his release. If he tried to kill me once, who's to say he won't try it again...He's not crazy but I'm afraid he will come back to get me when he’s released."

The perpetrator was ordered to get mental health treatment while incarcerated, something that may take place at one of California's state hospitals.

Milwaukee's North Side Strangler sentenced to life

Milwaukee's North Side Strangler was sentenced to seven consecutive life terms yesterday, February 24, 2011 in Milwaukee County Circuit Judge Dennis Cimpl's courtroom. Walter E. Ellis was sentenced for seven counts of 1st degree intentional homicide for the strangulation murders of seven women, must of them prostitutes. More about these crimes can be found here and here.

More than 30 friends and relatives of his many victims filled the gallery Thursday. Nine made formal statements to Cimpl, ranging from vengeful to forgiving.Tina Lewis, mother of Ouithreaun Stokes, Ellis' last known victim, asked, "What went wrong in his life that would make him kill these women?" She said she wished Wisconsin had the death penalty and hoped Ellis would wind up murdered in prison like infamous Milwaukee serial killer Jeffrey Dahmer.

Zola Farrior, sister of Sheila Farrior, who was killed in 1995, called Ellis "nothing but the devil. He didn't only kill my sister, he killed my mother - she died of heartbreak after that," Farrior said.

Dominika Walton's mother, Irene Smith, was stabbed and strangled in 1992. She tearfully said she was not happy with Ellis pleading no contest, that he was still trying to avoid responsibility. "He is a straight coward," she said.

Patricia Donald spoke about her friend Deborah Harris, Ellis' first known victim, who was killed Oct. 10, 1986, whom she called a generous, loving person who had moved to the city for a better life. She said she had forgiven Ellis because she will not let him prevent her from enjoying closure.

"We're going to all be all right," Donald said. "You don't win. You don't get to destroy lives anymore."

Ellis did not speak, and his attorney, Patrick Earle, said that he would not make any statements on his client's behalf.

BOSTON— A state senator arrested this week on charges of attempting to grope one woman and making lewd comments to a second was admitted to a psychiatric hospital yesterday. State Sen. James J. Marzilli entered the hospital hours after saying he would not seek re-election in the fall. The decision came a day after he was arraigned in Lowell District Court on multiple charges related to the arrest. Marzilli’s lawyer confirmed that he was seeking treatment.
“Senator Marzilli was admitted into a local hospital for treatment for an undisclosed illness this afternoon,” said Marzilli’s lawyer, Terrence Kennedy. A source close to Marzilli said on condition of anonymity that Marzilli was seeking treatment at McLean Hospital, a psychiatric hospital in Belmont.

Marzilli, 50, pleaded not guilty Wednesday to charges he tried to grab a woman sexually at a park in Lowell, then fled police, and to charges he made lewd remarks to another woman. Charges against him include disorderly conduct, resisting arrest, assault and battery and obstruction of justice. Marzilli is free on bail and due back in court July 3.

A spokesman for the Middlesex district attorney’s office said investigators were looking into other incidents possibly involving Marzilli, including one last year in Arlington and another in Boston’s Brighton neighborhood two years ago. Investigators also were looking into whether Marzilli was involved in other incidents in Lowell before his arrest.

Last month, Middlesex District Attorney Gerald T. Leone Jr. declined to charge Marzilli after a woman claimed he had touched her inappropriately in April, saying there was insufficient evidence.

Marzilli was arrested Tuesday after a woman told police he approached her while she was sitting on a park bench and tried to grab her crotch. A second woman called authorities after seeing media coverage of Marzilli’s arrest and said Marzilli made lewd comments to her. Kennedy said his client “totally denies” the charges.

(Update 2-23-11) Marzilli was sentenced to three months in jail and probation by Judge Paul Chernoff at Lowell Superior Court yesterday. Marzilli will serve his sentence at the Billerica House of Correction. For the first year of his probation, Marzilli will serve his first year under GPS monitoring and must do 200 hours of community service. A charge of attempted indecent assault and battery was stayed for a year, meaning that if the GPS monitoring goes without any hitches, Marzilli won't have to register as a sex offender.

In the city [of Lowell, MA]on June 3, 2008, for a function at Federal Fabrics-Fibers, Marzilli approached the women both on foot and in a car over the course of four hours, making lewd remarks about their bodies. They, in return, called him a pervert and told him to spend $20 on a hooker.

Middlesex District Attorney Elizabeth Dunigan said that some of the victims are afraid to go to Lowell, MA and that “At the time of his arrest, he was focused on himself, his career, his future. Maybe in time it can be a little bit about what these women lost on the streets of Lowell."

Houston man held without bond for sexually mutilating wife

A career criminal was charged with the torture of his 33 year old "wife" and held without bond. Gregory Longoria Jr, 39, was charged with aggravated assault of a family member for holding his estranged wife against her will and torturing her between noon Wednesday, February 16 and 7 AM February 17.

The 33 year old victim left Longoria and moved back to her parents' house along with her four children to escape the abusive relationship and allegations of cheating. Wednesday, Longoria went to the victim's parnets' house and threatened her with violence if she did not bring the one year old girl she had with him. She left with him and went back to Longoria's apartment.

The victim told investigators Longoria threatened to kill her elderly, disabled parents if she didn’t comply with his demands.The victim said once they arrived at Longoria’s apartment, he told her to undress and took sexually explicit and obscene photos of her.

When he was finished with the camera, the victim told investigators Longoria tied her to the bed and beat her. She said he then used a can of hairspray and a lighter to burn her nipples and vagina. After he burned her, the victim said he ripped one of her nipples off her body.

The victim said Longoria also choked her with a belt and smothered her with a pillow, causing her to lose consciousness. Longoria kept her there from noon Wednesday until 7 a.m. Thursday, deputies said. He then dropped her and the baby off at her parents’ house.

Longoria let her go after she convinced him that she had to go to a job interview that Thursday and that they needed the money. Longoria told her to take a shower and dropped her off at her parents house. Longoria took his daughter and drove around Houston until he was stopped Thursday evening. The victim was driven to Kingwood Medical Center.

Investigators observed burns to the woman's body consistent with her description of what happened. A doctor at Kingwood Medical Center told investigators that the woman will require reconstructive surgery and will suffer permanent disfigurement as a result of the attack, court records show.

During a press conference, Longoria was likened to a mad dog by Harris County Sheriff Adrian Garcia. "There are rabid dogs in our society — animals. These dogs that think they can get away with dehumanizing any person, but in particular women, will be dealt with. We are proving today that we will hunt those dogs down and put them in their kennels and try to show them the same dignity that they failed to show for a fellow human being...God help me if such an animal were ever to introduce himself to my family."

While the baby was physically unharmed, Lt. Ruben Diaz of the Houston sex crimes unit said "He had the baby asleep on the couch in the next room, probably listening to her own mother's screams for help." After Longoria's arrest Thursday afternoon, Diaz said "He didn’t even care that we picked him up. When we picked him up, he had a curt attitude. He had a smirk on his face like he didn’t care." The reason the situation lasted so long was because "She was protecting her family more so even than herself - she was tolerating the abuse."

The victim's mother told reporters "At times, I saw her she would just look teary-eyed. I would advise couples not to be quiet but be up front because that’s how a lot of women die."

The emergency protective order prohibits all contact with his victim, including indirect contact or showing up at her workplace. The same no contact conditions were imposed regarding the victim's four children and her parents. Prosecutor Donna Hawkins with the Harris County District Attorney's Office said the order "precludes the defendant from having any contact with the complainant in this case, not going by her residence and not attending her work place either."

Longoria is charged with a first degree felony "because of three elements: he assaulted a member of his family causing serious bodily injury and utilizing a deadly weapon, which in this case is fire," according to Hawkins.

According to a family member, the victim, who was released from Kingwood Medical Center Monday, is actually comforting her family members. "We have all been crying, when we come up to her, she just looks at us and says, ‘why are you crying? I am fine, I am strong, if I’m not crying you should not be crying...She is very hopeful about the future. She trusts a lot in God...She's not going to let this person take her down - she's way stronger than that."

Longoria has a history of arrests in Harris County dating back to 1989, including convictions for shooting two men, court files show.

In 2005, Longoria was charged with misdemeanor assault of a family member after he was accused of choking another woman identified as his wife with his hands, court records show. A court issued an emergency protection order, and Longoria pleaded guilty and was sentenced to 160 days in jail.

In 1992, he pleaded guilty to an attempted murder, two charges of aggravated assault and felony theft. He was sentenced to 10 years in prison on the aggravated assault and theft convictions and granted 10 years probation and deferred adjudication for the attempted murder conviction, court records show.

In September 1991, when Longoria was 20 years old, Bellaire police arrested him for shooting a 21-year-old man four times. Longoria was a passenger in a moving vehicle when he fired the shots, court records show. That man survived, and the incident led to Longoria's conviction for attempted murder.

A month later, Longoria was arrested again, this time for shooting a 20-year-old community college student. That victim also survived.

Longoria has not been formally arraigned yet because arraignment requires a public defender. Numerous public defenders have refused to take him on as a client due to the nature of the charges and allegetions against him. A lawyer is scheduled to be appointed later today.

Quebec man sentenced to 25 to life for luring woman he met online to death

A Quebec City man has been found guilty of first-degree murder in the slaying of a woman he met over the Internet and whose body has never been found. An emotionless Alain Perreault, 48, was sentenced Friday [February 11, 2011]morning to life in prison without possibility for parole for 25 years for the death of Lyne Massicotte.

A jury came back with the guilty verdict after three days of deliberation. Perreault met Massicotte in a chat room on the Internet and arranged a date in Quebec City in July 2003. Massicotte, a single mother, travelled there from her home in Chambly, Que., and vanished after the encounter.

Despite numerous searches, Massicotte's body was never found. The jury heard that Perreault admitted on video during a police sting operation he had killed Massicotte.The operation involved a fictitious criminal organization with an undercover officer posing as a crime boss.

During his trial, Perreault denied any involvement in Massicotte's slaying.

Former British soldier sentenced to 16 to life for bombing of wife's car

A former British soldier was sentenced to life imprisonment without parole for at least 16 years at Maidstone crown court Friday, February 18. 33 year old Nicholas Fabian of Vigo, Kent, England was convicted for planting a hand grenade underneath his wife Victoria's car. The hand grenade was stolen from training exercises and was rigged to go off when the victim reversed out of her driveway on March 5, 2010.

The victim suffered burns and shrapnel injuries, and was six months pregnant with her attacker's son, named Freddie. During the attack, Fabian, driving in another car with his four year old son Harry ripped off his shirt to use as a tourniquet. Police suspected Fabian from the beginning, but charges were not filed until they found the green and yellow paint that was found on the grenade and the fishing line used to booby trap the car. Fabian's official charges were attempted murder and causing an explosion with intent to endanger life.

Andrew Patience, QC castigated Fabian before formally pronouncing sentence. "What you did in causing that explosion, with the consequences which flowed from it on March 5 last year, was wicked beyond belief. You conceived a plan to rid yourself of your wife which demonstrated low cunning in its planning and preparation, and utter heartlessness and chilling ruthlessness in its execution...You are an evil man who was prepared to destroy at least one human life in order to achieve your own selfish ends. Not only are you evil but you present a danger to the general public."

Patience said that "your wife was not to know, even when you were sat together on March 4, that the plans for your life together meant nothing to you and you were practising upon her the cruelest of deceptions."

The motive behind the attack was for Fabian to rid himself of his wife and make a life with his mistress Jackie Phillips. The 33 year old Phillips told authorities Fabian promised to leave his wife for her, but Fabian himself said that he felt "lust, infatuation and obsession," but not love for Phillips. Phillips was not the only person who Fabian has had dalliances with.

Since his conviction [Thursday, February 17], it has since been revealed that as well as cheating on his wife, attempted killer Fabian had previously worked as a £50-a-time male prostitute and even starred in a gay porn movie while still a soldier in Aldershot.

Known as ‘Squaddie Nick’, he catered to the sexual needs of older men with an Army uniform fetish. One man, who had a relationship with Fabian after meeting him on a train, said: 'He came on to me strongly and we had sex in the train toilet. 'I dropped him off at his married Army quarters afterwards in my car but that night he was knocking on my door again. He was having affairs with a string of women and wanted gay sex too,' he told The Sun.

At the time [in 2004]he was living with a former partner, Louise Sands, the mother of two of his children. When asked after the trial whether she was aware of her ex’s secret double life, Miss Sands, 30, said: ‘What? Nick? Gay? My head is fried.’

He had spent ten years in The Princess of Wales Royal Regiment and during his time with them he was investigated for ‘misconduct issues’ which saw him demoted from lance corporal to private. He was also alleged to have stolen from his fellow soldiers.

After leaving the Army in 2004 he had found it difficult to adjust to civilian life and claimed he was happy when he was called up to serve as he missed ‘the thrill of being a soldier’, the court heard.

On the day of the attack in March last year Mrs Fabian had planned to take Charlie and Harry, her four-year-old son with Fabian, to get a haircut.

Afterwards all four were due to have a family meal at a Harvester restaurant.

Alastair Dickson from the Kent Crown Prosecution Service, said the affair with Phillips was not the only motive behing the attack on his wife. "Clearly not everyone who has affairs goes on to attempt to kill his wife in such a way...It has something to do with the fact that he was a fantasist and an attention-seeker but I don’t think anyone will ever know the true motive in addition to the Jackie Phillips motive behind this offence."

Dickson praised the victim for facing her attacker in open court instead of from behind a screen. "Victoria Fabian, throughout this terrible ordeal, has shown an enormous degree of bravery and strength. That's reflected in the way she gave her evidence to the court. She was brave enough to make the decision that she didn't want to give evidence from behind a screen, which was available to her. What she wanted to do was face Nicholas Fabian in court and for him to see exactly what he had done to her, and that shows remarkable bravery."

Predatory massage therapist sentenced to 11 years in prison

A Minneapolis massage therapist was ordered to serve 11 years imprisonment and be registered as a predatory sex offender on Valentines Day 2011. Lawrence Martin Valencour, 62, was convicted back in November of four counts of 4th degree criminal sexual conduct at a week long trial presided over by District Judge Thomas Poch. The assaults happened at Apple Valley, MN's A Touch Of Tranquility massage parlor, which has shut down.

In 2008, three women reported to Apple Valley police that Valencour had touched their breasts and genitals and put his genitals in their hands during massages, according to a criminal complaint. Police located three more victims through the business's owner.

The owner, who hired Valencour, base the hiring on the recommendation of a massage school she trusted. The misplaced trust cost her her business and those women their dignity.

Dakota County Attorney James Backstrom, the prosecutor, said, "We're pleased with the lengthy prison term that was handed down today in this case. These types of crimes are extremely traumatic to the victims, whose privacy is directly invaded in a very disturbing way." Backstrom said the 11 years for the 4th degree CSC counts were the maximum prison sentence that could be handed down.

Man convicted of bathtub drowning murder of wife

LEBANON (OH): A man found guilty of murder in his third trial over his wife's bathtub drowning buried his face in his hands as he heard the verdict Tuesday and continued to maintain his innocence, telling the judge he loved his wife and ''would never have hurt her.''

A Warren County jury deliberated about 12 hours over two days before convicting Ryan Widmer, who was in tears as the verdict was read. Judge Neal Bronson sentenced him to 15 years to life in prison. ''Judge, I did not do this,'' Widmer said, breathing heavily. ''I don't know why this has to keep going on. I mean, my life has been ruined.''

It was the second time Widmer was found guilty. The verdict from his first trial was thrown out over juror misconduct, and his second trial ended in a hung jury. Defense attorneys didn't comment on appeal plans or return an after-hours call seeking comment.

The couple had been married for about six months when she died. Ryan Widmer told a 911 dispatcher that his wife had fallen asleep in the bathtub.

Prosecutors in this trial for the first time had asked jurors to consider the lesser charge of involuntary manslaughter. The judge had instructed jurors that a murder conviction meant they believed Widmer purposely killed his 24-year-old wife, Sarah, in 2008. Involuntary manslaughter would mean they agreed that he assaulted his wife and caused her death but didn't mean to kill her.

Prosecutors had argued that bruises on his wife's neck supported their contention that Widmer killed his wife at their Hamilton Township home by grabbing her and forcing her head underwater.

The defense attributed the bruising to rescue workers' efforts to revive her and said she may have suffered a medical problem before drowning. Defense attorney Jay Clark said investigators made mistakes, took shortcuts and made assumptions, and he suggested that the death of an elderly woman in a bathtub under similar circumstances wouldn't have resulted in charges.

The trial featured a new prosecution witness, who testified that Ryan Widmer confessed to her in a phone call. Jennifer Crew, 36, of Cedar Rapids, Iowa, testified that Widmer told her on Oct. 26, 2009, that he killed his wife after she said she was going to leave him. Crew said Widmer was crying and so upset he could barely talk.

Crew said she had never met Widmer in person but sent him e-mail and text messages because she thought he was innocent after she saw a Dateline NBC episode about the case that aired after Widmer's first trial.

Man gets 25-50 years for shooting "girlfriend" to death

A “boyfriend” who shot a 6 months pregnant woman to death has pled guilty to second degree murder Monday, February 7, and is scheduled to serve 25-50 years in prison.

Rollon Michael Marko, a 27 year old Portage, MI man, was sentenced by Kalamazoo County Circuit Judge Alexander C. Lipsey to the term for 2nd degree murder and assault on a pregnant individual causing miscarriage or stillbirth. These charges were in place of a 1st degree murder charge, which carries an automatic life without parole sentence.

Marko, who had been drinking alcohol and smoking marijuana on May 22, shot Courtney Delano, 19, in his apartment. She and the fetus died of the single gunshot wound to her chest and shoulder.

Marko, who’s trial was to start Tuesday on charges of open murder and assault as well as the firearms charges, faced up to life in prison without the possibility of parole if convicted.

Troy Delano, father of the victim, 19 year old Courtney Delano told his daughter’s murderer, “You’re going to be raped in prison everyday. I hope you enjoy it. Eff you.”

Chandra Levy's murderer convicted, sentenced to 60 years - victim's mom says no closure

Washington (CNN) -- After more than three days of deliberations, jurors on Monday convicted Ingmar Guandique of two counts of first-degree murder in the 2001 death of Washington intern Chandra Levy.

As the verdict was read, Levy's mother, Susan, stared intently at Guandique. Several jurors wiped their eyes afterward.

Levy, a 24-year-old California native, was in Washington working as an intern for the Bureau of Prisons when she was last seen on May 1, 2001. Her skull was found over a year later, on May 22, 2002, in Washington's Rock Creek Park. But police didn't arrest Guandique until February 2009. He was then serving a 10-year sentence for attacking two other women in the park and had reportedly spoken about killing Levy.

"It's been nearly 10 years since the promise of a young life was lost in Rock Creek Park," Ronald Machen, the U.S. attorney for the District of Columbia, told reporters Monday afternoon. "Today's verdict does send a message for a murderer to be held accountable. It's never too late for justice to be served."

Following an 11-day trial, jurors deliberated for three days and then for another two hours Monday. They notified Superior Court Judge Gerald Fisher about 11:45 a.m. that they had reached a verdict, entering the courtroom at 12:35 p.m. ET.

Speaking after their dismissal, jurors told reporters they took the time to examine each piece of evidence and consider it. "We were very careful to evaluate all the evidence, and it was a decision based on everything we had," said juror Susan Kelly, a journalist.

Guandique, 29, will face a maximum sentence of life in prison without parole when he is sentenced February 11. The jury convicted him of one count of murder with kidnapping and a second count of murder with attempted robbery.

After the verdict, Susan Levy asked reporters, "What difference does it make," and then answered her own question."You, the prosecutors, defense, the jury, the police, the public and individual citizens, as well as the media, both the written media and the visual media, we all make a difference," she said. "... It makes a difference to find the right person who is responsible for my daughter's death or for anybody else's death."

Regardless of the sentence Guandique is given, "I have a lifetime sentence of a lost limb missing from our family tree," she said. "It's painful. I live with it every day. ... There's always going to be a feeling of sadness."

Emily Grinstead told reporters that she and fellow jurors were mindful not to rush a decision. While confident they reached the right verdict, she said that "doesn't mean that I don't wish we didn't have to be here today."

"You're dealing with somebody's life," Grinstead said. "Two people's lives. I don't take that lightly."

Asked what she would say to Susan Levy, juror Linda Norton said, "I think she has to take from this what she will. We cannot bring back her daughter. ... We did the best we could with the evidence we were given."

Prosecutors argued that Guandique, a reputed member of the Salvadoran gang Mara Salvatrucha, attacked Levy while she was jogging in Washington's Rock Creek Park. After her skull was found, a search turned up other remains of Levy's, as well as clothing later identified as hers strewn down the side of a ravine. Her running shoes were unlaced, and her clothes were turned inside out. Her pants were knotted in tight restraints around her legs.

Prosecutor Amanda Haines, during her closing argument, cited what she portrayed as confessions that Guandique allegedly made to a cellmate as he served time for other attacks, as well as remarks he allegedly made to a female pen pal.

Defense attorney Santha Sonenberg emphasized the largely circumstantial nature of the case, including what prosecutors have acknowledged was a lack of DNA evidence, a lack of witnesses and only secondhand accounts of Guandique's alleged confessions.

Both the women who Guandique also attacked in the park -- including one on the same day Levy went missing -- spoke at the trial, testimony that Kelly called "powerful." He had pleaded guilty for his role in those attacks, and was set to be released in September 2010.

The disappearance of Levy drew national attention after her parents discovered a connection with Gary Condit, who was then a sitting congressman from California. Condit was never a suspect in the case, but he was questioned intensively for details about Levy's whereabouts.

He testified in the trial earlier this month, but refused to address a question about whether he had sex with Levy. An FBI forensic expert later confirmed Condit's semen had been found in underwear retrieved from Levy's apartment in the days after her parents reported her missing. "We've lost our feeling for common decency. I didn't commit any crime. I didn't do anything wrong," he said.

Condit said several times during his testimony that the media frenzy surrounding Levy's disappearance was hard to handle, including a helicopter flight over his California home while his daughter and her friends were sunbathing at the family's pool. "They reported that I had young women in bikinis at my house," he said.

Juror Grinstead pointed out that it wasn't just police that were sidetracked and focused for weeks on the wrong person. Asked who also was on the wrong track, she told reporters, "You all."

Metropolitan Police Department Chief Cathy Lanier defended authorities' handling of the case Monday afternoon, saying it sometimes takes time to find evidence and suspects. The U.S. attorney's office in the District of Columbia recently opened a "cold case" unit, which Machen credited for leading to four convictions in the past year for murders that dated back as far as 20 years.

"It's not like it is on TV. Cases can be very complicated," said Lanier, who became chief in 2007. "You never give up, regardless of criticism, regardless of mistakes. And I think that's what happened in this case."

(Update 2-15-11) On Friday February 11, Guandique was sentenced to 60 years imprisonment for the Levy slaying. Judge Gerald I. Fisher presided over the trial and its conclusion. Prosecutors asked for life without parole - the defense asked for 60 years. Guandique will serve 85% or 51 years before becoming eligible for early release.

Judge Fisaher called the Levy slaying "a truly horrible crime" and Guandique a "dangerous person...Dangerous to women, in particular. And will be a danger for some time. He's a sexual predator. Nobody else should be at the mercy of Mr. Guandique like Ms. Levy."

Fisher acknowledged that the prosecution's case "wasn't a very strong" one - and was based on circumstantial evidence. Fisher said the strongest evidence linking Guandique to Levy's death included Guandique's previous attacks on two female joggers, testimony from witnesses who placed Guandique in the park at the time Levy disappeared and the testimony of Guandique's cellmate, Armando Morales, who said Guandique admitted to him that he killed Levy in the park.

Before sentencing, the victim's mother, Susan Levy, spoke to Guandique directly. "Because of you, young man, you have caused us to live a Holocaust again...You have sentenced our entire family to days of sadness, tears and heartache. You are a hideous creature."

"How could you take my daughter's life? Did you really take her life? Look me in my eyes and tell me."

Before Fisher issued his decision, Guandique stood up, paused, wiped his eyes and addressed the Levy family. It was the first time he had spoken at length in court since being charged in 2009.

"I am sorry for what happened to your daughter," he said through an interpreter. "But I had nothing to do with it. I am innocent."

This view was the continuation of a view Guandique has held since a January 22 letter to the Washington Post. It goes, "Everything about this case was a stupid, comedic farce that the detectives and prosecutors have engaged in," Guandique wrote. "I know there are people who believe in my innocence and to those people who believe in my innocence I say you are not mistaken, because I am innocent."

On a Valentine's Day 2011 interview with anchor Chris Wragge of the CBS Early Morning Show, Susan Levy said that "I always have that 5 percent not being sure. Ninety-five percent I like to believe that the Justice Department is accurate. But there is that 5 percent...But they proved in court. It's circumstantial. Not substantial, but circumstantial evidence that he was involved."

Wragge later asked, "I know there's no sense of closure but is there any sense of peace that you can think of?" "There's no closure, that's for buildings," Susan Levy said. "You have a daughter that's tragically dead, there's never a sense of peace."

Long term substitute teacher charged with misconduct with three boys

A British literature teacher who allegedly had sexual relationships with three Bay City Central High School students is free on $100,000 bond. 41 year old Heidi Lewis was charged with 6 counts of 3rd degree criminal sexual conduct, punishable by up to 15 years imprisonment.

While the AOC in Michigan is normally 16, Michigan state law raises the AOC to 18 when dealing with teacher student sex under normal circumstances The same law raises it to 26 when dealing with Michigan special needs students. Lewis was arrested after the "girlfriend" of one of the alleged victims told Assistant Principal Joseph Buggs that her beau had had sex with the teacher. The teacher was a long term substitute, who taught between January and June 2010. This led to an interview with Buggs and a Bay City police officer.

The students, both 17, told Buggs and the officer they had been in Lewis’ class and that during the school year, their relationship had been of a typical teacher-student nature.

Near the end of the school year, Lewis and one of the students exchanged cell phone numbers, one of the teens said. A short while after school let out for the year, Lewis came over to the teen’s house and they had sex, the teen told investigators.

The second teen told investigators the first teen later told him of his relationship with Lewis while they were hanging out together. When the second teen said he did not believe his friend, the first teen called Lewis over to his house. Both teens then simultaneously had sex with Lewis, they said, according to court records.

Over time, the two teens told a third classmate about having sex with Lewis. Investigators interviewed the third teen, who claimed to have had sex with Lewis in the back of her silver Jeep Cherokee. This teen told his girlfriend what happened and she ended up passing the information to school authorities.

Lewis was arrested later that day. She was arraigned February 9, 2011 in Bay County District Judge Dawn A. Klida's courtroom. Bay County Assistant Prosecutor Jordan E. Case asked that an additional stipulation prohibiting her from contact with minors be added to her release conditions. Defense attorney Richard Lee Jr objected, but Judge Klida granted the prosecution request.

Lawrence, MA police officer sent away for 10-12 years for raping mother of two on duty

A former Lawrence, MA police officer was sentenced to 10-12 years imprisonment for raping a young mother of two who was drunkenly celebrating her 24th birthday. Sentencing took place on February 3, 2011 in Newburyport District Court by Judge Richard Welch.

Kevin Sledge Sr, 48, of Salem, NH, was also ordered to stay away from the victim, her family and her friend Regina Perry, undergo sex offender treatment, register as a sex offender, and serve 5 years of probation after leaving prison. Judge Welch said that while Sledge's family said that he was a supportive father and nephew, he was "a man who committed rape and indecent assault and battery," taking advantage of a woman who "was drunk as can be." The official charges a jury convicted Sledge of were three counts of indecent assault and battery and a single rape count.

He said he was trying to help the victim, who told him she was stranded and abandoned in downtown Lawrence that night. He said she asked him for a ride home to Nashua, N.H. He told her he could drive her to the police station.

When she refused to go into the police station lobby and wait for Perry there, Sledge said he allowed the woman to wait in his car parked out back. The victim says after she was picked up by Sledge, he drove her to the police station where he was on duty. She said he returned to his car several times to rape and assault her.

Sledge, a police officer for 17 years, raped and repeatedly assaulted the woman in his personal car, a silver Jaguar he parked behind the police station on Sept. 26, 2008. Sledge was assigned to the booking room and repeatedly left his post to go to his car to rape and fondle the woman. When arrested, he was immediately suspended from the department and stripped of his paycheck once indicted.

The trial was Sledge's second trial - the first trial ended in a mistrial. Prosecutor Kate MacDougall asked for a 12-15 years sentencing, citing the "sacred trust" Sledge violated and that he used his police officer status to facilitate "disgraceful and shameful behavior." MacDougall read a victim impact statement from the victim. The statement said that the attack affected her parenting ability. Her son missed school because she was too scared to walk his to school. She eventually sucummbed to depression, and was evicted from her apartment and ended up with her children in homeless shelters.

"Every time, I (saw) a silver car, I put my head down and my heart would pound hoping it wasn't him," "Never would I have thought trusting a police officer was gonna end in a disaster," she said. "I thought I had no chance going up against a cop, but I did it anyways."

Defense attorney John Morris asked Welch to impose a 3- to 5-year prison sentence, pointing to the many letters of support Sledge's extended family had written on his behalf to Welch. Morris read a letter in court from Kevin Sledge Jr., Sledge's 21-year-old son, who is a sophomore in college. Sledge Jr. described his father as his best friend and a person who loves him unconditionally. He also said he was disappointed by his dad's choices. "I cannot imagine what my life would be like without him. He taught me to be a hard worker ... to never quit," Sledge Jr. wrote. "I am proud to call him my dad."

Morris also said Sledge suffers from congestive heart failure, a condition he was diagnosed with in August. In addition to heart valve and blood flow problems, Sledge also has a herniated disk in his back and nerve damage that resulted from a cruiser accident he was involved in as a police officer, Morris said.

Judge Welsh told the victim, "You displayed remarkable courage when you testified...Hopefully you can build on that." Shawn Sledge, 40, the perpetrator's nephew, said "[The sentence is] somewhat harsh ... I do understand the judge's comments that he was a police officer and a protector of the law. I understand the decision he made, even though I don't think it's the right one."

Father of four sent away for life for raping woman he met on sugar daddy website

A man who lured a 22 year old woman he met on a sugar daddy website into rape was sentenced to life without parole by Orange Circuit Judge Walter Komanski Wednesday, February 9. Father of four Marcelo Augusto Alves misrepresented himself as Mark Garcia, even using a fake picture, and communicated with the 22 year old Tampa victim before arranging a meeting with her in the Dr. Phillips area of Orlando outside of a multimillion dollar home March 2009.

"He was wearing a mask and had a knife in his hand and tackled her to the ground and he raped her," said Assistant State Attorney Kelly Hicks. The mask was pantyhose over his face. Alves put a knife to the victim's throat and tackled her to the ground before raping her. Alves was charged with, then convicted for four counts of sexual battery. His attorney argued that only one act of rape occured, but Alves was convicted on all four counts.

In the victim impact statement, read by Hicks, she said, "I trusted him as Mark and didn't think something like this could have happened...Marcelo royally screwed me up...Now I understand the term, 'sexual predator.'" "He is a monster who deserves to go away for the rest of his life," Hicks said.

Man who bludegoned, dismembered mistress sentenced to 25 years

A Delaware man who murdered his mistress and dumped her body in the Atlantic Ocean because he could not afford to take care of two families was sentenced to 25 years in prison with 85% to serve for aggravated manslaughter. Rosario DiGirolamo, now 36, was sentenced in a Trenton, NJ courtroom yesterday for beating Amy Giordano, his 27 year old mistress, with a hammer, cutting her body into pieces, and burying Amy's body in a pond. The killing took place June 7, 2007. DiGirolamo plead guilty to aggravated manslaughter on January 3, 2011, when his $1 million bail, which his parents put up, was revoked.

DiGirolamo was seeing Amy when she lived in Hightstown, N.J, and he and his wife, Maria DiMaggio, lived in Millstone Township. DiGirolamo was putting Amy up in a $850 per month apartment apartment.

DiGirolamo claimed that his mistress lunged at him with a hammer after an argument over money and Giordano was threatening to expose their affair, but Superior Court Judge Edward Neafsey pointed out that DiGirolamo searched "lethal karate blows to the back of the head...He studied how to do this and learned his lesson well,” Neafsey said. “What the vicious nature of the crime showed was his anger for the victim and his decision to eradicate her, totally eliminate her, from his life.”

The case did not just make New Jersey headlines, but Delaware's headlines, since two days after the killing, DiGirolamo and Amy's baby Michael DiGirolamo, then 11 months, off at a hospital in Delaware with a note stating "Please help my baby John Vincent I can no longer take care of him. Lost job, lost medical. God have mercy on me."

DiGirolamo was charged with murder in March 2008 after his former best friend became a government witness. John A. Russo Jr. told prosecutors that DiGirolamo had told him of plans to kill the 27-year-old Giordano because he couldn't afford two families. On June 4 or 5, 2007, Russo told prosecutors, DiGirolamo bought a reciprocating saw, garbage bags and drain cleaner at a Lowe's store that Russo managed, and on June 8 confided that he had killed Giordano.

Three days after DiGirolamo's arrest in March 2008, Russo took authorities to a pond near his Staten Island, N.Y., home where had led DiGirolamo on June 9, 2007. That day DiGirolamo threw a suitcase containing Giordano's body parts into the water, and drove to Delaware to get rid of their son.

Russo, who pleaded guilty to misdemeanor evidence tampering, was sentenced in December under New Jersey's pretrial intervention program for first-time offenders to three years of supervision and 50 hours of community service.

Though prosecutors let DiGirolamo plead guilty to a lesser charge -- a murder conviction could have brought him 30 years to life in prison -- Assistant Prosecutor Al Garcia said after the sentencing that they never believed the victim provoked DiGirolamo. Garcia said the deal was cut because key witnesses had not always been honest with investigators, which could have undermined their credibility before a jury.

Garcia said about the victim,“She was with the man she loved. She was with her son. On that day Amy thought she was going to start a new life. She thought she was going to get a new job and a new apartment. But the defendant destroyed those dreams.”

Just before sentencing, Judge Neafsey berated the defendant, saying about the dismemberment, "Even in death you did not give dignity to Amy Giordano...The time to show remorse and regret was after you killed her, not on your judgment day.”

Garcia said afterwards, "Justice was served, because he came into court and pled guilty. Usually they don't come in and plead guilty for 25 years.''

Marsha Kaller-Apter sent a latter to the court describing how the killing of her sister affected her life. Part of the letter stated "There is a spot in my life that can't be filled...That was Amy's spot...I don't know what you were thinking and to tell you the truth I don't really care. You killed my sister and left my nephew for dead. HOW CAN YOU DO THAT!!!??? ... How can you even think of hurting someone so small and sweet.''

Jerome Ballarotto stated that before the internet search evidence, his client intended to go to trial, but now he'll appeal. "But considering that the judge was going to allow the jury to see that evidence, my client made a decision not to take the risk of a jury finding him guilty of planning to kill her.”

[Assistant Prosecutor Thomas]Meidt said the sentence marks the closure of one of the longest investigations in the Mercer County Prosecutor’s Office.

“It’s very satisfying,” Meidt said. “Sometimes you work a case for a long time and never solve it. This is a case where all the hard work paid off and we got a good disposition on it.”

Michael Girolamo was adopted by a relative on his father's side in 2008.

Man who shot to death mother of his kids sentenced to at least 75 years

A man who shot and killed his baby's momma in from of her kids in a Montclair, NJ YMCA was sentenced to 75 years to life in a New Jersey Superior courtroom on February 1, 2011. Judge Joseph Cassini III sentenced 39 year old Kenneth Duckett of Orange, NJ to the term saying that innocent people are killed every day, and citing Duckett's numerous felony arrests (22 priors) and convictions (six priors) in New Jersey and North Carolina. The 917 days Duckett spent in custody was credited towards his sentence.

Duckett was on trial for a month and found guilty - just two days before Christmas - for the slaying of Monica Paul, 31, of Montclair. Duckett gunned down Paul, the mother of his two children, on June 26, 2008 inside the YMCA Family Center on Glenridge Avenue. Their 10-year-old daughter, Essence, was near and their 4-year-old son, Noah, was swimming in the facility's indoor pool. Paul was in an observation room watching the lesson.

A quarrel ensued between Paul and Duckett, leading to the shooting.

About 15 family members and friends were in the courtroom today to hear the sentence. As Duckett was led out of the courtroom by Essex County Sheriff's officers, he made a hand gesture and nodded to a handful of his friends also in the room.

Duckett, wearing a green prison jumpsuit and a yellow and orange knit hat, apologized to his son Noah, Paul's father, Lionel Paul, and her cousin, Greg Paul.

Before sentencing, Essex County Assistant Prosecutor Rachel Gran said "The crime is not a peaceful act, or hope for a peaceful world." The prosecutor went on to say that when Paul was killed in front of her daughter, he brought an "enormous" gun and held the entire Y hostage. After sentencing, Gran said "We believe the sentence imposed by Judge Cassini was absolutely appropriate given the horrific nature of the crime. Mr. Duckett brutally murdered Ms. Paul in a crowded YMCA while innocent children and their parents gathered for learning and recreation.''

"While we know the sentence will never bring back Ms. Paul, who left behind two lovely children, we hope the family will be comforted in some small measure by the fact that the justice system worked well in this case,'' said Assistant Prosecutor Gina Iosim.

Suburban St. Louis police officer sentenced to 25 years for forcing women into sex acts

A former Uplands Park, MO police officer was sentenced to 25 years in federal prison for raping and robbing prostitutes. One attack occurred at his own police station. 32 year old Leon Pullen of Foley, MO was sentenced in a St. Louis federal court Friday, January 28 to the 300 month sentence after pleading guilty to nine federal felonies.

These felonies included conspiracy, deprivation of civil rights, witness tampering, and lying to the FBI. Federal prosecutors dropped ten other charges after Pullen pled guilty July 28, 2010. Pullen faced a sentence of 18 1/2 to 25 years of federal confinement.

Pullen's MO was to respond to online escort ads, then after the women responded, he would identify himself as a police officer, pull out his gun, then force the victims to perform sex acts on him. Two of the victims were forced into sex at gunpoint. Pullen was arrested by the FBI on Saturday, September 19, 2009.

The affidavit goes on to say that Pullen called the woman, said his name was "Jimmy," and agreed to pay $400 for a sexual act and that he had her and another woman meet him in Uplands Park on July 15, 2009.

At the meeting, the affidavit said, Pullen rubbed himself against one woman and told her that she had two choices: to give him all her money or get naked, LaCombe wrote. Another officer was present, [FBI special agent Greg]LaCombe wrote, but that officer is not named in the complaint.

Pullen then ordered her and the other woman back in their car and told them to follow him to the police station, where he took the victim to an office in the rear of the station, forced her to undress and then forcibly performed oral sex on her.

The woman, afraid that Pullen would call in the other officer to have sex with her, tried to end the attack by offering to meet Pullen later, LaCombe wrote. Pullen gave her his contact information, and then she left, later calling the FBI.

The victim of that encounter, identified as D.S., gave a victim impact statement and said the sexual assault left her with PTSD and a back injury. "I've always considered myself a very strong woman until that day," she said. The attack had also affected her ability to parent her four children.

Judge Rodney Sippel gave Pullen the 25 year sentence, stating "[People] trust law enforcement to make sure they're safe," Sippel said. "For law enforcement to turn on them and take from them that sense of safety . . . it's hard to comprehend." Pullen was also ordered to pay thousands of dollars in restitution, with the exact amount being disputed.

The second officer in the federal complaint, Justin Biancardi, plead guilty in St. Louis federal court Monday, January 10, 2011 to shaking down over a dozen prostitutes for money. Biancardi, who cooperated with the feds, faces a maximum sentence of 10 years imprisonment and a $250,000 fine when he is sentenced April 13.

Lake Forest, CA man convicted of raping 5 women faces life imprisonment

A Lake Forest, CA man was convicted of raping 5 Orange County women and sexually assaulting a sixth on Wednesday February 2, according to the Orange County District Attorney's office. 32 year old Sekayi Rudo White was found guilty of 14 counts of rape, sexual assault, making criminal threats, and burglary. White faces a maximum sentence of 119 years to life when he is sentenced April 15, 2011.

[White's] 14 felony counts includ[ed] attempted rape and forcible rape for Jane Doe No. 1; assault with the intent to commit rape, sexual battery by restraint and criminal threats for Jane Doe No. 2; forcible rape and dissuading a witness by force for Jane Doe No. 3; first-degree residential burglary of an inhabited dwelling and two counts of forcible rape for Jane Doe No. 4; forcible rape, criminal threats and first-degree residential burglary of an inhabited dwelling for Jane Doe No. 5; and forcible rape for Jane Doe No. 6.

He has also been slapped with sentencing enhancements and allegations for sexual crimes against multiple victims, rape with the use of a deadly weapon, rape in the commission of a burglary, non-accomplice present during a residential burglary, personal use of a deadly weapon, use of a deadly weapon during a sexual offense, being armed with a deadly weapon during a sexual offense, and crime-bail-crime (which means he allegedly committed a crime while out of custody on bail for another criminal case).

The attacks started in late summer 2002, when White raped a 22 year old passed out woman (Jane Doe 6)at a Santa Ana hotel. The woman woke up while White was raping her, and could not remember drinking alcohol or entering the hotel room. After the attack, Afterwards, White harassed her at home and work.

In December 2005, White met a 44 year old woman (Jane Doe 1) at an Irvine, CA bar and drove the woman to her home in Newport Beach. He used the ruse of asking to use the bathroom to emerge naked with an erect peniswhile he tried to remove her pants as he was pinning her down. White threatened to kill her if she told about the attack.That victim successfully fought him off. In August 2006, he picked up a 22 year old woman (Jane Doe 2) at a Huntington Beach bar, bringing her back to his home where he raped her.

White was indicted for the three assaults on September 2006. Even though he was held on $250,000 bail, he made bond, and raped three more women between January and April 2007, when he was arrested again and held without bond.

Jane Doe No. 3

On March 31, 2007, White is accused of going to a bar in Lake Forest, where 28-year-old Jane Doe No. 3 was celebrating her birthday. The victim had met the defendant a few months prior. At approximately 2:30 a.m. on April 1, 2007, Jane Doe No. 3 was dropped off at home by a friend. White is accused of showing up at the victim's home and knocking on her door. The victim, who was intoxicated due to alcohol consumption, opened the door, and White is accused of entering. Jane Doe No. 3 passed out in her bed. When the victim woke up, White is accused of forcibly raping her as she struggled and told him to stop. The victim punched White in the face and was able to get up and attempt to call 911. White is accused of following Jane Doe No. 3 and stopping her from calling the police. The victim ran outside and called 911 from a neighbor's home.

The defendant was re-arrested and charged April 4, 2007, with the rape of Jane Doe No. 3. The Orange County district attorney's office issued a press release about White that day, and several media publicized the case. As a result of the media coverage, three additional victims who had previously been frightened to report the crimes against them came forward to police.

Jane Doe No. 4

Jane Doe No. 4 met and began dating White in 2006 when she was 22 years old. In February 2007, White is accused of beginning to send threatening messages to the victim and spying on her by peering through the blinds into her home. On Feb. 21, 2007, White is accused of breaking into Jane Doe No. 4's home when she was alone, pushing the victim to the ground, and stepping on her chest as he removed her pants and panties. He is accused of forcibly raping the victim as he held a large hunting knife to her neck.

Jane Doe No. 5

Jane Doe No. 5 was renting a room from Jane Doe No. 4. The victim frequently locked her bedroom door using an eye-hook because she had seen White in the apartment before and was alarmed by his aggressive behavior toward her roommate. One night in January 2007, Jane Doe No. 5 locked her bedroom door and went to sleep. White is accused of breaking the lock off the door, entering the bedroom and forcibly raping Jane Doe No. 5. He is accused of threatening to kill her if she reported the rape.

Hopefully, White will get the maximum sentence for his crimes. This will insure that women in bars will not have to put up with White's lures and violence again.

Teenage rapist sentenced to 75 to life for attack on woman

A teenage rapist who attacked a 40 year old woman was sentenced to 75 years to life in a Denver, CO courtroom Wednesday, February 3. Shakiel Madden-Vaughn, who was 16 when he attacked a 40 year old woman who was walking home from a light rail station on January 24, 2009, was convicted by a jury of attempted 1st degree murder, two counts of sexual assault, 1st degree assault, and aggravated robbery for the attack. Madden-Vaughn raped the 40 year old victim, beat her with a baseball bat, then stole her purse.

Madden-Vaughn, who turned 18 the day before Halloween last year, faces charges of fondling a 12 year old girl on a playground January 19, 2009 and hitting a 68 year old woman with a brick. Chief Deputy DA Joseph Morales and Deputy District Attorney P.J. Loew prosecuted the case.

Former teacher gets year in prison and lifetime SO registration for "relationship" with 18 year old girl

Ryan Spicer, a 30 year old ex teacher from Crooksville, OH, was sentenced to a year in prison and lifetime registration as a Tier 3 sex offender for a count of sexual battery. Perry County Common Pleas Court accepted his plea November 16 to a Bill Of Information regarding a count of sexual battery. The victim was a 18 year old girl who Spicer met as a business teacher at Crooksville High School. Spicer was also employed as the assistant football coach at the high school, and worked there from July 24, 2007, to May 20, 2010. Spicer cited "personal" reasons for his resignation.

Kyle Newton, superintendent for the Crooksville Exempted Village School District Board of Education, said once Spicer had resigned, the school was removed from the situation. Newton did say the girl was the only student who has reported any incidents with Spicer.

Although Newton said he and Spicer had a conversation just before Spicer's resignation last year, he would not state what had been discussed. Newton said Monday that when he learned of the situation, he dealt with Spicer as quickly as he could.

According to Newton, Spicer surrendered his taching credentials last month.

LA county health inspector gets 115 days jail, lifetime SO registration for groping donut shop owner

A Los Angeles County health inspector was sentenced to 115 days in jail, three years probation and lifetime sex offender registration February 3 for groping a Pomona, CA doughnut shop owner. Los Angeles County Superior Court Judge David Brougham meted out the sentence February 3 in a Pomona, CA courtroom. 51 year old Magdy Tawadros was convicted on January 26 after jurors found him guilty of a single sexual battery count.

The groping took place March 24, 2010, at the 45 year old victim's shop, Pixie Donuts. A surveillance camera caught Tawadros grabbing the woman in the back room of her shop and touching her chest as she tried to get away. The victim's civil attorney, Tim McDonough, elaborates on the encounter.

"The first actual assault was a hug, at which point the female store owner distracts him and says, 'I have to look out for the customers,' and she escapes, and after that a second altercation occurs where she's reeled in and of course there's some groping that occurs, and some inappropriate hand touching and things of that nature, and at that point a second escape occurs that then leads on to a third physical altercation. He spends about 15 minutes on the premises asking the female store owner if he can date her, and asks for her phone number and apparently leaves another business card with her in an attempt to solicit her to engage in some sort of encounter with him in the future," said McDonough. The victim went to the police March 29, 2010.

Tawadros, who worked in the West Covina bureau of the Los Angeles County Department of Public Health, was initially placed on desk duty, but fired on April 14 after the surveillance tape came to light. According to defense attorney Michael Holmes, "Watching (the jury) view the surveillance tape it was clear they were uncomfortable with what happened and I think that was the deciding factor."

It was the second jury trial in the case. The first ended in a mistrial after Deputy District Attorney Lauren Guber failed to give Tawadros' defense attorney an audio recording she made during interviews with the alleged victim and her husband. Deputy District Attorney Daniel Rochmes prosecuted the case to conviction, Gibbons said. Rochmes could not immediately be reached for comment.

The victim impact statement by the woman and her husband said they were "so relieved now that the jury has found Mr. Tawadros guilty... In our view, he has shown no remorse for what he did and he has fabricated a gross public lie intended to prove that he was innocent and to turn the tables on his victims, our family. He used his advantageous position as a county public code enforcer to commit a criminal act while he was on duty."

A $10 million lawsuit has been filed against Tawadros by the victim.

Oklahoma City serial rapist gets 5 life without parole terms

John Earl Stephney Jr, 33, was sentenced to five life without parole terms for the rapes of five women by
Judge Kenneth Watson on Friday, January 28, 2011. Stepney's guilty plea to the charges did not help him one iota at sentencing.

The judge was told he attacked the first rape victim as she slept in her apartment Nov. 17, 2008. Next, he attacked a woman walking home from work late Dec. 7, 2008.

His third victim was the woman who was doing Christmas shopping the afternoon of Dec. 23, 2008, at Penn Square Mall. His fourth victim was attacked Jan. 5, 2009, as she was doing laundry at her apartment complex.

The fifth victim was attacked on Jan. 7, 2009, as she was vacuuming her car at a car wash. She told police the rapist said, “Maybe next time your husband will come wash your car.” Stepney was arrested the next day.

Stepney forced two victims to let him withdraw cash at ATMs from their bank accounts, according to the police reports and court records. In his attacks, he threatened the women with a BB gun that looked like a real handgun, prosecutors said.

The third victim read an impact statement to the court. “Things are still not back to my ‘normal.' I do not ever sleep well. I hear every little noise and I am jolted awake multiple times every night. Every time I have to walk to my car alone I have such pain and tightness in my chest is it almost unbearable.”

According to police reports, when Stephney saw his victim was looking away, he said “What are you doing not paying attention?" The victim said when she did look at him, he said “Don't look at me. Do you want a .45 bullet to your head?”

Judge Watson said that if the victim had been his daughter, “I wonder if I could let the penitentiary take care of it rather than taking care of it myself.”

As for Stepney, he made no statement during sentencing, but in a pre sentence report he said "I made some bad decisions. I have wrecked lives including my own. I have always had a problem with pornography.”

He also said he was using drugs when “my crimes happened.” He said, “The drugs make you feel like you must have everything you want. They take over you. … All I can really ask for is to be forgiven.”

Stepney's bad decisions have exacted a heavy price on his life and the lives of his victims. Forgiveness will not come from the people of Oklahoma, but perhaps, one day, may come from God .

Fresno insurance company owner sentenced to 10 days jail, 4 years probation for peeping on female employee

A Fresno, CA boss was sentenced to 10 days jail, 20 days in a work program and four years probation Wednesday, January 26 for taking indecent photos of one of his female employees in December 2009. 51 year old insurance company owner Wellman Shew was convicted of misdemeanor peeping after he was found with "disturbing" images on his work computer. If Shew violates his probation, he will be sent to prison and the four years he is scheduled to spend on the sex offender registry will become life.

Police later searched Shew's business on North Cedar Avenue near Alluvial Avenue and found a video that showed a female employee using the restroom. Police said officers also found a fake plant on top of the toilet with a secret compartment and two boxes with holes on the side.

In court Wednesday, [prosecutor Tim]Galstan, a deputy district attorney, informed the judge that there could be multiple victims, because Shew had told police that he was not fixated on just the victim in this case. "I just kind of rotate from people to people," Shew said, according to Galstan.

Just before sentencing, Shew told Judge Dennis Peterson in Fresno County Superior Court that his actions stemmed from a porn addiction, and "Hopefully, she will find in her heart to forgive me." Defense attorney Michael Idiart said that his client has tried to make amends by attending marital counseling, paying a civil settlement, and that "He accepts his punishment and wants to move forward."

The victim also made a statment to the court, asking Judge Peterson to make her peeper register as a sex offender. "Knowledge is power - I want future employees to know what he did." Peterson, when announcing his sentence, cited the vulnerability of the victim and the "sophistication and planning" of the unlawful recording.

Chief Master Sergeant sentenced to 20 months for sexual harassment of subordinates

A former Chief Master Sergeant for the US Air Force was sentenced to 20 months imprisonment and a dishonorable discharge for having "affairs" with ten subordinates. Chief Master Sgt. William Gurney was convicted of 15 counts after a 5 day court martial. Scott Air Force Base, Ill was the site of the court martial. According to the complaint, the sexual misconduct lasted between 2007 and 2009.

Gurney pleaded guilty to seven charges of dereliction of duty for failing to maintain a professional relationship with seven female subordinates, one violation of wrongful misuse of government property, one violation of indecent conduct with a female master sergeant and four violations of committing adultery with four female subordinates, according to a news release from the 375th Air Mobility Wing Public Affairs team at Scott.

Gurney entered the blind plea because he was“derelict in misusing his position by consensually exchanging explicit pictures with female subordinates and by fondling or kissing them.” He also sexted, kissed, and fondled female subordinates, and had sex with his wife with a married subordinate present.

According to prosecutor Capt. Tania Bryant, “As a chief master sergeant in the U.S. Air Force, it was his responsibility to lead, mentor and guide his enlisted troops,” she said. “How did he do that? He abused his position, marred the reputation of AFMC and blackened the eye of the Air Force.”

Defense attorney Maj. Lance Wood said the misconduct was“almost exclusively about mutual affairs with adult women” and that Gurney took “moral and legal responsibility” for his crimes.

However, prosecuting Maj. Patricia Gruen showed photos of Gurney's penis, a photo he sent to a senior airman. Gruen said that that photo, and not his stripes, “was how Chief Gurney chose to represent himself and the U.S. Air Force..He was out there as one of the Air Force’s very, very, very, very best,” she said. “He was Superman. They were flattered and they couldn’t imagine a command chief paid any attention to them, much less directed attention to their careers. But this Superman charged for his services, and he ultimately charged a price they wouldn’t pay.”

During a speech just before sentencing, Gurney said “I essentially lived a double life in which my actions were not those of a senior leader at a majcom of the Air Force,” Gurney said, crying and pausing several times as he read from a statement. “I am not a bad person. I made some bad decisions. I got caught up in a cycle of sin.”

He also talked about how his two daughters were leery of entering a grocery store because of fear of being recognized. The oldest daughter, just 15, is taunted at school because of her father's actions.

Gurney’s confinement was scheduled to begin Friday night, but his case isn’t over. The convening authority, 18th Air Force commander Lt. Gen. Robert Allardice, will review the sentence and have the final say. And Gurney’s dishonorable discharge and his prison term trigger an automatic appeal to the Air Force Court of Criminal Appeals at Joint Base Anacostia-Bolling in Washington, D.C.

Gurney and lawyers for both sides declined to talk with reporters after sentencing. Air Force Materiel Command spokeswoman JoAnne Rumple released a statement on the case, but it did not say if commander Gen. Donald Hoffman has been following the case or he had any comment.

Michelle Lindo McCluer, the executive director of the National Institute Of Military Justice, said “A dishonorable discharge is the worst kind of punitive punishment you can give at a court-martial. I’ve seen that given to people convicted of rape and murder and occasionally desertion. To give it in a case like this? That’s definitely sending a message.”

Besides the dishonorable discharge, Gurney was demoted to airman basic and will be stripped of his $6,215.70 a month pay and allowances while incarcerated.

Mother of two boys gets justice - ex-husband sentenced to 6 years for forced oral copulation

A suburban San Diego man was sentenced to 6 years imprisonment and lifetime registration as a sex offender for the forced oral copulation of wife back in 2008. The victim, Crystal Harris, was attacked initially on March 28, 2008, when Shawn Harris, her husband, forced her to perform oral sex on her, and followed it up with vaginal rape. Three days later, Crystal claimed that her husband force himself on her anally.

Crystal Harris testified that her husband told her the forced sex acts were "punishment" because he believed she had lied to him. The later incident was the trigger for the police investigation.

Shawn Harris testified that the acts were part of sexual role-play.Although the jury found Harris guilty of forcing oral sex, the panel split over the remaining charges of rape and sodomy, and leaned toward acquittal. Instead of retrying Harris on those two counts, prosecutors dropped those charges.

San Diego Superior Court Judge Joan Weber sentenced Shawn Harris to 6 years in prison and a lifetime on the California sex offender registry Monday, January 24. Part of Crystal's victim impact statement is below and the full statement can be found here.

"The very person I expected to protect me from such horrible atrocities was the one person I needed protection from. My heart still breaks when I think about how this happened and how our lives came crashing apart...We can talk about spousal abuse, and we can talk about stranger rape. But we do not talk about spousal rape. Ever. Yet here I was in this situation where my own husband committed this ultimately humiliating and private crime against me."

As for her now ex-husband, the victim said she saw no remorse, only arrogance from her baby's daddy.

"I sincerely apologize to anyone affected by my actions," Shawn Harris said. "I do not feel any ill will toward my spouse."

Judge Weber said to the perpetrator, "Your conduct does show a serious danger to society. I hope at some point you can come to grips with what you did." Weber called the attack the "ultimate taking advantage of a position of trust."

Crystal's battle with her now ex-husband isn't over. They are fighting over the custody of their two sons. He is currently requesting that their sons have the chance to see him while he is behind bars. "It's not fair for someone to force children to visit the man who raped their mother," she said.\

"Blue Eyed Rapist" sentenced to 70 more years in prison - currently serving over 200 years total

David Hopper, 44, the "Blue Eyed Rapist" suspected in an many as 9 attacks on Cincinnati area women between 1992 and 2006, was sentenced to 40 more years in prison by Judge James Flannery. The Burlington, OH man was offered numerous plea deals on the pending charges, including deals to life sentences, which he turned down. He finally accepted a plea deal to a dozen counts regarding the latest victims for 40 years in prison. The victims in this case were raped at a model home showing in 2006.

"Forty years in prison will either cause you to die in prison, or you will be so old you will be harmless at that time you are released. I think society will be adequately protected."

The February 2006 attack on the two model-home attendants in a subdivision near Springboro led to Hopper's arrest in nine attacks since 1992 in Kentucky, Ohio and Indiana.

He pawned two rings he took from one of the women at a Northern Kentucky pawnshop. Hopper was videotaped on security camera. He gave his name, address and Social Security number.
Police charged him in nine attacks on women, many of them store clerks working alone. DNA evidence linked the attacks to Hopper in five cases, authorities said.

That woman decided at Hopper's sentencing that she didn't want to be known as his victim anymore.

"After today, I want to be referred to as the woman who brought the blue-eyed rapist to justice. He has taken enough from me. I was just doing my job that day, and since then, my life has been turned upside down."

In the Warren County attack, prosecutors said Hopper walked into the model home in the Greycliff subdivision with a silver-colored handgun and demanded the women's purses and jewelry.

He forced them into the basement, removed their clothing, sexually assaulted one of them and made the women have sex. He bound and gagged them and barricaded them in the basement, leaving with their clothes and an ATM card.

They squeezed through a basement window and ran naked to a neighbor's house for help.

Prosecutor Rachel Hutzel said about the attacks that "This is about as horrible a crime as you can commit without murdering somebody." His latest 40 year sentence will be added to a 34 year sentence for federal gun charges and state charges related to his Kentucky attacks. The first 32 years of his sentence will be spent at the Federal Medical Center in Lexington, KY (FMC Lexington). Hopper faces more charges in Ohio and Indiana.

(Update 1-27-10) A week ago, on January 19, Hopper was sentenced by Franklin County Common Pleas Judge Pat Sheeran to serve another 23 years in the rape of a suburban Cincinnati GNC clerk which occurred on November 28, 2003. The victim, who attended his sentencing January 19, 2010, said that "I'm the one who has control now. I'm the one with all the freedom while you sit in jail."

Ohio prison sentences are served without chance of parole, and Hopper faces additional trials in Hamilton County, OH and Indiana.

(Update 1-17-11) Last month on December 14, 2010, Hopper was sentenced to 70 additional years imprisonment for the rape of a woman at a shoe store in 2004. The rape occured in Aurora, IN , and Hopper's guilty plea and sentence were handed down in Dearborn County (IN), with Judge James Humphrey presiding. Hopper's official charges he plead guilty to were criminal deviate conduct with a deadly weapon, robbery with a deadly weapon, and criminal confinement with a deadly weapon.

The criminal deviate conduct with a deadly weapon netted Hopper 50 years, and the robbery and criminal confinement counts added 20 more years to Hopper's sentence.

A math teacher accused of sexually assaulting a 17 year old boy at a Chicago West Side college preparatory school was sued by the boy's family yesterday. The suit alleges intentional infliction of emotional distress, willful and wanton misconduct, negligence and breach of fiduciary duty. Damages are over $50,000 per count, excluding court costs.

The student-athlete, an unnamed minor, was recruited and enrolled at Chicago Hope Academy, 2189 West Bowler Street in the Near West Side neighborhood on the West Side, in 2005, the suit said.

Beginning in the spring of 2008, when the boy was 16 years old, his math teacher Kathryn Vail-Wesley, 22, “publicly and privately showered Plaintiff with attention and affection,” the suit said.Vail-Wesley “would hug or touch Plaintiff on an almost daily basis during the 2007-2008 school year, and would invite Plaintiff to her home,” the suit said.

Vail-Wesley was “well-liked” by students, and the boy felt “privileged to receive attention” and looked to her as a “mentor, leader, protector and authority figure,” the suit said.

After the grooming, Vail-Wesley began making phone calls and “gratuitous inappropriate and/or intimate discussion regarding her private life and sexual history,” eventually approaching his for sex because she was fond of him and wanted to “mix [his] chocolate skin with [her] vanilla skin.” This culminated in repeated sexual encounters between August and October of 2008. The end of the relationship occurred after Vail-Wesley’s husband, a fellow teacher at the school, found his wife and the victim, physically assaulting the victim.

Vail-Wesley’s solicitation and sexual exploitation of the boy included sexual touching, kissing, intercourse and other sexual acts. It occurred in various locations, including but not limited to classrooms, passageways, the teacher’s lounge, chapel and other locations on the Academy’s premises, the suit said. Vail-Wesley explained that her sexual behavior was a “reward” for the boy’s good athletic performance for the school's football team, the suit said. She would attend the boy’s football games exclusively wearing his jersey.

Vail Wesley has been charged with 5 counts of sexual assault, with the trial still pending. The lawsuit stated that teacher student boundaries were blurred, particularly between teachers and student-athletes. The perp's sexual actions were “regular and conspicuous” and “should have been apparent” to other teachers and coaches, but "[a]cademy staff turned a blind eye to Vail-Wesley’s inappropriate attention.”

The lawsuit says that school administrators, teachers, and coaches began to intimidate the victim, culminating after the administration gave the boy a choice to either withdraw or be expelled from Chicago Hope, disrupting both his academic and athletic careers.

(1-14-11 - guilty plea to lesser charges) Vail-Wesley was sentenced to 2 years of sex offender probation Wednesday, January 12, 2011 after pleading guilty to aggravated criminal sexual abuse. The other counts of sexual assault were dropped by prosecutors. Chicago Hope principal Mike Laneve said that “Chicago Hope Academy doesn’t discuss school affairs in public.”

Former beauty queen pleads guilty to soliciting kidnapping of "boyfriend," sentenced to 2 years in prison, 6 years probation

A former beauty queen has plead guilty to conspiracy to commit kidnapping and aggravated assault Tuesday, December 8. Twenty-seven year old Kumari Fulbright's guilty plea was heard and accepted by Pima County Superior Court Judge Richard Nichols, who will formally sentence her to two years in prison for aggravated assault and seven years probation for kidnapping.

Fulbright and three other defendants, Larry Hammond, Robert Ergonis, and David Wayne Radde planned and carried out the attack, according to law enforcement. The motive for the attack, according to prosecutors, was Fulbright's anger at her jewelry being pawned off to settle a $16,000 drug debt.

Defense attorney Steve Weiss told Judge Richard Nichols that Fulbright conspired with others to restrain her former boyfriend in December 2007 and brandished a knife near his ear, threatening to cut it. Although she signed a plea agreement, Fulbright was reluctant to verbally acknowledge her actions and accept the terms in court, as required, saying she did not agree with her attorney's description of the crime.

Each time Nichols asked Fulbright if she committed a particular act, she refused to answer directly. Instead answering yes or no, Fulbright told the judge such things as "I agree I'm pleading guilty" or "I am guilty" or "The evidence shows that."

At one point, Fulbright also snapped that she reads, writes and understands English and she signed the plea agreement. Eventually, Fulbright said, "OK, yes" when asked if she conspired to have the man restrained, she brandished the knife and she threatened him with it.

Fulbright was a law clerk for a federal court and a law student at the University of Arizona. She won the Miss Pima County pageant in 2005 and the Miss Desert Sun pageant in 2006. Hammond plead guilty to aggravated assault, and faces a sentence of as much as 8 3/4 years in prison. Radde also plead guilty to kidnapping conspiracy charges and faces 3 to 12 1/2 years in this case as well as another 3 to 12 1/2 years for unrelated drugs and weapons charges. All sentences will be handed down after the trial of Ergonis.

(Update 12-13-10) The former law clerk was sentenced to 2 years imprisonment and 6 years probation for her role in the kidnapping of her "boyfriend." Pima County Superior Court Judge Michael Miller handed down the sentence after Fulbright pled guilty to conspiracy to commit kidnapping and aggravated assault in a Tuscon, AZ courtroom Thursday, December 9.

Defense attorney Steve Sherick asked for 18 months of probation. Prosecutor Michael Jette didn’t specify how long he thought she should be placed on probation, but told Miller she didn’t live up to the terms of her plea agreement and almost had it revoked.Jette told Miller Fulbright has done “anything and everything” to protect Ergonis, thus violating her promise to tell the truth on the stand. She also told Radde what he should testify, Jette said.

[The victim]’s desire to move on with his life is the only reason Fulbright was extended a plea agreement in the first place and it’s the only reason it hasn’t been revoked, Jette said. Fulbright still hasn’t accepted responsibility for her actions or shown remorse, Jette said.

Sherick told Miller his client’s testimony was truthful and consistent with police statements and defense interviews she’s given. The defense attorney cited Fulbright’s remorse and behavior while on pretrial release and while in jail as reasons for a short term of probation.

Besides the prison sentence, Fulbright was also ordered to pay $15,000 restitution to her victim. Ergonis will be sentenced later this week.

(Update 1-12-11) Ergonis was sentenced to 22 1/2 years imprisonment on December 16, 2010. He was convicted in November 2010 by a Pima County jury of aggravated assault with a deadly weapon, kidnapping, armed robbery and aggravated robbery. It was revealed that Fulbright had been "dating" Ergonis for months, writing him while he was on tril to tell him that the prosecution had no case and that she did not want to testify against him.

Wife gets too light sentence for running over and killing husband during drunken argument

A wife who ran over her husband during a drunken argument, killing him, was sentenced to 1 to 3 years in prison by Rockland County County Court Judge Charles Apotheker on January 3, 2011. 33 year old Kelly McElroy of Stony Point, NY, faced a maximum of 7 years for 2nd degree vehicular manslaughter, a sentence that the victim's family wanted. After last October's guilty plea to the vehicular manslaughter charge and a DWI, Judge Apotheker promised a maximum of three years.

In the early morning of January 24, 2010, Kelly McElroy and her husband, Glenn, 26, left a pub and drove home. During a heated argument, the husband got out of the car and Mrs. McElroy, who had a blood alcohol level of 0.16 percent, struck Glenn.

Emergency responded found him unconscious with severe head injuries. He died on January 30 at Nyack Hospital when he was removed from life support.

Rockland District Attorney Thomas Zugibe said his office “ believe[s] that the ends of justice have been served.”

However, local opinion suggested that McElroy's sentence was too light.

Stony Point Mom asked, How can the judge "promise" three years and consider less? That doesn't sound like a promise - it sounds like no justice for Glenn and his family...It's hard to understand how you can be drunk, kill someone's son (and the father of your children) and get away with a slap on the wrist.

What is a human life worth these days? For Rockland County Court Judge Charles Apotheker the answer is 1 to 3 years in prison. Apotheker said that Kelly McElroy, a woman who ran over her husband while driving with a blood-alcohol level of 0.16, will have to, one day, answer to a "higher authority." That's all well and good but Judge Apotheker represents a higher authority in this life. McElroy pleaded guilty in October to second-degree vehicular manslaughter and driving while intoxicated.

Apotheker should be held accountable for this absurd sentence that does not in any way equate to the loss of a young man's life.

Wife who set fire to husband's apartment gets 5 years

A wife who set fire to her husband's Hartwell, OH apartment, destroying it and two others, was sentenced to 5 years in prison followed by 5 years of probation on January 3, 2011. Hamilton County Common Pleas Court Judge Steve Martin imposed the sentence on Shenique Anderson after she plead guilty on November 29 to a single count of aggravated arson. Five counts of arson were dropped by prosecutors as a result of the plea.

During the incident, Anderson claimed that someone was trying to burn down her apartment and was trying to kill her when she called 911. $600,000 in damage was done to 6 apartments, half to the building and the other half to other tenant's property. The husband had a restraining order out on Anderson at the time of the arson.

In court [the] morning [of January 3], Anderson said she believes brain damage she suffered to an organic brain disease, played a part in her setting that fire. She also said she suffers from bi-polar disorder and was in manic-high phase when this happened.

Anderson's apology is as follows. "First off, I want to apologize to my children. We've always had a close relationship and I also want to apologize. I also want to apologize for any inconvenience I have caused on my neighbors."
